Name of Regulations

These Regulations are the Stevedoring Levy (Distribution of Surplus Levy) Regulations 2007.

Commencement

These Regulations commence on the day after they are registered.

Definitions

In these Regulations:

Act means the Stevedoring Levy (Collection) Act 1998.

responsible person means a person referred to under subsection 8 (1) of the Act.

surplus levy means the surplus under subsection 19 (1) of the Act.

Distribution of surplus levy

(1)For subsection 19 (1) of the Act, the scheme for the distribution of surplus levy is as provided for in this regulation.

Stage 1

(2)The amount of surplus levy that each responsible person is to receive is to be calculated as follows:

(3)If there is any surplus levy remaining after Stage 1, each responsible person is to receive an amount of the levy calculated as follows:
