Statutes Amendment (Liquor Licensing) Act 2019

An Act to amend the Liquor Licensing (Liquor Review) Amendment Act 2017 and the Statutes Amendment (Attorney-General's Portfolio) Act 2018.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Statutes Amendment (Liquor Licensing) Act 2019.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Liquor Licensing (Liquor Review) Amendment Act 20173Amendment of Schedule 2 – Transitional provisions
  1. (1)

    Schedule 2, clause 5(1)—delete "imposed" first occurring

  2. (2)

    Schedule 2, clause 5(1)—delete "lawfully imposed" and substitute:

    a lawful condition of a licence

  3. (3)

    Schedule 2, clause 5(3)—delete "a term of a licence, or an authorisation or any other right or limitation set out in a licence." and substitute:

    1. (a)

      a term of a licence, or an authorisation or any other right or limitation set out in a licence; and

    2. (b)

      any such condition whether imposed under a provision of old Part 3 Division 2 or any other provision of the principal Act.

Part 3Amendment of Statutes Amendment (Attorney-General's Portfolio) Act 20184Amendment of section 2 – Commencement

Section 2(4)—delete subsection (4) and substitute:

  1. (4)

    Part 3, other than sections 6 and 8, will come into operation on the day on which Part 3 of the Statutes Amendment (Liquor Licensing) Act 2019 comes into operation.

  2. (4a)

    Sections 6 and 8 will come into operation on the day on which section 22 of the Liquor Licensing (Liquor Review) Amendment Act 2017 comes into operation.
