AMENDMENT ACT 1976

No. 14 of 1976

An Act to amend the States Grants (Universities) Act 1972-1975.

 

BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:—

Short title and citation.

1. (1) This Act may be cited as the States Grants (Universities) Amendment Act 1976.

(2) The States Grants (Universities) Act 1972-1975 is in this Act referred to as the Principal Act.

(3) The Principal Act, as amended by this Act, may be cited as the States Grants (Universities) Act 1972-1976.

Commencement.

2. (1) Subject to sub-section (2), this Act shall come into operation on the day on which it receives the Royal Assent.

(2) Sections 5 and 19 shall be deemed to have come into operation on 31 December 1975.

Interpretation.

3.Section 2 of the Principal Act is amended by inserting in sub-section (1), after the definition of “non-collegiate accommodation”, the following definition:—

“‘relevant period’ means the period that commenced on 20 November 1975 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent;”.

Salary rates.

4. Section 4 of the Principal Act is repealed.

Grants for expenditure on University building projects, &c.

5. Section 5 of the Principal Act is amended—

(a) by omitting from sub-section (1c) the figures “$2,179,000” and substituting the figures “$223,000”;

(b) by omitting sub-section (1f); and

(c) by omitting from sub-section (4) the words “sub-section (1), (1c), (1d) or (1f)” and substituting the words “sub-section (l), (1c) or (1d)”.

Additional grants for cost increases— University building projects, &c.

6. Section 5a of the Principal Act is amended by omitting from sub-section (2b) the figures “$14,732,928” and substituting the figures “$17,456,000”.

Additional grants for cost increases— building projects of halls and colleges.

7. Section 8a of the Principal Act is amended by omitting from sub-section (4b) the figures “$972,848” and substituting the figures “$1,120,000”.

Recurrent grants in respect of halls of residence and residential colleges.

8. Section 9 of the Principal Act is amended—

(a) by omitting from sub-section (2) the words “each of the years 1974 and 1975, $5,510” and substituting the words “the year 1974, $6,130, and, in respect of the year 1975, $7,150”; and

 

(b) by omitting sub-sections (3) and (4) and substituting the following sub-sections:—

“(3) In relation to each residential college, there is payable to a State under this section, in relation to the year 1974, the amount that is specified in column 2 of the following table in relation to the number of resident full-time students of the college in that year and, in relation to the year 1975, the amount that is specified in column 3 of that table in relation to the number of resident full-time students of the college in that year:—

“(4) In addition to the amount payable in accordance with sub-section (2) or sub-section (3), there is payable under this section, in relation to each hall of residence or residential college—

(a) in respect of the year 1974, the sum of—

(i) an amount calculated by multiplying $73.60 by the number of resident full-time undergraduate students of the hall of residence or residential college in that year;

(ii) an amount calculated by multiplying $36.80 by the number of resident full-time post-graduate students of the hall of residence or residential college in that year; and

(iii) an amount calculated by multiplying $12.30 by the number of non-resident students of the hall of residence or residential college in that year; and

(b) in respect of the year 1975, the sum of—

(i) an amount calculated by multiplying $85.80 by the number of resident full-time under-graduate students of the hall of residence or residential college in that year;

(ii) an amount calculated by multiplying $42.90 by the number of resident full-time post-graduate students of the hall of residence or residential college in that year; and

(iii) an amount calculated by multiplying $14.30 by the number of non-resident students of the hall of residence or residential college in that year.”.

Additional grants for cost increases—teaching hospital building projects.

9. Section 10a of the Principal Act is amended by omitting from sub-section (2b) the figures “$751,360” and substituting the figures “$675,000”.

10. After section 11c of the Principal Act the following sections are inserted:—

Grant for repairs to Clinical Science Building at Royal Brisbane Hospital.

“11d. (1) There is payable to the State of Queensland, for the purpose of financial assistance in relation to expenses incurred by the University of Queensland in carrying out repairs to the Clinical Science Building at the Royal Brisbane Hospital in that State in consequence of damage caused by fire to that building, an amount of $38,920.

“(2) The financial assistance to the State of Queensland by way of payment of an amount under sub-section (1) is granted on the condition that the State will, without undue delay, pay that amount to the University of Queensland.

Reimbursement of moneys expended by States before commencing day on recurrent expenditure of Universities.

“11e. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the relevant period, had been paid by the State to a University situated in that State for the purpose of being applied by the University towards expenditure by the University on university purposes in respect of the year 1975, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11f, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

“(2) The financial assistance to a State constituted by a payment or payments of money under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a University is granted on the conditions—

(a) that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 20 November 1975, applied by the University for expenditure on university purposes otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities; and

(b) if the University is specified in Part IV of the First Schedule and the Commonwealth Education Minister informs the State Education Minister that he is satisfied that the University failed to apply, in the year 1975, for university purposes included in the purposes specified in that Part in relation to that University, an amount that is not less than the amount specified in that Part in relation to that University in respect of that year—that the State will repay the relevant financial assistance, or such part of the relevant financial assistance as the Minister specifies, to the Commonwealth.

