An Act to make provision for the grant of Financial Assistance to the States in connexion with Universities, and for other purposes.

BE it enacted by the Queen's Most Excellent Majesty, the Senate, and the House of Representatives of" the

Commonwealth of Australia, for the purpose of appropriating

PART I.—PRELIMINARY.

1. This Act may be cited as the States Grants

2.—(1.) Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.

4. The States Grants {Universities) Act 1955 and the Stales Grants {Universities) Act 1956 are repealed.

5. An advance made, before the commencement of this section, 1957 on account of an amount that may have become payable under that Act to the State in relation to a University in respect of the year One thousand nine hundred and fifty-eight shall, upon the commencement of this section, be deemed to have been made to that State under section twelve of this Act on account of amounts that may become payable under section eight of this Act to that State in relation to that University in respect of that year.

PART

I I — G R A N T S

OF FINANCIAL ASSISTANCE.

Interpretation.

6.

—(1.) In this Part, unless the contrary intention appears—

" capital expenditure " means—

{a) expenditure on the erection or purchase of a

building or the purchase of land; and

{b) expenditure, exceeding One thousand pounds, on the alteration of a building or for the purchase of, or otherwise in connexion with, a single item of equipment;

" fees " means tuition, examination, matriculation and other

fees payable to a University by a student enrolled at,

with his course of study or attendance at the University, or applying for enrolment at, the University in connexion

and includes fees payable to the University in respect

of the conferring of a degree or diploma, but does not include fees the payment of which is voluntary or fees payable to an organization of students;

" State grants " means moneys paid by a State to a University for university purposes, other than moneys paid in fulfilment of the conditions upon which a payment is made to the State under this Part or of the conditions upon which a payment has been or is made to the State under the Slates Grants {Universities) Act 1957 or that Act as amended by this Act;

" University " includes the South Australian School of Mines

and Industries;

" university purposes" means the general teaching and research purposes of a University in connexion with courses of study at the University, and includes external tuition for courses of study at the University;

" year to which this Part applies " means the year One thousand nine hundred and fifty-eight, the year One thousand nine hundred and fifty-nine or the year One thousand nine hundred and sixty.

(2.) For the purposes of this Part, moneys paid by the State of Tasmania to the Joint Engineering Board of Management (being the Board established under an agreement made on the first day of January, One thousand nine hundred and twenty-six, between the Minister for Education of the State of Tasmania and the Council of the University of Tasmania) for the general teaching purposes of that Board in connexion with courses of study in chemistry and engineering conducted by that Board in the University of Tasmania and the Hobart Technical College shall be deemed to be moneys paid by that State to the University of Tasmania and to have been so paid for university purposes.

(3.) In this Part, a reference to a Schedule shall be read as a reference to a Schedule to this Act.

7.—(1.) If the sum of the fees and State grants (not being State grants used for capital expenditure) received during a

year to which this Part applies by a University specified in the first column of Part I. of the First Schedule is not less than the amount specified opposite to the name of that University in the second column of that Part of that Schedule, there is payable under this section, in respect of that year, to the State in which the University is situated, for the purposes of financial assistance, an amount equal to the amount specified opposite to the name of that University in such one of the third, fourth and fifth columns of that Part of that Schedule as is applicable to

that year.

(2.) The financial assistance to a State under this section in' relation to a University in respect of a year is granted on the conditions that—

{a) the State will, in respect of each payment in respect of that financial assistance and without undue delay, pay to the University an amount equal to that payment;

{b) the State will ensure that—

(i) a portion of the sum of the amounts so paid to the University, being a portion equal to the amount specified opposite to the name of the University in such one of the second, third and fourth columns of Part II. of the

First Schedule as is applicable to that year, is applied by the University towards the teaching and administrative costs of the residential colleges administered by or affiliated with the University; and

(ii) the remaining portion of the sum of those amounts is applied by the University for expenditure on university purposes, other than expenditure on a project referred to in section nine of this Ac t; and

(c) the State will ensure that, within two months after the expiration of the year in which the State pays an amount to the University in pursuance of paragraph (a) of this sub-section, a statement is furnished to the Minister showing—

(i) the extent to which, and the purposes for which, that amount had been applied by the University before the expiration of that year; and

(ii) the purposes for which the University proposes to apply any part of that amount that had not been applied by the University before the expiration of that year.

General grants

8.—(1.) Subject to this section, if the sum of the fees and State grants (not being State grants used for capital expenditure) received during a year to which this Part applies by a University specified in the first column of a Part of the Second Schedule exceeds the amount specified opposite to the name of that University in the second column of such Part of that Schedule

situated, for the purposes of financial assistance, an amount

equal to the sum of—

(a) one-third of the amount of that excess; and

(b) the amount specified opposite to the name of that

University in the third column of that Part of that

Schedule.

(2.) Subject to the next succeeding sub-section, the amount payable to a State under the last preceding sub-section in relation to a University in respect of a year shall not exceed the amount specified opposite to the name of that University in the fourth column of such Part of the Second Schedule as is applicable to that year.

(3.) If increases in the salaries of members of the academic staff of a University are granted during a year to which this Part applies (being increases that become effective not later than the expiration of that year), the last preceding sub-section does not apply in relation to that University in respect of that year or a subsequent year, but the amount payable under sub- section (1.) of this section in relation to the University to the State in which the University is situated in respect of that year or a subsequent year shall not exceed the amount specified opposite to the name of that University in the fifth column of such Part of the Second Schedule as is applicable to that year or the subsequent year, as the case may be.

