STATUTORY SALARIES ADJUSTMENT ACT.

Act No. 10, 1975.

An Act to increase the salaries of the Judges of the Supreme Court and District Court and of the holders of certain other statutory offices; for this and other purposes to amend the Constitution Act, 1902, the Supreme Court Act, 1970, the District Court Act, 1973, the Public Service Act, 1902, the Western Lands Act, 1901, the Valuation of Land Act, 1916, the Industrial Arbitration Act, 1940, and certain other Acts in certain respects; to repeal the Statutory Salaries Adjustment Act, 1974; to validate certain matters; and for purposes connected therewith. [Assented to, 8th April, 1975.]

Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the "Statutory Salaries

Adjustment Act, 1975".

The salary payable to the holder of an office specified in Column 1 of Schedule 1 pursuant to the enactment specified opposite that office in Column 2 of that Schedule—

(a)

shall, in respect of the period commencing on, and including, 31st May, 1974, and ending on, and including, 31st December, 1974, be deemed to have been increased to the amount specified opposite that office in Column 3 of that Schedule;

(b)

shall, in respect of the period commencing on, and including, 1st January, 1975, and ending immedi­ ately before the date of assent of this Act, be deemed to have been increased to the amount specified opposite that office in Column 4 of that Schedule; and

(c) is, on and after the date of assent to this Act, office in Column 4 of that Schedule. increased to the amount specified opposite that

3.      (1) The holder of an office specified in Column 1 of

Schedule 2—

(a)

shall, in respect of the period commencing on, and including, 31st May, 1974, and ending on, and including, 31st December, 1974, be deemed to have

been

been entitled to receive an allowance for special expenses incurred by him in the capacity of holder of the particular office at the annual rate specified opposite that office in Column 2 of that Schedule;

(b) shall, in respect of the period commencing on, and including, 1st January, 1975, and ending immedi­ ately before the date of assent to this Act, be deemed to have been entitled to receive an allowance for special expenses incurred by him in the capacity of holder of the particular office at the annual rate specified opposite that office in Column 3 of that Schedule; and
(c) is, on and after the date of assent to this Act, entitled to receive an allowance for special expenses incurred by him in the capacity of holder of the particular office at the annual rate specified opposite that office in Column 3 of that Schedule.

(2) Any allowance to which the holder of any office referred to in subsection (1) is deemed to have been entitled under that subsection in respect of any period before the date of assent to this Act shall be reduced by the amount of any allowance to which he is or was entitled under the Statutory Salaries Adjustment Act, 1974, in respect of that period.

(1) The holder of an office specified in Schedule 3 shall, in respect of the year ending on 30th November, 1975, and in respect of each subsequent year ending on the thirtieth day of November, be entitled to be paid, by way of a lump sum, in addition to the allowance provided in respect of the holder of that office by section 3, a recreation leave allowance of $150 at such time as the Minister determines.

(2) The holder of an office referred to in subsection (1) is not entitled to the recreation leave allowance referred to in that subsection in respect of the year ending on 30th November, 1975, if he has been paid a recreation leave allowance in respect of that year under section 4 of the Statutory Salaries Adjustment Act, 1974.

5.     The Statutory Salaries Adjustment Act, 1974, is hereby

repealed.
