States Grants (Universities) (No. 2)

An Act relating to the Grant of Financial Assistance to the States in Connexion with Universities.

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title and citation.

1.—(1.) This Act may be cited as the States Grants (Universities) Act (No. 2) 1971.

(2.) The States Grants (Universities) Act 1969–1970, as amended by the States Grants (Universities) Act 1971, is in this Act referred to as the Principal Act.

(3.) Section 1 of the States Grants (Universities) Act 1971 is amended by omitting sub-section (3.).

(4.) The Principal Act, as amended by this Act, may be cited as the States Grants (Universities) Act 1969–1971.

Commencement.

2.This Act shall come into operation on the day on which it receives the Royal Assent.

Grants for recurrent expenditure.

3. Section 3 of the Principal Act is amended—

(a) by inserting before sub-section (1.) the following sub-section:—

“(1a.) A reference in this section to the prescribed income of a University in respect of a year shall be read as a reference to the sum of the fees received by the University during that year and the State contributions paid in respect of the University during that year, other than fees or State contributions used for capital expenditure or additional research expenses.”;

(b) by omitting from paragraph (a) of sub-section (1.) the words “sum of the fees received by the University during that year and the State contributions paid in respect of the University during that year (other than fees or State contributions used for capital expenditure or additional research expenses)” and inserting in their stead the words “prescribed income of the University in respect of that year”;

(c) by omitting from paragraph (b) of sub-section (1.) the words “the sum of those fees and State contributions” and inserting in their stead the words “the prescribed income of the University in respect of that year”; and

(d) by inserting after sub-section (2.) the following sub-sections:—

“(2a.) Where the prescribed income of a University in respect of the year One thousand nine hundred and seventy exceeds the amount specified in respect of the University in the second column of Part I. of the First Schedule but the prescribed income of the University in respect of the year One thousand nine hundred and seventy-one is less than the amount specified in respect of the University in the second column of Part II. of that Schedule, the prescribed income of the University in respect of the year One thousand nine hundred and seventy-one shall, for the purposes of

sub-section (1.) of this section, be deemed to be increased by—

(a) the amount by which the prescribed income of the University in respect of the year One thousand nine hundred and seventy exceeds the amount specified in respect of the University in the second column of Part I. of the First Schedule; or

(b) the amount by which the amount specified in respect of the University in the second column of Part II. of that Schedule exceeds the prescribed income of the University in respect of the year One thousand nine hundred and seventy-one,

whichever is the less.

“(2b.) Where the prescribed income of a University in respect of the year One thousand nine hundred and seventy exceeds the amount specified in respect of the University in the second column of Part I. of the First Schedule but the prescribed income of the University in respect of the year One thousand nine hundred and seventy-two is less than the amount specified in respect of the University in the second column of Part III. of that Schedule, then—

(a) if the last preceding sub-section does not apply in relation to the University—the prescribed income of the University in respect of the year One thousand nine hundred and seventy-two shall, for the purposes of sub-section (1.) of this section, be deemed to be increased by the amount by which the prescribed income of the University in respect of the year One thousand nine hundred and seventy exceeds the amount specified in respect of the University in the second column of Part I. of the First Schedule; or

(b) if the last preceding sub-section applies in relation to the University and the amount ascertained in relation to the University in accordance with paragraph (a) of that sub-section exceeds the amount ascertained in relation to the University in accordance with paragraph (b) of that sub-section—the prescribed income of the University in respect of the year One thousand nine hundred and seventy-two shall, for the purposes of sub-section (1.) of this section, be deemed to be increased by the amount of the excess.”.

First Schedule.

4. The First Schedule to the Principal Act is amended by omitting Parts II. and III. and inserting in their stead the following Parts:—

7. The Fourth Schedule to the Principal Act is amended by omitting the words “University College of Townsville” and inserting in their stead the words “James Cook University of North Queensland”.

Fifth Schedule.

8. The Fifth Schedule to the Principal Act is amended by omitting the words “University College of Townsville” and inserting in their stead the words “James Cook University of North Queensland”.

Sixth Schedule.

9. The Sixth Schedule to the Principal Act is amended—

(a) by omitting the words and figures relating to the University of New South Wales and inserting in their stead the following words and figures:—
