An Act to repeal certain Acts and amend certain other Acts in various respects and for the purpose of effecting statute law revision; and to make certain savings. [Assented to, 18th December, 1985.]

Statute Law (Miscellaneous Provisions) 1985

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the “Statute Law (Miscellaneous Provisions)

Act 1985”.

Commencement

(1) Except as provided by this section, this Act shall commence on the date of assent to this Act.

(2) Section 5, in its application to a provision of Schedules 6, 7, 8, 9 (7), 11, 14, 18, 19 (2), 22, 23 and 24, shall commence on the day on which the provision commences.

(3) The repeal of the Ministers of the Crown Act 1959 by this Act shall take effect on such day as may be appointed by the Governor and notified by proclamation published in the Gazette.

(4) The several provisions of Schedules 6, 7, 8 and 22 shall commence on such day or days as may be appointed by the Governor and notified by proclamation published in the Gazette.

(5) Schedule 9 (7) shall, if the date of assent to this Act is earlier than the day appointed and notified under section 2 (3) of the Fisheries and Oyster Farms (Amendment) Act 1979 for the commencement of Schedule 4(15) (a) to that Act, commence on the day so appointed and notified.

(6) Schedules 11, 14 and 18 shall commence on the day fixed by Proclamation for the purposes of section 2 (2) of the Australian Citizenship Amendment Act 1984 of the Commonwealth.

(7)	Schedule 19 (2) shall, if the date of assent to this Act is earlier than

the day appointed and notified under section 2 (2) of the Pastures Protection (Amendment) Act 1985 for the commencement of Schedule 1 to that Act, commence on the day so appointed and notified.

Statute Law (Miscellaneous Provisions) 1985

(8) Schedule 23 shall, if the date of assent to this Act is earlier than the

day appointed and notified under section 2 (2) of the Public Notaries Act 1985 for the commencement of that Act (other than sections 1, 2 and 13), commence on the day so appointed and notified.

(9) Schedule 24 shall, if the date of assent to this Act is earlier than the day appointed and notified under section 2 (2) of the Second-hand Dealers and Collectors (Amendment) Act 1985 for the commencement of Schedule 1 (5) (e) to that Act, commence on the day so appointed and notified.

is repealed.

Savings relating to repealed enactments

The repeal by this Act of any enactment does not affect — (b) the continuity, or status as a legal entity, of any body;

(c)	any duty, obligation, liability, benefit, privilege or right saved by the operation of the enactment; or

(d) any amendment or validation made by the enactment.

Interpretation Act 1897

2. The savings contained in this Schedule do not limit any saving in the Interpretation Act 1897.

Transfer of assets, etc., on repeal of Argentine Ant Eradication Act 1962

(1) In this clause, “repealed Act” means the Argentine Ant Eradication Act 1962. (2) On and from the commencement of this Act, all personal property vested in the Minister administering the Argentine Ant Eradication Act 1962 under section 6 of the repealed Act shall vest in the Minister administering the Plant Diseases Act 1924 for the purposes of that Act.

(3) The Treasurer may direct that the account called the Argentine Ant Eradication Campaign Fund, required to be kept in the Special Deposits Account under section 15 of the repealed Act, be closed.

(4) Where the account referred to in subclause (3) is closed any money paid into the account shall be paid into the Consolidated Fund.

Amendment to Noxious Insects Act 1934

4. A regulation made under section 7 (2) of the Noxious Insects Act 1934 and in force immediately before the commencement of this Act shall, on that commencement, be deemed to have been made under section 7 (2) of that Act, as amended by this Act.

Rabbit inspectors

5. A person holding office as a rabbit inspector under the Pastures Protection Act 1934 as in force immediately before the commencement of this Act shall be deemed to have been duly appointed on that commencement as a noxious animal inspector under that Act, as amended by this Act, on the same terms and conditions (including any as to the term of office of the person) as those applicable to the person immediately before that day.

Chairman of Release on Licence Board

6. The amendments made to the Prisons Act 1952 by this Act do not affect the term of office of the person appointed as a member of the Release on Licence Board under section 59 (3) (a) of the Prisons Act 1952, as in force immediately before the commencement of this Act, and that person shall continue to hold office as Chairman of the Board until the expiration of the person’s term of office.

7. Any declaration in force under section 71a of the Public Health Act 1902

immediately before the commencement of Schedule 22 shall be deemed to be a

declaration made under section 7Ia of that Act, as amended by this Act.

Saving of certain rales under Sporting Injuries Insurance Act 1978

8. An amendment made by this Act to section 31 of the Sporting Injuries Insurance

Act 1978 does not operate so as to affect any rule made under that section and in force immediately before the commencement of the amendment.

Metric conversion

9. The provisions of Schedule 31 amending section 58c (1) of the Valuation of Land

Act 1916 are for the purpose of metric conversion, as referred to in section 3 of the

Metric Conversion (Savings) Act 1974.

Effect of amendment of amending provisions

10. An amendment made by Schedule 31 to an amending provision (as defined by the

Reprints Act 1972) contained in an Act shall, if the amending provision has commenced before the date of assent to this Act, be deemed to have taken effect as from the commencement of the amending provision.

Regulations

11. (1) The Governor may make regulations containing other provisions of a savings

or transitional nature consequent on the enactment of this Act. (2) A provision made under subclause (1) may take effect as from the date of assent

to this Act or a later date.

(3) To the extent to which a provision referred to in subclause (1) takes effect from a date that is earlier than the date of its publication in the Gazette, the provision does not operate so as—

(a)	to affect, in a manner prejudicial to any person (other than the State or a public authority), the rights of that person existing before the date of its publication in the Gazette; or
