Short title.

STATES GRANTS (UNIVERSITIES) ACT 1972
An Act to make provision for the grant of Financial Assistance to the States in connexion with Universities.
Short title amended; No. 32, 1918, s. 2.
1. This Act may be cited as the States Grants (Universities) Act 1972-1973.*

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 2.
Interpretation.

2. (1) In this Act, unless the contrary intention appears-

''additional research expenses'', in relation to a University, means such expenses incurred, otherwise than by way of land and buildings expenditure, by the University, in connexion with research or training in research, as the Commission approves as additional research expenses for the purposes of this Act, being expenses that, in the opinion of the Commission, should not be expected to be met out of funds available for university purposes;

''collegiate accommodation'' means residential accommodation (including related facilities) for students of a University, being accommodation which, having regard to the facilities and services provided for the students, the extent to which, and the manner in which, the students are supervised and to any other considerations that the Commission considers relevant, is, in the opinion of the Commission, of a collegiate nature;

''fees'' means tuition, examination, matriculation and other fees payable to a University by a student enrolled at, or applying for enrolment at, the University in connexion with his course of study or attendance at the University, and includes fees payable to the University in respect of the conferring of a degree or diploma, but does not include-

(a) fees the payment of which is voluntary;

(b) fees payable to an organization of students;

(c) fees in respect of residential accommodation; or

(d) fees payable in connexion with, or in connexion with attendance for the purposes of, studies that are not included in the studies that are required or permitted to be undertaken for the purpose of obtaining a degree or diploma of the University;

''hall of residence'', in relation to a University, means a hall, college or other establishment at which any students of the University reside, being an establishment-

(a) administered by the University, or by a body corporate established by the University; and

(b) approved by the Minister, for the purposes of this Act, as a hall of residence;

''land and buildings expenditure'' means expenditure on the purchase of land, with or without buildings, the planning, erection or alteration of a building, the development or preparation of land for building or other purposes or the installation of water, electricity and other services, other than expenditure on the alteration of a building at a cost of less than Ten thousand dollars;

''non-collegiate accommodation'' means residential accommodation (including related facilities) for students of a University, other than collegiate accommodation;

''residential college'', in relation to a University, means a residential college (not being a hall of residence) affiliated with the University and approved by the Minister, for the purposes of this Act, as a residential college;

''State contribution'' means moneys paid by a State to a University for university purposes, other than moneys paid in fulfilment of the conditions upon which a payment is or has been made to the State by the Commonwealth under this Act or any other Act;

''the Commission'' means the Australian Universities Commission established by the Australian Universities Commission Act 1959-1971;

''University'' means a University referred to in any of the Schedules, and includes any other place of education referred to in the First Schedule;

''university purposes'', in relation to a University, means the general teaching and research purposes of that University in connexion with courses of study at that University, and includes external tuition for courses of study at that University and planning and other preparatory work in connexion with proposed courses of study;

''year to which this Act applies'' means any one of the years 1973, 1974 and 1975.

(2) In this Act, a reference to a Schedule shall be read as a reference to a Schedule to this Act.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 3.
Grants for recurrent expenditure.

Sub-section (1) amended by No. 176, 1973, ss. 4 and 17.
3. (1) In relation to each University specified in Part I of the First Schedule there is payable, in respect of the year to which that Part relates, to the State in which the University is situated, for the purpose of financial assistance-

(a) if the sum of the fees received by the University during that year and the State contributions paid in respect of the University during that year (other than fees used for, or State contributions made for the purposes of, land and buildings expenditure, expenditure in respect of equipment in accordance with proposals approved under section 6 or additional research expenses) is not less than the amount specified in respect of that University in the second column of that Part-the amount specified in respect of that University in the third column of that Part; or

(b) in any other case-so much of the amount specified in respect of that University in the third column of that Part as bears to that amount the same proportion as the sum of those fees and State contributions bears to the amount specified in respect of that University in the second column of that Part.

(2) Where the Minister is satisfied that a State contribution paid after the expiration of the year 1973 related to university purposes in respect of that year, he may, in his discretion and with the approval of the State, direct that, for the purposes of this section, that contribution shall be treated as having been paid during that year.

(2A) There is payable to a State, in relation to each University situated in that State that is specified in the first column of Part II or Part III of the First Schedule, in respect of the year to which Part II or Part III, as the case may be, relates, for the purpose of financial assistance, such amount as is specified in relation to that University in the second column of Part II or Part III, as the case may be, of that Schedule.

