STATUTE LAW REVISION ACT.

Act No. 35,1937.

An Act to promote the revision of the Statute Law by repealing enactments which have ceased to be in force or have become unnecessary, by correcting certain errors and inaccuracies in enactments, and by adopting the usual regulation making power in certain Acts; and for purposes connected therewith [Assented to, 23rd December, 11)37.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of Xew South by and with the advice and consent of the Legis-

Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . This Act may be cited as the "Statute Law Revision Act, 1937."

The Acts ment ioned in the F i r s t Schedule to th is

repea led :

Prov ided tha t notwi ths tanding the repeal of any of the Acts mentioned in P a r t I I of the said Schedule or the provisions of section ninety-one of the Publ ic W o r k s Act, 1912, the Const ruct ing Author i ty under any such Act shall continue to have the same powers , discret ions, r igh t s and immunit ies in respect to making and mainta in­ ing fencing along any line of ra i lway constructed unde r any such Act as if this section had not been enacted.

3 . The Acts mentioned in the Second Schedule to th i s Act a re hereby amended in the manner shown in the said Schedule.

4 . (1) The repeal by this Act of any enactment shall

not—

(a)

revive anything not in force or existing at the t ime a t which the repeal takes effect; or

(b)

affect the validity, invalidity, effect, or conse­

quences of any th ing a l ready done or suffered;

o r

(c) affect any exist ing s ta tus or capaci ty ; or

(d) affect

a l ready acquired, accrued, or incurred, or any

remedy or proceeding in respect thereof; or

any r ight , t i t le, obligation, or

l iabil i ty

(e)

affect any release or discharge of or from any debt, penal ty , obligation, liability, claim or de­

m a n d ;

or

(f) affect any indemni ty ; or

(g)

affect the proof of any past act or thing, or

the admissibil i ty or inadmissibi l i ty of

evidence

(2) The repeal by this Act of any enactment or

Schedule shall not affect any enactment in which the

enac tment or Schedule has been applied, incorpora ted

o r

re fe r red (3) This Act shall not affect—

to .

(a) any principle or rule of law or equi ty ; or

(b)

any established jurisdiction, form or course of pleading, practice or p rocedure ; or

(c)

the general or public na tu re of any s t a t u t e ; or

(d)

any existing usage franchise liberty custom p r i n l e g e restr ic t ion exemption office appoint­ ment payment allowance emolument or benefit; or

(e)

any prospect ive

r i gh t ;

no twi ths tanding that the same respectively may have been in any manner affirmed recognised or der ived by in or f rom any enactment hereby repealed.

(4) This section shall not l imit any saving in the

5 . Regulat ions made under the au thor i ty of

any

enactment amended or repealed by the Second Schedule to this Act and in force a t the commencement of this Act shall not be affected by such amendment or repeal , but may be amended, repealed or replaced by regulat ions lawfully made after such commencement.
