Statutes Amendment (Heavy Vehicle Registration Fees) Act 2017

An Act to amend the Highways Act 1926; and the Motor Vehicles Act 1959.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Statutes Amendment (Heavy Vehicle Registration Fees) Act 2017.

2Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Highways Act 19263Amendment of section 31 – Highways Fund

Section 31(3)—after paragraph (b) insert:

and

1. (c)

   the regulatory component of registration fees collected or received in respect of heavy vehicles (which must, under section 28 of that Act, be paid into the National Heavy Vehicle Regulator Fund).

Part 3Amendment of Motor Vehicles Act 19594Insertion of section 28

After section 27 insert:

28—Payments into National Heavy Vehicle Regulator Fund

1. (1)

   The Registrar must, in accordance with a scheme agreed with the National Heavy Vehicle Regulator, pay into the National Heavy Vehicle Regulator Fund any amounts collected or received in respect of the regulatory component of the prescribed registration fees for heavy vehicles.

2. (2)

   If the prescribed registration fee for a heavy vehicle is to be reduced by the prescribed amount under section 34 or 37, the prescribed amount is to be deducted from the road use component of the registration fee and not the regulatory component.

3. (3)

   In this section—

National Heavy Vehicle Regulator means the National Heavy Vehicle Regulator established under the Heavy Vehicle National Law (South Australia);

National Heavy Vehicle Regulator Fund means the National Heavy Vehicle Regulator Fund established under the Heavy Vehicle National Law (South Australia);

road use component of the prescribed registration fee means those charges other than so much of them as is, or is of a kind, prescribed by the Heavy Vehicle National Regulations (South Australia) as the regulatory component of those charges.