(3) The financial assistance to a State by way of payment of an amount under this section in relation to a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University;

(b) the State will ensure that the amount so paid to the University is applied by the University for expenditure on university purposes; and

(c) in the case of a payment in respect of the year 1974 or the year 1975-the State will ensure that no University situated in that State charges fees in respect of that year or any part of that year.

(4) The financial assistance to a State by way of payments under this section in respect of a year in relation to a University specified in Part IV of the First Schedule (other than by way of payments in respect of the year 1973 in relation to the University of Sydney) is granted on the further condition that the State will ensure that the University will, in that year, apply, for university purposes included in the purposes specified in that Part in relation to that University, not less than the amount specified in that Part in relation to that University in respect of that year.

(4A) The financial assistance to the State of New South Wales by way of payments under this section in respect of the year 1973 in relation to the University of Sydney is granted on the further condition that the State will ensure that the University will, during the years 1974 and 1975, apply, for University purposes included in the purposes specified in Part IV of the First Schedule in relation to the University of Sydney, in addition to the amounts specified in that Part in relation to the University of Sydney in respect of those years, an additional amount of not less than $200,000.

(5) A reference in this section to expenditure on university purposes shall be read as not including a reference to land and buildings expenditure, expenditure in respect of equipment in accordance with proposals approved under section 6 or expenditure by way of additional research expenses.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 4.
Salary rates.

4. (1) For the purposes of financial assistance under this Act in respect of a year to which this Act applies-

(a) the approved rate of basic professorial remuneration is $19,102 per annum;

(b) the approved rate of remuneration for an associate professor or a reader is $15,940 per annum;

(c) the approved maximum rate of remuneration for a senior lecturer is $14,308 per annum;

(d) the approved minimum rate of remuneration for a senior lecturer is $12,268 per annum;

(e) the approved maximum rate of remuneration for a lecturer is $11,982 per annum;

(f) the approved minimum rate of remuneration for a lecturer is $8,698 per annum;

(g) the approved maximum rate of remuneration for a principal tutor is $11,044 per annum;

(h) the approved minimum rate of remuneration for a principal tutor is $8,698 per annum;

(i) the approved maximum rate of remuneration for a senior tutor or senior demonstrator is $8,698 per annum;

(j) the approved minimum rate of remuneration for a senior tutor or a senior demonstrator is $7,270 per annum;

(k) the approved maximum rate of remuneration for a tutor or demonstrator is $7,015 per annum; and

(l) the approved minimum rate of remuneration for a tutor or demonstrator is $5,740 per annum.

(2) Where the Minister is satisfied that a University, in a year to which this Act applies, has paid-

(a) basic professorial remuneration at a rate higher than the rate referred to in paragraph (a) of sub-section (1);

(b) remuneration to associate professors or readers at a rate higher than the rate referred to in paragraph (b) of sub-section (1);

(c) remuneration to senior lecturers at a rate higher than, or in accordance with a range of remuneration the maximum rate of which was higher than, the rate referred to in paragraph (c) of sub-section (1);

(d) remuneration to senior lecturers in accordance with a range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (d) of sub-section (1);

(e) remuneration to lecturers at a rate higher than, or in accordance with a range of remuneration the maximum rate of which was higher than, the rate referred to in paragraph (e) of sub-section (1);

(f) remuneration to lecturers in accordance with a range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (f) of sub-section (1);

(g) remuneration to principal tutors at a rate higher than, or in accordance with a range of remuneration the maximum rate of which was higher than, the rate referred to in paragraph (g) of sub-section (1);

(h) remuneration to principal tutors in accordance with a range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (h) of sub-section (1);

(i) remuneration to senior tutors or senior demonstrators at a rate higher than, or in accordance with a range of remuneration the maximum rate of which was higher than, the rate referred to in paragraph (i) of sub-section (1);

(j) remuneration to senior tutors or senior demonstrators in accordance with the range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (j) of sub- section (1);

(k) remuneration to tutors or demonstrators at a rate higher than, or in accordance with a range of remuneration the maximum rate of which was higher than, the rate referred to in paragraph (k) of sub-section (1); or

(l) remuneration to tutors or demonstrators in accordance with a range of remuneration the minimum rate of which was higher than the rate referred to in paragraph (l) of sub-section (l),
the Minister may determine that the amount payable under section 3 in relation to that University in respect of that year shall be limited to such amount as he considers would have been the amount so payable if the approved rates referred to in that sub-section had been observed, and, in making such a determination, the Minister may have regard to the relationship between rates of remuneration referred to in this section and other rates of remuneration paid by the University.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 5.
Grants for expenditure on University building projects, &c.

SECT

Sub-section (1) amended by No. 176, 1973, s. 6.
5. (1) Subject to this section, if a State contribution received by a University specified in the first column of the Second Schedule in the period of three years to which this Act applies was made for the purpose of assisting the University to carry out a project of that University specified in respect of that University in the second column of that Schedule, there is payable under this section to the State in which the University is situated, for the purpose of financial assistance, an amount equal to five times the State contribution.

(1A) Where the Commission is satisfied that the contribution, or the total of the contributions, made during the year 1973 by a State to a University specified in the first column of the Second Schedule for the purpose of assisting the University to carry out a project specified in respect of that University in the second column of that Schedule exceeds one-fifth of the maximum grant specified in the third column of that Schedule in respect of that project the Commission may, at the request of that State, approve-

(a) the reduction of the amount payable to that State under sub- section (1) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-fifth of that maximum grant; and

(b) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (a).

(1B) Where the Minister has, under sub-section (2), approved an amount in substitution for a maximum grant specified in the third column of the Second Schedule, a reference in sub-section (1A) to that maximum grant shall be read as a reference to the amount so approved by the Minister.

(1C) There is payable to the State of New South Wales, during the period of three years to which this Act applies, for the purpose of financial assistance in relation to a project of the University of New South Wales, being a project to erect buildings to house a National School of Management Education, an amount of $1,800,000.

(2) The respective total sums payable to a State under sub-section (1) in relation to the several projects of a University shall not exceed the amounts respectively specified in the third column of the Second Schedule opposite to the descriptions of those several projects or such other amounts, not exceeding in all the sum of the amounts so specified, as are approved by the Minister.

(3) Where a project specified in the Second Schedule consists of, or includes, the erection, alteration or extension of a building, that project shall be deemed to include the provision of furnishings, as approved by the Commission for the purposes of this section, for that building, or for the altered parts or the extensions of that building, as the case may be.

(4) The financial assistance to a State by way of payment of an amount under sub-section (1) or (1C) in relation to a project of a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University; and

(b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, towards the carrying out of that project.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 6.
Grants for equipment.

SECT

6. (1) A University specified in the Third Schedule may, from time to time, submit for the approval of the Commission proposals for expenditure in respect of equipment for use by the University.

(2) The Commission may approve proposals so submitted, subject to such conditions as the Commission determines.

(3) If a State contribution received by a University in the period of three years to which this Act applies was made for the purpose of assisting the University to meet expenditure incurred, or to be incurred, by the University in accordance with proposals approved under this section, there is payable under this section to the State in which the University is situated, for the purpose of financial assistance, an amount equal to five times the State contribution.

(3A) Where the Commission is satisfied that the contribution, or the total of the contributions, made during the year 1973 by a State to a University specified in the Third Schedule for the purpose of assisting that University to meet expenditure incurred, or to be incurred, by the University in accordance with proposals approved under this section exceeds one-fifth of the maximum grant specified in that Schedule in respect of that University, the Commission may, at the request of that State, approve-

(a) the reduction of the amount payable to that State under subsection (3) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-fifth of that maximum grant; and

(b) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (a).

(4) The total of the amounts payable to a State under this section in relation to a University shall not exceed the amount specified in respect of that university in the Third Schedule.

(5) The total of the amounts that may be paid under this section to the State of South Australia in relation to Flinders University of South Australia in respect of equipment other than equipment for the School of Medicine of that University shall not exceed $1,158,000.

(6) The total of the amounts that may be paid under this section to the State of Western Australia in relation to Murdoch University in respect of equipment other than equipment for the School of Veterinary Studies of that University shall not exceed $333,000.

(7) The financial assistance to a State by way of payment of an amount under sub-section (3) in relation to a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University; and

(b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, for the purposes of expenditure in accordance with an approval under this section.

(8) In this section, ''equipment'' includes library material of a kind approved by the Commission for the purposes of this section.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 7.
Special research grants.

