Statutory Declarations Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Statutory Declarations Act 1959.

Citation

1. These Regulations may be cited as the Statutory Declarations Regulations.

Commencement

2. These Regulations commence on 12 December 1991.

Interpretation

3. In these Regulations, unless the contrary intention appears: “the Act” means the Statutory Declarations Act 1959.

Persons before whom a statutory declaration may be made-paragraph 8 (b) of the Act

4. For the purposes of paragraph 8 (b) of the Act, the persons listed in the Schedule are prescribed.

Holder of a Statutory Office

Alderman or Councillor of a Municipal or Shire Council

Senior Executive Service Officer of the Commonwealth Public Service

Permanent Employee of the Commonwealth Government with 5 years service

Senior Executive Service Officer of a State Public Service

Permanent Employee of a State Government with 5 years service

Senior Executive Service Officer of a Territory Public Service

Permanent Employee of a Territory Government with 5 years service

Permanent Employee of a Local Government with 5 years service

Officer of the Australian Navy, the Australian Army, or the Australian Air Force, within the meaning of the Defence Force Discipline Act 1982

Non-Commissioned Officer within the meaning of the Defence Force Discipline Act 1982 with 5 years service

Warrant Officer within the meaning of the Defence Force Discipline Act1982 with 5 years service

Full-time Teacher at a school, or tertiary education institution, with 5 years service

Registered Nurse, or Enrolled Nurse, with 5 years service

Bank Manager

Bank Officer with 5 years service

Building Society Officer with 5 years service

Credit Union Officer with 5 years service

Registered Member of the Institute of Chartered Accountants in Australia, the Australian Society of Certified Practising Accountants or the National Institute of Accountants Postal Manager

Australian Postal Corporation Officer with 5 years service

Person before whom a statutory declaration may be made under the law of the State, or Territory, in which the declaration is made

Australian Consular Officer, or Australian Diplomatic Officer, within the meaning of the Consular Fees Act 1985

NOTE

1. Notified in the Commonwealth of Australia Gazette
