Application for the production of documents.
[1] These reasons for decision concern an order requiring the applicant to produce documents which was issued by the Commission on 24 July 2015.
[2] The respondent in this matter had applied for a series of orders for the production of documents. Of these the Commission has decided the majority are either not relevant to the issues which are expected to arise in the hearing of this application or will be unreasonably burdensome on third parties which are not directly involved in this application.
[3] A limited number of these documents which the respondent seeks to be produced I am satisfied are relevant to the issues in this application and the order sought does in these instances have a legitimate forensic purpose.
[4] Specifically,
- The applicant’s passport is relevant to establish the Visa status of the applicant at various times and whether during the period of employment she has travelled overseas which may be relevant to her financial capacity at various times.
- Records of Visas applied for and granted appears to be relevant context for this application both with respect to the commencement of the employment and decisions the applicant may have taken to seek alternative Visa sponsorship.
- Bank statements between October 2013 and February 2015, of credit cards only, is relevant as an indication of the financial capacity of the applicant throughout the period of her employment to incur the costs of the disputed training.
- Records of the positions the applicant has applied for since her dismissal is relevant to the matters the Commission is required to consider should it be necessary to determine an amount of compensation to be ordered.
[5] I have considered the implications of such an order on the applicant for each category of document and I am satisfied that an order would not be unreasonably burdensome on the applicant.
[6] For these reasons on 24 July 2015 I issued an order requiring the production of these documents.