Sub-section (1) amended by No. 176, 1973, s. 8.
7. (1) Subject to this section, where, in the period of three years to which this Act applies, a University specified in the Fourth Schedule incurs additional research expenses and applies moneys derived from a State contribution made for the purposes of those expenses towards meeting those expenses, there is payable to the State in which the University is situated, for the purpose of financial assistance, an amount equal to-

(a) five-sixths of those expenses; or

(b) five times the amount derived from a State contribution that is applied towards meeting those expenses,
whichever is the less.

(1A) Where-

(a) the Commission is satisfied that during the year 1973-

(i) a State has made a contribution or contributions to a University specified in the Fourth Schedule for the purpose of meeting additional research expenses in relation to that University; and

(ii) that contribution or those contributions has or have been applied towards meeting those expenses; and

(b) that contribution or the total of those contributions exceeds one-fifth of the maximum grant specified in that Schedule in relation to that University,
the Commission may, at the request of that State, approve-

(c) the reduction of the amount payable to that State under subsection (1) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-fifth of the maximum grant; and

(d) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (c).

(2) The total of the amounts payable to a State under this section in relation to a University shall not exceed the amount specified in respect of that University in the Fourth Schedule.

(3) The financial assistance to a State by way of payment of an amount under sub-section (1) in relation to any expenses of a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University; and

(b) the State will ensure that the University promptly discharges any outstanding liability in respect of those expenses.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 8.
Building grants in respect of halls of residence and residential colleges.

SECT

8. (1) For the purposes of this section, a project of a hall of residence or residential college consists of-

(a) the purchase of land, with or without buildings, for the purposes of the hall or college;

(b) the planning, erection or alteration of a building of or for the hall or college;

(c) the development or preparation of land for such a building or for other purposes of the hall or college;

(d) the installation of water, electricity and other services for the purposes of the hall or college; or

(e) the purchase of furnishings or equipment for a building of the hall or college.

(2) Subject to this section, if-

(a) during the period of three years to which this Act applies-

(i) a State contribution is received by a University for the purpose of expenditure by the University in carrying out a project of a hall of residence; or

(ii) an amount derived otherwise than in consequence of the grant of financial assistance by the Commonwealth to the State in which the relevant University is situated is expended by the body administering a residential college on a project of the college; and

(b) the Minister has, at the request of the State in which the relevant University is situated, approved the grant of financial assistance in respect of the project,
there is payable to that State, for the purpose of financial assistance, such amount as the Commission approves, not exceeding an amount equal to-

(c) five times the amount of the State contribution referred to in sub-paragraph (i) of paragraph (a); or

(d) twice the amount of the expenditure referred to in sub-paragraph (ii) of that paragraph,
as the case may be.

(2A) Where the Commission is satisfied that the contribution, or the total of the contributions, made during the year 1973 by a State to a University specified in the Fifth Schedule for the purpose of expenditure by the University in carrying out projects of halls of residence exceeds one-fifth of the maximum grant specified in that Schedule in respect of collegiate accommodation at halls of residence of that University the Commission may, at the request of that State, approve-

(a) the reduction of the amount payable to that State under sub- section (2) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-fifth of that maximum grant; and

(b) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (a).

(2B) Where-

(a) the Commission is satisfied that during the year 1973-

(i) a State has made a contribution or contributions to bodies administering the residential colleges of a University specified in the Fifth Schedule for the purpose of expenditure on projects of those colleges; and

(ii) that contribution or those contributions has or have been expended by those bodies on those projects; and

(b) that contribution or the total of those contributions exceeds one-twelfth of the maximum grant specified in that Schedule in respect of collegiate accommodation at affiliated residential colleges of that University,
the Commission may, at the request of that State, approve-

(c) the reduction of the amount payable to that State under sub- section (2) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-twelfth of that maximum grant; and

(d) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (c).

(3) Subject to this section, there shall not be paid under this section, in respect of projects in relation to-

(a) collegiate accommodation at halls of residence of a University;

(b) collegiate accommodation at residential colleges of a University; or

(c) non-collegiate accommodation at halls of residence and residential colleges of a University,
amounts exceeding in total the amount set out in respect of that University in the column of the Fifth Schedule that relates to accommodation of that kind.