(4.) For the purposes of the last preceding sub-section, increases in salaries granted after the twenty-eighth day of November, One thousand nine hundred and fifty-seven, and before the commencement of this Part, shall be deemed to have been granted in the year One thousand nine hundred and fifty- eight.

(5.) The financial assistance to a State under this section in relation to a University in respect of a year is granted on the conditions that—

{a) the State will, in respect of each payment in respect of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and

{b) the State will ensure that—

(i) a portion of the sum of the amounts so paid to the University, being a portion equal to the amount specified opposite to the name of the University in the sixth column of such Part of the Second Schedule as is applicable to that year, is applied by the University towards the teaching and adminis- trative costs of the residential colleges

(ii) the remaining portion of the sum of those amounts is applied by the University for expenditure, not being capital expenditure, on university purposes.

(6.) In the application of this section in relation to the South Australian School of Mines and Industries—-

{a) the reference in sub-section (1.) of this section to fees and State grants received by a University shall be read as a reference to fees and State grants received by the South Australian School of Mines and Industries and expended on courses of study at that School recognized by the University of Adelaide for the purposes of courses for degrees at that University;

(b) the reference in sub-paragraph (i) of paragraph {b) of sub-section (5.) of this section to residential colleges shall be read as including a reference to the residential colleges administered by or affiliated with the University of Adelaide; and

(c) the reference in sub-paragraph (ii) of that paragraph to university purposes shall be read as a reference to the teaching purposes of the South Australian School of Mines and Industries that are connected with courses of study referred to in paragraph (a) of this sub-section.

9.—(1.) Subject to this section, if a State grant received by a during a year to which this Part applies was made for the purpose of assisting the University to carry out a project of that University specified opposite to the name of that University in the second column of that Schedule, there is payable under this section, to the State in which the University is situated, for the purposes of financial assistance, an amount that bears to the amount of the State grant the same proportion as the amount specified opposite to the description of that project in the third column of that Schedule bears to the amount so specified in the fourth column of that Schedule.

(2.) The sum of the amounts payable to a State under the last preceding sub-section in relation to a project of a University shall not exceed the amount specified opposite to the description of that project in the third column of the Third Schedule or such greater amount as the Minister, in a special case, determines.

(3.) The sum of the amounts payable to a State under sub- section (1.) of this section in relation to a University shall not exceed the sum of the amounts specified in the third column of the Third Schedule opposite to the descriptions of the projects of

that University.

(4.) Where an amount is paid to a State under sub-section (1.) of this section for the purposes of financial assistance in relation to a project of a University, being a project that consists of the erection (in whole or in part), or the completion or purchase, of a building, there is also payable under this section to that State, for the purposes of financial assistance, an amount equal to sixteen per centum of that first-mentioned amount.

(5.) The financial assistance to a State under this section in relation to a University is granted on the conditions that—

expenditure on

(a) the State will, in respect of each payment in respect of that financial assistance and without undue delay, pay to the University an amount equal to that payment; and

{b) the State will ensure that—

(i) in the case of an amount so paid in respect of financial assistance under sub-section (1.) of this section, the amount is applied by the University towards the project in respect of which the payment was made; and

(ii) in the case of an amount so paid in respect of financial assistance under the last preceding sub-section, the amount is applied by the University towards equipping the building in respect of which the payment was made or any other building of the University referred to in the second column of the Third Schedule.

10.—(1.) In this section, "affiliated residential college" means a residential college affiliated with, but not administered

(2.) Subject to this section, if—

{a) an amount is expended by an affiliated residential college during a year to which this Part applies on the purchase, erection or alteration of a building of the college, not being an amount paid by the State in which the college is situated in fulfilment of the conditions upon which a payment is made to the State under this Part or of the conditions upon which a payment has been or is made to the State under the States Grants {Universities) Act 1957; and

{b) the State requests the Commonwealth to grant financial assistance under this section in respect of that expenditure,

assistance, such amount, not exceeding one-half of the amount

there is payable to that State, for the purposes of financial

so expended, as is specified in the request as the amount of

financial assistance required in respect of that expenditure.

(3.) The sum of the amounts payable to a State under the last preceding sub-section shall not exceed the amount specified in the second column of the Fourth Schedule opposite to the name of that State.

(4.) The financial assistance to a State under this section is granted on the condition that the State will, in respect of each payment in respect of that financial assistance and without undue delay, pay to the affiliated residential college in relation to which that payment is made an amount equal to that payment.

11. In addition to the conditions specified in any other provision of this Part, an amount of financial assistance to a State under this Part is granted on the conditions that—

(a) if the Treasurer informs the Treasurer of the State that he is satisfied that the State has failed to fulfil the conditions applicable to that amount, the State will repay that amount to the Commonwealth; and

(b) if that amount exceeds the amount properly payable, the

State will repay the excess to the Commonwealth.

Advances.

12. The Treasurer may, at such times as he thinks fit, make advances of such amounts as he thinks fit to a State on account of an amount that may become payable under this Part to the State.

Appropriation.

13. Payments under this Part shall be made out of the

Consolidated Revenue Fund, which is appropriated accordingly.

PART III.—AMENDMENTS OF THE STATES GRANTS (UNIVERSITIES)

14.—(1.) In this Part, the States Grants (Universities)
