s1 2 s3 Stock Amendment (No. 2) No. 376, 1994 ˙ Short title 1. This regulation may be cited as the Stock Amendment Regulation (No. 2) 1994 . ˙ Regulation amended 2. This regulation amends the Stock Regulation 1988 . ˙ Insertion of new ss 7BA and 7BB 3. After section 7B— insert— ˙ Way diseased stock may be destroyed 7BA.(1) This section applies if the chief executive orders— (a) the destruction of— (i) infected or suspected stock; or (ii) an animal product or carcass of infected or suspected stock; or (iii) anything used in connection with infected or suspected stock or an animal product or carcass of infected or suspected stock; or (iv) infected or suspected pasture or fodder; or (b) the removal and destruction of animal pathogen or biological preparation; or (c) the removal and disposal of soil. 1 (2) If the chief executive’s order relates to live stock, the stock must be destroyed in a way consistent with the Australian Veterinary Emergency Plan, Emergency Operations Manual, Destruction of Animals approved by the Agriculture and Resource Management Council of Australia and New 1 See section 15 (Stock may be destroyed in certain cases) of the Act.
s4 3 s5 Stock Amendment (No. 2) No. 376, 1994 Zealand. 2 (3) If the chief executive’s order relates to— (a) the removal and destruction of— (i) an animal product or carcass; or (ii) a thing used in connection with infected or suspected stock or an animal product or carcass of infected or suspected stock; or (iii) infected or suspected pasture or fodder; or (b) the removal or disposal of soil; the thing must be removed and destroyed or disposed of in a way consistent with the Australian Veterinary Emergency Plan, Emergency Operations Manual, Disposal of Carcases, Animal Products, Materials and Wastes approved by the Agriculture and Resource Management Council of Australia and New Zealand. ˙ Rate of compensation for destruction of diseased stock 7BB. The prescribed rate of compensation for section 17 (Owner to be compensated) of the Act is market value.’. ˙ Amendment of Sch 1 (Prescribed diseases) 4. Schedule 1— insert— ‘acute equine respiratory syndrome virus’. ˙ Amendment of Sch 7 (Notifiable diseases) 5. Schedule 7— insert— ‘acute equine respiratory syndrome virus’. 2 This document is available for inspection or purchase at the department’s head office.