(4) If, at any time during the period of three years to which this Act applies, the Minister certifies that he is satisfied that the amount specified in a column of the Fifth Schedule in respect of a University exceeds by not less than a specified amount the total of the sums that have become payable, and any further sums that may become payable, under this section to a State in relation to that University in respect of accommodation of the kind to which that column relates, the Commission may, subject to the approval of the Minister, determine that this section shall have effect as if-

(a) an amount determined by the Commission, not exceeding the amount specified in the certificate of the Minister, were deducted from the first-mentioned amount; and

(b) an amount equal to, or amounts determined by the Commission and together equal to, the amount so deducted were added to another amount or other amounts specified in any of the columns of the Fifth Schedule, whether in respect of that University or another University.

(5) The financial assistance to a State by way of payment of an amount under sub-section (2) is granted on the condition that the State will, without undue delay, pay that amount to the University or body administering the hall of residence or residential college.

(6) A State contribution in relation to which a State is entitled to a payment of financial assistance under this section shall not be taken into account for the purposes of section 3.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 9.
Recurrent grants in respect of halls of residence and residential colleges.

SECT

9. (1) There is payable to each State, in respect of each year to which this Act applies, for the purpose of financial assistance in relation to halls of residence and residential colleges of Universities in that State, amounts determined in accordance with this section.

(2) In relation to each hall of residence, there is payable to a State under this section in respect of a year an amount of Five thousand dollars.

(3) In relation to each residential college, there is payable to a State under this section in respect of a year the amount that is specified in the following table in relation to the number of resident full-time students of the college in the year:-

(4) In addition to the amount payable in accordance with sub- section (2) or sub-section (3), there is payable to a State under this section in respect of a year, in relation to each hall of residence or residential college, the sum of-

(a) an amount calculated by multiplying Sixty dollars by the number of resident full-time undergraduate students of the hall of residence or residential college in that year;

(b) an amount calculated by multiplying Thirty dollars by the number of resident full-time post-graduate students of the hall of residence or residential college in that year; and

(c) an amount calculated by multiplying Ten dollars by the number of non-resident students of the hall of residence or residential college in that year.

(5) Where a hall of residence or residential college, or a part of such a hall or college, was not in use during the whole of the academic year comprised in a year to which this Act applies, the Commission may determine that an amount payable under this section in respect of that year in relation to that hall or college shall be such part only of the amount that would otherwise be payable as the Commission thinks appropriate.

(6) The financial assistance to a State by way of payment of an amount under this section in relation to a hall of residence or residential college of a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University or to the body administering the hall of residence or residential college; and

(b) the State will ensure that the amount so paid by the State is used for the provision of tutorial assistance to students of, or for meeting administrative costs of, the hall of residence or residential college.

(7) For the purposes of this section, the number of students of a particular class of a hall of residence or residential college in a year is the number that is the average of the maximum numbers of students of that class during the several terms of that year.

(8) This section does not apply in relation to a hall of residence or residential college that does not provide collegiate accommodation.

(9) In this section-

''college of advanced education'' has the same meaning as in the States Grants (Advanced Education) Act 1972-1973;

''full-time student'' means a student who is pursuing, at a University or at a college of advanced education, a course of study (including a course of study at post-graduate level) which the Commission is satisfied is such as reasonably to require full-time study;

''non-resident student'', in relation to a hall of residence or residential college, means a student of a University, not occupying collegiate accommodation at that, or any other, hall of residence or residential college, who is enrolled as a non-resident student of that hall or college and receiving at that hall or college tutorial assistance other than tutorial assistance that is provided by the relevant University to all students of that University pursuing a particular course of study;

''resident full-time post-graduate student'', in relation to a hall of residence or residential college, means a full-time student who is a resident of the hall of residence or residential college occupying collegiate accommodation and is engaged, at a University or at a college of advanced education, in study or research at post-graduate level;

''resident full-time student'', in relation to a hall of residence or residential college, means a resident full-time undergraduate student or resident full-time post-graduate student of the hall or college;

''resident full-time undergraduate student'', in relation to a hall of residence or residential college, means a full-time student, not being a resident full-time post-graduate student, who is a resident of the hall of residence or residential college occupying collegiate accommodation.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 10.
Grants in respect of building projects, &c., in connexion with teaching
hospitals.

