Statutes Amendment (Attorney-General's Portfolio) (No 3) Act 2022

An Act to amend the Coroners Act 2003 and the Criminal Law Consolidation Act 1935.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Statutes Amendment (Attorney‑General's Portfolio) (No 3) Act 2022.

2Commencement
  1. (1)

    Subject to this section, this Act comes into operation on the day on which it is assented to by the Governor.

  2. (2)

    Part 2 comes into operation immediately after Schedule 1 of the Voluntary Assisted Dying Act 2021 comes into operation.

Part 2Amendment of Coroners Act 20033Amendment of section 3 – Interpretation
  1. (1)

    Section 3(1), definition of reportable death—after "subsection (2)" insert:

    or (2a)

  2. (2)

    Section 3(1), definition of reportable death, (ea)—delete paragraph (ea)

  3. (3)

    Section 3—after subsection (2) insert:

    1. (2a)

      For the purposes of this Act, the death of a person is not reportable if the death occurs as a result of the administration of a voluntary assisted dying substance in accordance with the Voluntary Assisted Dying Act 2021.

4Amendment of section 39 – Annual report

Section 39(2)—delete "all recommendations made by the Coroner's Court under section 25 during that financial year" and substitute:

  1. (a)

    all recommendations made by the Coroner's Court under section 25 during that financial year; and

  2. (b)

    the number of notifications received by the State Coroner under section 84(2) of the Voluntary Assisted Dying Act 2021 during that financial year.
