A STATUTE OF THE UNIVERSITY COLLEGE OF SOUTHERN QUEENSLAND
Queensland Subordinate Legislation 1991 No. 92 ————— Department of Education Brisbane, 26th September, 1991 His Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the UniversityofSouthernQueensland Act 1989 , has been pleased to approve the following Statutes made by the Council of the University College of Southern Queensland. ————— PAUL BRADDY A STATUTE OF THE UNIVERSITY COLLEGE OF SOUTHERN QUEENSLAND STATUTE 9—THE STUDENT ASSOCIATION 1. Definitions. In this Statute unless the contrary intention appears— “Board” means the Board of Directors of the Student Association; “member” means a member of the Student Association; “Student Association fees” means fees payable for membership of the Student Association. 2. Powers. (1) For the purpose of carrying out its objects, the Student Association shall have the following powers which may be exercised by the Board— (a) to purchase and in any way deal with lands and other property of any tenure whether real or personal and any interest therein and to grant, acquire, sell and in any way deal in leases of freehold and leasehold land and generally to purchase, sell, exchange, lease, and in
2 Statutes under University of Southern Queensland Act 1989 any way deal with shares, debentures or property, whether real or personal; (b) to borrow money on overdraft or by way of loan from any financial institution or any other person upon, at and subject to such security, rate of interest and other terms and conditions as such institution or person may impose; (c) to apply fees, income, grants and other monies in the nature of grants as are made available to the Student Association for the purpose for which such grants and other monies are intended, and otherwise to use or expend its income howsoever derived in the erection, maintenance and repair of buildings, the purchase of equipment, goods, chattels and stock and for any thing, purpose or use whatsoever; (d) to establish, operate, subsidise and maintain, whether on the property of the UCSQ, Student Association or elsewhere any facilities for student accommodation, refectories, commercial and administrative services and recreational facilities, amenities and all other things without restriction of any kind for the benefit of the members of the Student Association; (e) to employ, pay and dismiss servants, agents and employees and to remunerate any person or company in cash or otherwise by way of honorarium or otherwise for services rendered or to be rendered; (f) to produce, print, publish and circulate a Student Association newspaper and such other student publications in any media form and to carry on the business of printers and publishers; (g) to invest, lend and deal with the monies of the Student Association which are not immediately required from time to time. (h) to generally do all things whatsoever, howsoever that will give effect to or further or better the objects of the Student Association; (i) to promote or acquire any company or association for the purpose of acquiring or taking over all or any of the property, rights and liabilities of the Student Association, or for any other purpose which may seem directly or indirectly calculated to benefit the Student Association; (j) to expel, suspend, fine or reprimand or take any other disciplinary
3 Statutes under University of Southern Queensland Act 1989 action against a member or other person using the facilities or services of the Student Association; (k) to recommend to Council that amendments be made to this Statute; (l) generally to act in any manner authorised by the Act, this Statute or the Constitution or necessary or convenient for giving effect to this Statute or the Constitution. (2) Council may by resolution make available to the Student Association UCSQ lands for the occupation, use and benefit of the Student Association on such terms and conditions determined by council and may from time to time amend, vary or revoke any such resolution after due consultation with the Board. (3) Council may from time to time make to the Student Association such grants and payments of money on such terms and conditions as it may determine in and for the Student Association’s building or other programs. 3. Membership. There shall be the following classes of membership of the Student Association criteria for which shall be as prescribed by the Student Association Constitution— 1 Ordinary 2 Extension Campus 3 Honorary Life 4 Life 5 Associate 6 Reciprocal 7 Casual 4. Student Association Board. There shall be a Student Association Board of Directors which shall— (a) be constituted in the manner and by the persons prescribed in the Student Association constitution; (b) exercise and discharge the functions, powers, authorities and duties conferred or imposed on it by or under this Statute or the Student Association constitution; (c) be responsible for and have the entire control and management of
4 Statutes under University of Southern Queensland Act 1989 the affairs and property of the Student Association. 5. Fees. (1) Student Association fees shall be such as shall be approved by Council after report and recommendation by the Board. (2) Council may by resolution agree to collect Student Association fees on behalf of the Student Association and may levy an appropriate charge for such service. Council shall account to the Student Association for all fees collected. Council shall not be obliged to enforce or sue for payment of the fees it agrees to collect. Council may from time to time amend, vary or revoke any resolution made under this subsection after due consultation with the Board. (3) The Student Association, or UCSQ on behalf of the Student Association, shall refund, for any semester, the Student Association fees paid by a member who ceases to be an enrolled student within such period after the commencement of that semester as the Board from time to time determines. 6. General Meetings and Referendums. (1) Subject to this Statute, proceedings at a general meeting of the Student Association and the manner in which a referendum shall be conducted shall be as prescribed by the Student Association Constitution. (2) A general meeting of the Student Association may debate any issue of concern to members. (3) At a general meeting of the Student Association, each member present shall have one vote. (4) Resolutions passed at any general meeting of the Student Association shall be in the form of a recommendation to the Board. (5) A referendum of members held by the Student Association shall determine Student Association policy on the issues submitted to the referendum. 7. Seal. The Board shall provide for the safe custody of the common seal of the Student Association which shall only be used by the authority of a resolution of the Board. 8. Constitution. (1) Subject to the Act and the Statutes and rules the Student Association Constitution shall provide for— (a) the administration, organisation, finances and functions of the
5 Statutes under University of Southern Queensland Act 1989 Student Association; (b) the implementation of the objects and powers of the Student Association and the other provisions of this Statute; and (c) any other matter required by this statute to be prescribed in the Student Association constitution. (2) Subject to Section 96 of the Act, the Student Association Constitution may be amended, altered or modified in the manner prescribed by the Student Association Constitution. (3) Any Amendment to the Student Association Constitution approved by Council shall take effect on the day after it is approved by Council, or on such later day as may be specified in the resolution passed by the Board and approved by Council. 9. Accounts. (1) The Board shall keep such accounting and other records as will sufficiently explain the transactions and financial position of the Student Association. (2) The Board shall each financial year produce, to a general meeting members of the Student Association for adoption, an audited balance sheet made up at the last day of the Student Association’s financial year, and an audited statement of income and expenditure for that year. (3) A copy of the Student Association’s audited annual balance sheet and statement of income and expenditure shall be transmitted to Council as soon as practicable after it has been adopted by the Student Association.