SECT

10. (1) For the purposes of this section, the teaching hospital projects of a University are projects in relation to a hospital referred to in the Sixth Schedule that are to be carried out by the hospital in accordance with arrangements with that University, being projects that are described in the Sixth Schedule opposite to the name of that hospital appearing under the name of that University.

(2) Subject to this section, if a State contribution received by a University specified in the Sixth Schedule in the period of three years to which this Act applies was made for the purpose of assisting the University to meet the cost of a teaching hospital project of that University, there is payable under this section to the State in which the University is situated, for the purpose of financial assistance, an amount equal to five times the State contribution.

(2A) Where the Commission is satisfied that the contribution, or the total of the contributions, made during the year 1973 by a State to a University specified in the first column of the Sixth Schedule for the purpose of assisting the University to meet the cost of a teaching hospital project specified in respect of that University in the second column of that Schedule exceeds one-fifth of the maximum grant specified in the third column of that Schedule in respect of that project, the Commission may, at the request of that State, approve-

(a) the reduction of the amount payable to that State under subsection (2) by an amount equal to the amount by which that contribution or the total of those contributions, as the case may be, exceeds one-fifth of that maximum grant; and

(b) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (a).

(3) The sum of the amounts payable to a State under sub-section (2) in respect of the teaching hospital projects of a University shall not exceed the sum of the amounts specified in the third column of the Sixth Schedule, under the name of that University, opposite to the descriptions of those projects.

(4) The total amount payable to a State under sub-section (2) in respect of any one teaching hospital project of a University shall not exceed-

(a) the amount specified in the third column of the Sixth Schedule, under the name of that University, opposite to the description of that project; or

(b) subject to the last preceding sub-section, where another amount is approved by the Minister, that other amount.

(5) Where a project specified in the Sixth Schedule consists of, or includes, the erection, alteration or extension of a building, that project shall be deemed to include the provision of furnishings, as approved by the Commission for the purposes of this section, for that building, or for the altered parts or the extensions of that building, as the case may be.

(6) The financial assistance to a State by way of payment of an amount under sub-section (2) in relation to a teaching hospital project of a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University; and

(b) the State will ensure that the amount so paid to the University is applied by the University, without undue delay, towards that project.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 11.
Recurrent grants in respect of teaching hospitals.

SECT

11. (1) For the purposes of this section, a reference to a teaching hospital of a University shall be read as including a reference to any hospital in which students enrolled in the Faculty of Medicine of that University receive clinical instruction.

(2) For the purposes of this section, the appropriate costs, in relation to a teaching hospital of a University, are-

(a) the salaries paid to an administrative officer, to clinical supervisors, and to persons whose duties are of a secretarial nature, engaged in the administration of the teaching at that hospital of students enrolled in the Faculties of Medicine of that University and of any other University in relation to which that hospital is a teaching hospital;

(b) the expenditure (other than land and buildings expenditure or expenditure on the purchase of equipment) incurred by the hospital in relation to the parts of the hospital used exclusively by students referred to in the last preceding paragraph and by their teachers and to the facilities and equipment so used in connexion with those parts of the hospital; and

(c) the expenditure, up to an amount of Two thousand five hundred dollars in any year, incurred in the purchase of books and periodicals for the medical library of the hospital.

(3) Where a State furnishes to the Minister such information, certified to be correct by the Auditor-General of the State, as the Minister requires with respect to the State contributions in relation to the appropriate costs of the teaching hospitals of a University incurred in the year 1973, there is payable to the State in which the University is situated, for the purpose of financial assistance-

(a) if the Minister is satisfied that the amount of the State contributions paid to that University during that year in relation to the appropriate costs of those teaching hospitals incurred in that year is not less than the amount specified in respect of that University in the second column of the Part of the Seventh Schedule that relates to that year-the amount specified in respect of that University in the third column of that Part; or

(b) in any other case-so much of the amount specified in respect of that University in the third column of that Part as bears to that amount the same proportion as the amount the Minister is satisfied constitutes those State contributions bears to the amount specified in respect of that University in the second column of that Part.

(4) Where the Minister is satisfied that a State contribution paid after the expiration of the year 1973 related to the appropriate costs of a teaching hospital of a University incurred in that year, he may, in his discretion and with the approval of the State, direct that, for the purposes of this section, that contribution shall be treated as having been paid during that year.

