Stevedoring Industry Levy Collection Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Stevedoring Industry Levy Collection Act 1977.

1.    Commencement

1.1   These Regulations commence on 18 August 1994.

2.   Amendment

2.1   The Stevedoring Industry Levy Collection Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Prescribed class of waterside workers for the purposes of the definition of “Division B waterside worker” in sub-section 3 (1) of the Act)

3.1   Omit the regulation.

4.   Regulation 4 (Prescribed document for the purposes of subsection 3 (2) of the Act)

4.1   Omit “sub-regulation 5 (1)”, substitute “subsection 8A (1) of the Act”.

5.   Regulation 5 (Information to be furnished by ship’s agent)

5.1   Omit the regulation.

6.   Regulation 6 (Penalty for failure to comply with Regulation 5)

6.1   Omit the regulation.

7.   Regulation 11 (Records to be kept)

7.1   Omit “Penalty: $1,000”, substitute “Penalty: 10 penalty units.”.

7.2   Omit “waterside workers;”, substitute “stevedoring employees;”.

8.   Regulation 12 (Information to be given to prescribed person)

8.1   Subregulation 12 (1):

Omit “Penalty: $1,000”, substitute “Penalty: 10 penalty units.”.

8.2   Paragraph 12 (1) (a):

Omit “waterside workers”, substitute “stevedoring employees”.

9.   Schedule

9.1   Form 1:

Omit the form.