Limits on grants under sections 3 and 11e.

“11f. Payments shall not be made to a State under sections 3 and 11e in relation to a University that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under section 3 in relation to the University.

Reimbursement of moneys expended by States on University building projects.

“11g. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the period that commenced on 1 January 1976 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent, had been paid by the State to a University situated in that State for the purpose of being applied by the University towards the carrying out of a project that is specified in relation to that University in the Second Schedule, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11h, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

“(2) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a building project of a University is granted on the condition that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 1 January 1976, applied by the University towards the carrying out of the project, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities.

Limits on grants under sections 5, 5a and 11g.

“11h. Payments shall not be made to a State under any one or more of the following provisions, namely, sections 5, 5a and 11g in relation to a project that is specified in relation to that University in the Second Schedule that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under sections 5 and 5a in relation to that project.

Reimbursement of moneys expended by States on equipment proposals of Universities.

“11j. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the period that commenced on 1 January 1976 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent, had been paid by the State to a University situated in that State for the purpose of assisting the University to meet expenditure incurred, or to be incurred, by the University in accordance with proposals for expenditure in respect of equipment for use by that University approved under section 6 or 6a, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11k, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

“(2) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a University is granted on the condition that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 1 January 1976, applied by the University for the purposes of expenditure in accordance with proposals for expenditure in respect of equipment for use by that University approved under section 6 or 6a, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or any other Act providing for the granting of financial assistance to the States in relation to Universities.

Limits on grants under section 6, sub-sections 6a(1) and (3) and section 11j.

“11k. Payments shall not be made to a State, in relation to proposals for expenditure in respect of equipment for use by a University situated in that State, under any one or more of the following provisions, namely, section 6, sub-sections 6a(1) and (3) and section 11j that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under sections 6 and 6a in relation to those proposals.

Reimbursement of moneys expended by States on additional research expenses incurred by Universities.

“11l. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the relevant period, had been paid by the State to a University situated in that State for the purpose of being applied by the University towards additional research expenses incurred by the University, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11m, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

 

“(2) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a University is granted on the conditions that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 20 November 1975, applied by the University towards the discharge of its outstanding liabilities in respect of additional research, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities.

“(3) Where the State Education Minister for a State makes a request under sub-section (1) in respect of an amount of moneys paid by the State to a University for the purpose referred to in that sub-section, the amount so paid to the University shall not be taken into account as a State contribution to the University for the purposes of section 7.

Limits on grants under sections 7, 7a and 11l.

“11m. Payments shall not be made to a State under any one or more of the following provisions, namely, sections 7, 7a and 11l, in relation to a University that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under sections 7 and 7a in relation to that University.

Reimbursement of moneys expended by States on project of halls of residence and residential colleges of Universities.

“11n. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the period that commenced on 1 January 1976 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent, had been paid by the State to a University situated in that State for the purpose of expenditure by the University in carrying out a project of a hall of residence of that University, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11p, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

“(2) Where the Minister is satisfied that a State has, during the period that commenced on 1 January 1976 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent, paid to the body administering a residential college of a University situated in that State an amount of money towards the expenditure incurred or to be incurred by the body on a project of the college, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11p, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Minister determines not exceeding that first-mentioned amount.

“(3) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a project of a hall of residence of a University is granted on the conditions that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 1 January 1976, applied by the University towards the carrying out of the project, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities.

 

“(4) In this section, references to a project of a hall of residence or to a project of a residential college, have, respectively, the same meaning as in section 8.

Limits on grants under sections 8, 8a and 11n.

“11p. (1) Payments shall not be made to a State, under any one or more of the following provisions, namely, sections 8, 8a and 11n in relation to projects of halls of residence or residential colleges of a University, being projects for the provision of accommodation of a kind in respect of which an amount is specified in relation to that University in a particular column of the Fifth Schedule, that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under sections 8 and 8a in relation to those projects.

“(2) In this section, references to a project of a hall of residence or to a project of a residential college, have, respectively, the same meaning as in section 8.

Reimbursement of moneys expended by States on building projects in connexion with teaching hospitals of Universities.

“11q. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of money which, during the period that commenced on 1 January 1976 and ended on the day immediately preceding the day on which the States Grants (Universities) Amendment Act 1976 received the Royal Assent, had been paid by the State to a University situated in that State for the purpose of assisting the University to meet the cost of a project that is, for the purposes of section a teaching hospital project of that University, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11r, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

“(2) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a teaching hospital project of a University is granted on the condition that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 1 January 1976, applied by the University towards the project, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities.