(4A) There is payable to a State, in relation to each University situated in that State that is specified in the first column of Part II or Part III of the Seventh Schedule, in respect of the year to which Part II or Part III, as the case may be, relates, for the purpose of financial assistance, such amount as is specified in relation to that University in the second column of Part II or Part III, as the case may be, of that Schedule.

(5) The financial assistance to a State by way of payment of an amount under this section in relation to the teaching hospitals of a University is granted on the condition that the State will, without undue delay, pay that amount to the University.

(6) A State contribution in relation to which a State is entitled to a payment of financial assistance under this section shall not be taken into account for the purposes of section 3.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 11A.
Grants for assistance to students in need.

11A. (1) In relation to each University specified in the Eighth Schedule there is payable, in the year that commenced on 1st January, 1973, to the State in which the University is situated, for the purpose of financial assistance, the amount specified in the second column of the Eighth Schedule opposite to the name of that University.

(2) The financial assistance to a State by way of payment of an amount under this section in relation to a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University;

(b) the State will ensure that the amount so paid to the University is applied by the University towards assisting students in need; and

(c) the State will, as a condition of the payment to the University, require the University to furnish annually to the Commission statistics and information in respect of the application of the amount by the University.

(3) In this section, ''student in need'' means a student enrolled at a University specified in the Eighth Schedule who is determined by that University to be experiencing hardship by reason of his financial circumstances.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 11B.
Grants for assistance to train additional social workers.

11B. (1) In relation to each University specified in the Ninth Schedule there is payable, in each year specified in that Schedule, to the State in which the University is situated, for the purpose of financial assistance, the amount specified in that Schedule in relation to that University in respect of that year.

(2) The financial assistance to a State by way of payment of an amount under this section in relation to a University is granted on the conditions that-

(a) the State will, without undue delay, pay that amount to the University; and

(b) the State will ensure that the amount so paid to the University is applied by the University towards increasing the number of students being trained as social workers at the University.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 12.
Additional conditions.

SECT

12. (1) In addition to the conditions specified in any other provision of this Act, an amount of financial assistance to a State under this Act is granted on the conditions that-

(a) if the Minister informs the State that he is satisfied that the State has failed to fulfil the conditions applicable to that amount, the State will repay that amount, or such part of that amount as the Minister specifies, to the Commonwealth; and

(b) if that amount exceeds the amount properly payable, the State will repay the excess to the Commonwealth.

(2) An amount of financial assistance to a State under this Act in relation to a project referred to in section 5, 8 or 10 is granted on the conditions that-

(a) particulars of matters in relation to the carrying out of the project will be submitted for the approval of the Commission in accordance with procedures determined by the Minister; and

(b) the project will be carried out, as regards matters to which those procedures relate, in accordance with approvals given by the Commission.

Minister may fix amounts, and times of payment, of financial assistance.

Advances.

SECT

13. The Minister and the Treasurer may make arrangements for the making by the Treasurer to a State, by way of financial assistance to the State, of advances on account of an amount that is expected to become payable under this Act to the State, and the conditions that would be applicable to a payment of the last-mentioned amount are applicable to any such advance.

Appropriation.

14. Payments to a State under this Act shall be made out of the Consolidated Revenue Fund, which is appropriated accordingly.

Progress reports.

SECT

15. The Commission shall furnish to the Minister, at such times as the Minister directs, such reports as the Minister requires on the progress made, and the progress proposed to be made, in the carrying out of the projects specified in the Second Schedule or in the Sixth Schedule or on any other matter relevant to the operation of this Act.

STATES GRANTS (UNIVERSITIES) ACT 1972 - SECT. 16.
Special provisions relating to Wollongong University College and Murdoch
University.

SECT

16. (1) On and after the date of establishment of a University at Wollongong in the State of New South Wales-

(a) references in a Schedule to the Wollongong University College shall be read as references to that University; and

(b) this Act has effect as if things done before that date by or in relation to the Wollongong University College had been done by or in relation to that University.

(2) For the purposes of this Act-

(a) until the establishment of Murdoch University in the State of Western Australia, the Murdoch University Planning Board established by the Murdoch University Planning Board Act, 1970 of that State shall be deemed to be a University, and references in a Schedule to Murdoch University shall be read as references to that Board; and

(b) on and after the date of establishment of Murdoch University, this Act has effect as if things done before that date by or in relation to the Murdoch University Planning Board had been done by or in relation to Murdoch University.
