The following new section is inserted, after New s. 3A. section three of *" The Statistical Returns Act of 1896" (as amended by t" The Bureau of Industry Act of 1932"), and numbered 3A, namely:- " [3A.] In this Act the term "Government ?OV~lr1~ D:ent Statistician" shall mean the "Director" within the StatIstICian. meaning of t" The Bureau of Industry Acts, 1932 to 1934," or any person other than the said Director who may at any time or times be appointed by the Governor in Council to be Government Statistician." 5. Section five of *" The Stock Returns Act of 1893 " is repealed and the following new section is inserted in lieu thereof:- Recovery of penalties. " [5.] All offences against this Act shall be heard and determined and all penalties shall be recovered by complaint in a summary way. Any inspector of stock or member of the Police Force, or any other person authorised under the hand of the Government Statistician, may institute proceedings under this Act. Any person who lays any complaint for an offence against this Act in which complaint it is averred that he has been authorised by the Government Statistician so to do shall in the absence of evidence to the contrary be deemed to have been authorised by the Government Statistician to lay such complaint. The production of a telegram purporting to have been received from the Government Statistician and purporting to authorise any person to institute any prosecution for an offence under this Act or any proceedings shall be admissible as evidence on the prosecution or proceedings, and shall without prejudice to any other method of proof thereof be accepted as evidence of the authority of the officer to institute the prosecution or proceedings." (i.) Section seven is amended, as follows ;- (a) In the last paragraph the words "a return" are repealed and the words "any such return" are inserted in lieu thereof; also after the words "false return " the words " be assessed and " are inserted. (b) The following new paragraphs are added to the said section, namely;- " The amount of any assessment or double assess- ment referred to in this section shall without prejudice to any other provision of this section be a debt due to the Crown and may be recovered accordingly. Any penalty imposed by this section for failing to make a return under t" The Stock Returns Act of 1893 " (or any Act amending the same) or for making any such return of stock which is false in any material particular shall be recoverable summarily on the complaint of any person authorised to institute proceedings under t" The Stock Returns Act of 1893 " (or any Act amending the same). That part of section two of t" The Stock Returns Act of 1893 " consisting of the following words, namely ; - "and any owner failing or neglecting to make such return within one month from the date on which it was due, or who shall make a false return, shall be liable to a penalty not exceeding fifty pounds" shall not apply to an offence against this section."