Limits on grants under sections 10, 10a and 11q.

“11r. Payments shall not be made to a State under any one or more of the following provisions, namely, sections 10, 10a and 11q in relation to a project that is, for the purposes of section 10, a teaching hospital project of a University that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under sections 10 and 10a in relation to that teaching hospital project.

Reimbursement of moneys expended by States before commencing day on recurrent expenditure in respect of teaching hospitals.

“11s. (1) Where the State Education Minister for a State requests the Commonwealth Education Minister to authorize the reimbursement to the State of an amount of moneys which, during the relevant period, had been paid by the State to a University situated in that State for the purpose of being applied by the University in making contributions towards the appropriate costs of the teaching hospital or teaching hospitals of the University, otherwise than out of financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities, the Commonwealth Education Minister may, subject to section 11t, authorize the payment to the State under this sub-section, by way of financial assistance to the State, of such amount as the Commonwealth Education Minister determines, being an amount that does not exceed the amount referred to in the request.

 

“(2) The financial assistance to a State constituted by a payment or payments of moneys under sub-section (1) (in this sub-section referred to as the ‘relevant financial assistance’) in relation to a University is granted on the condition that the State will cause to be furnished to the Commission (not later than 31 December 1976 or such later day as the Minister approves) a certificate by a person approved by the Minister to the effect that the person has satisfied himself that an amount equal to the relevant financial assistance was, after 20 November 1975, applied by the University in making contributions towards the appropriate costs of the teaching hospital or teaching hospitals of that University, otherwise than out of moneys paid to the University by the State from financial assistance granted to the State under this Act or under any other Act providing for the granting of financial assistance to the States in relation to Universities.

“(3) In this section, references to a teaching hospital of a University and to the appropriate costs of a teaching hospital of a University, have, respectively, the same meaning as in section 11.

Limits on grants under sections 11 and 11s.

“11t. Payments shall not be made to a State under sections 11 and 11s in relation to a University that exceed, in the aggregate, the sum of the amounts that, but for this section, would be authorized to be paid to the State under section 11 in relation to that University.”.

11.Section 14 of the Principal Act is repealed and the following sections are substituted:—

Payments may be made out of Consolidated Revenue Fund or Loan Fund.

“14. Payments to a State under this Act may be made—

(a) in the case of payments in accordance with section 5, 5a, 6, 6a, 8, 8a, 10, 10a, 11g, 11j, 11n or 11q, or advances under section 13 on account of moneys expected to become payable in accordance with such a section—out of the Consolidated Revenue Fund or the Loan Fund; or

(b) in any other case—out of the Consolidated Revenue Fund.

Authority to borrow.

“14a. The Treasurer may, from time to time, in accordance with the provisions of the Commonwealth Inscribed Stock Act 1911-1973, or in accordance with the provisions of an Act authorizing the issue of Treasury Bills, borrow moneys not exceeding, in the aggregate, the sum of the amounts that have been paid since 30 June 1975, or that may become payable, in accordance with each of the following sections, namely, sections 5, 5a, 6, 6a, 8, 8a, 10, 10a, 11g, 11j, 11n and 11q.

Application of moneys borrowed.

“14b. Moneys borrowed under section 14a shall be issued and applied only for the expenses of borrowing, for the purpose of making payments to the States in accordance with a section specified in section 14a, for the purpose of making advances to the States in accordance with section 13 on account of moneys that are expected to become payable under a section so specified and for the purpose of making payments to the Consolidated Revenue Fund in accordance with section 14c.

Reimbursement of Consolidated Revenue Fund from Loan Fund.

“14c. (1) Where an amount has, after 30 June 1975, been paid out of the Consolidated Revenue Fund in accordance with a section specified in section 14a, or by way of an advance in accordance with section 13 on account of moneys expected to become payable in accordance with a section so specified, the Treasurer may authorize the payment to that Fund, out of the Loan Fund, of an amount not exceeding the amount so paid.

“(2) In any statements of the receipts and expenditure, or of the expenditure, of the Consolidated Revenue Fund prepared by the Treasurer under section 49 or 50 of the Audit Act 1901-1975, amounts paid to the Consolidated Revenue Fund under sub-section (1) of this section shall not be shown as receipts of that Fund but shall be shown as having reduced the total of the amounts expended from that Fund under this Act.

Appropriation.

“14d. The Consolidated Revenue Fund and the Loan Fund are appropriated as necessary for the purposes of this Act”.

First Schedule.

12.The First Schedule to the Principal Act is amended by omitting Parts II and III and substituting the following Parts:—
