SECT

An Act to impose a Charge in respect of the Employment of Waterside Workers

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 1 
Short title 
SECT

  1. This Act may be cited as the Stevedoring Industry Charge Act 1947. *1*

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 2 
Commencement

  2. This Act shall come into operation on a date to be fixed by
Proclamation.*1*

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 3 
Incorporation 
SECT

  3. The Stevedoring Industry Charge Assessment Act 1947 shall be incorporated
and read as one with this Act.

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 4 
Imposition of charge 
SECT

  4. A charge is imposed in respect of the employment of waterside workers
after the commencement of this Act and before the commencement of the
Stevedoring Industry Levy Act 1977.

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 5 
Rate of charge 
SECT

  5. The rate of the charge is as follows:
  (a)  in respect of the employment of class A waterside workers-such amount,
not exceeding $4.00, per man-hour as is prescribed for the time being;

  (b)  in respect of the employment of class B waterside workers-such amount,
not exceeding $5.00, per man-hour as is prescribed for the time being; and

  (c)  in respect of the employment of class C waterside workers-such amount,
not exceeding $3.00, per man-hour as is prescribed for the time being.

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 6 
Person liable

  6. The charge in respect of the employment of any waterside workers shall be
paid by the employer of those waterside workers.

STEVEDORING INDUSTRY CHARGE ACT 1947 - SECT 7 
Regulations 
SECT

  7.*2* The Governor-General may make regulations, not inconsistent with this
Act, prescribing amounts for the purposes of section 5 of this Act.
*2* S. 7-Section 6 of the Stevedoring Industry Charge Act (No. 2) 1967
provides as follows:

   "6. At any time after this Act receives the Royal Assent and before the
date fixed under sub-section (2) of section 2 of this Act regulations may be
made under the Principal Act as amended by this Act as if the sections of this
Act referred to in that sub-section had come into operation on the day on
which this Act receives the Royal Assent, but regulations so made shall not
come into operation before the date fixed under that sub-section."

  Section 5 of the Stevedoring Industry Charge Act 1971 provides as follows:

   "5. At any time after this Act receives the Royal Assent and before the
date fixed under sub-section (2) of section 2 of this Act regulations may be
made under the Principal Act as amended by this Act as if the sections of this
Act referred to in that sub-section had come into operation on the day on
which this Act received the Royal Assent, but regulations so made shall not
come into operation before the date fixed under that sub-section."
