STEVEDORING INDUSTRY FINANCE COMMITTEE REGULATIONS - REG 1
Citation

1. These Regulations may be cited as the Stevedoring Industry Finance Committee Regulations.*1* SEE NOTES TO FIRST ARTICLE OF THIS CHAPTER .

STEVEDORING INDUSTRY FINANCE COMMITTEE REGULATIONS - REG 2
Repeal

2. Statutory Rules 1977 No. 238 and 1978 No. 164 are repealed.

STEVEDORING INDUSTRY FINANCE COMMITTEE REGULATIONS - REG 3
Interpretation

3. In these Regulations, "the Act" means the Stevedoring Industry Finance Committee Act 1977.

STEVEDORING INDUSTRY FINANCE COMMITTEE REGULATIONS - REG 4
Prescribed services and amenities - section 10 of the Act

4. For the purposes of section 10 of the Act, the following are prescribed services and amenities: (a) the provision of refreshments and of facilities for refreshments, including canteens; (b) health services.

Prescribed benefits - paragraph 12 (1) (a) of the Act

5. For the purposes of paragraph 12 (1) (a) of the Act, the following are prescribed benefits: (a) payments of: (i) travelling allowances or expenses to waterside workers; or (ii) the fares of waterside workers; or (iii) the costs of the hire of transport for waterside workers; or (iv) the costs of accommodation and sustenance for waterside workers; that: (v) are in accordance with an award or order of the Industrial Relations Commission in connection with the transfer of the waterside workers between ports; and (vi) are not related to a transfer of the waterside workers, permanently or for an indefinite period, that was arranged because, under an arrangement provided for in an award or order of that Commission or by an agreement between the Association and the Waterside Workers' Federation of Australia, they were redundant at the port from which they were transferred; (b) payments under an award or order of that Commission in respect of the sick leave entitlements of waterside workers: (i) that had accrued immediately before the commencement of the Act; and (ii) for which the Authority within the meaning of the Stevedoring Industry Acts (Termination) Act 1977 was liable.

Prescribed benefits - paragraph 12 (1) (b) of the Act

6. For the purposes of paragraph 12 (1) (b) of the Act, the entitlements provided for in the "one-off" special retirement and redundancy package referred to in subclause 6.2 of the Reform Agreement are prescribed benefits.

Prescribed employees

7. For the purposes of paragraph (b) of the definition of "eligible employee" in subsection 12 (2) of the Act, employees who would have been eligible employees by virtue of paragraph (a) of that definition if the following companies had not ceased to be members of the Association are prescribed employees: (a) Brisbane Cargo Service Pty Ltd (b) Capbulk Handling Company Pty Ltd (c) Conaust Ltd (d) Container Terminals Australia Ltd (e) Mercantile Stevedores (WA) Pty Ltd
