CATCHWORDS
Court management and supervision of appeals - where Registrar refused to allow further adjournment of related proceedings "on the papers" - proceedings further adjourned by court to await next mention of a related criminal prosecution

HIS HONOUR:  The court's order today is to adjourn proceedings 2513 of 2009, 2650 of 2009 and 3775 of 2009 to the 9th of June 2011.

Some explanation of the adjournment may be thought called for, given that today's mention occurs at the initiative of the court, the Registrar having listed the matters and, as I'm told, subsequently declined a request from both sides for an adjournment on the papers.  If the court is going to pursue active case management, then pressure ought to be kept on the parties.

The proceedings I've mentioned and other proceedings of a prosecutorial nature in the Beaudesert Magistrates Court which are to be mentioned there on the 8th of June 2011 all arise out of the Council's contention that Mr Steedman, and perhaps others, have been carrying out, unlawfully, a use of extractive industry at Gleneagle.

Although that activity, according to the chronology which Ms Raymond has handed up and which has been marked Exhibit 1, ceased in August last year, live issues remain, including rehabilitation issues.  Exhibit 1 indicates that Mr Steedman has suffered health problems which have occasioned some delays.

At the present time, steps are in train, or are said to be, for removal of a wash tower on the site and sale of machinery, additional time being required for that.
The parties have thus indicated to the court that things are moving along and it's appropriate to grant the requested adjournment to the day following the next mention in Beaudesert Magistrates Court of the prosecution.
