CONSEQUENTIAL AMENDMENTS OF PRINCIPAL ACT

States Grants (Tertiary Education Assistance) Amendment Act (No. 3) 1985

An Act to amend the States Grants (Tertiary Education Assistance) Act 1984, and for related purposes

[Assented to 11 December 1985]

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title, &c.

1. (1) This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act (No. 3) 1985.

(2) The States Grants (Tertiary Education Assistance) Act 19841is in this Act referred to as the Principal Act.

Commencement

2. (1) Sub-section 3 (1) shall be deemed to have come into operation on 4 June 1985.

(2) The remaining provisions of this Act shall come into operation on the day on which it receives the Royal Assent.

Interpretation

3. (1) Section 3 of the Principal Act is amended by omitting from sub-section (5) “Community College” and substituting “Institute of Technology”.

(2) Section 3 of the Principal Act is amended—

(a) by inserting after paragraph (c) of the definition of “fees” in sub-section (1) the following paragraph:

“(ca) fees imposed in accordance with guidelines determined by the Minister, by notice in writing published in the Gazette, for the imposition of fees in respect of overseas students;”;

(b) by inserting after the definition of “fees” in sub-section (1) the following definition:

“‘institute of tertiary education’ means an institution situated in a State, or a proposed institution to be situated in a State, that is specified in a direction for the time being in force under section 5a of the Commonwealth Tertiary Education Commission Act 1977;”;

(c) by inserting “, institute of tertiary education” after “institution” in paragraph (a) of the definition of “relevant institution” in sub-section (1);

(d) by inserting after sub-section (6) the following sub-section:

“(6a) For the purposes of this Act—

(a) a State shall be deemed to have paid moneys to an institute of tertiary education that is not a body corporate if it has paid those moneys to the body administering that institute; and

(b) an institute of tertiary education that is not a body corporate shall be deemed to have done any act or thing that is required or permitted by this Act to be done if the body administering the institute has done that act or thing.”;

(e) by inserting after sub-section (7) the following sub-section:

“(7a) Where—

(a) a State proposes to establish an institute of tertiary education;

(b) the name of the proposed institute is specified in a Schedule to this Act; and

(c) an institute under that name has not been established or a body has not been established to administer the proposed institute,

then, for the purposes of this Act—

(d) there shall be deemed to be in existence an institute of tertiary education under that name;

 

(e) the State shall be deemed to have paid moneys to the institute if it has paid those moneys to such person or body as the Minister determines to be the appropriate authority in relation to the institute for the purposes of this Act; and

(f) the institute shall be deemed to have done any act or thing that is required or permitted by this Act to be done if the appropriate authority in relation to the institute has done that act or thing.”; and

(f) by omitting from sub-section (8) “or technical and further education institute” and substituting “, technical and further education institution or institute of tertiary education”.

Grants for recurrent expenditure of technical and further education institutions

4. Section 6 of the Principal Act is amended by omitting from sub-section (3) “the year 1985” and substituting “either of the years 1985 and 1986”.

Promotion of equality of opportunity

5. Section 7 of the Principal Act is amended—

(a) by omitting from paragraph (5) (a) “$1,079,000” and substituting “$1,086,000”;

(b) by omitting from paragraph (5) (b) “$1,093,000” and substituting “$1,140,000”; and

(c) by omitting from paragraph (5) (c) “$1,093,000” and substituting “$1,140,000”.

Recurrent grants may be increased to assist institutions in promoting greater participation of Aboriginals in tertiary education

6. Section 8 of the Principal Act is amended—

(a) by omitting from paragraph (3) (b) “$1,640,000” and substituting “$2,601,000”; and

(b) by omitting from paragraph (3) (c) “$2,186,000” and substituting “$3,841,000”.

Special assistance for students

7. Section 9 of the Principal Act is amended by omitting from sub-section (2) “$10,756,000” and substituting “$11,090,000”.

Key centres of teaching and research

8. Section 10 of the Principal Act is amended—

(a) by omitting from paragraph (4) (a) “$1,079,000” and substituting “$1,086,000”;

(b) by omitting from paragraph (4) (b) “$1,093,000” and substituting “$1,140,000”; and

 

(c) by omitting from paragraph (4) (c) “$1,093,000” and substituting “$1,140,000”.

Recurrent grants may be increased to assist institutions in meeting certain superannuation expenses

9. Section 11 of the Principal Act is amended—

(a) by omitting from paragraph (3) (a) “$16,401,000” and substituting “$16,507,000”;

(b) by omitting from paragraph (3) (b) “$20,986,000” and substituting “$21,878,000”; and

(c) by omitting from paragraph (3) (c) “$24,265,000” and substituting “$25,297,000”.

Recurrent grants in respect of student residences and affiliated colleges

10. Section 12 of the Principal Act is amended—

(a) by omitting from paragraph (2) (a) “$2,504,000” and substituting “$2,521,000”;

(b) by omitting from paragraph (2) (b) “$1,318,000” and substituting “$1,374,000”;

(c) by omitting from paragraph (3) (a) “$771,000” and substituting “$777,000”; and

(d) by omitting from paragraph (3) (b) “$391,000” and substituting “$407,000”.

Special research centres

11. Section 14 of the Principal Act is amended—

(a) by omitting from paragraph (4) (a) “$5,104,000” and substituting “$5,132,000”;

(b) by omitting from paragraph (4) (b) “$5,161,000” and substituting “$5,383,000”; and

(c) by omitting from paragraph (4) (c) “$5,161,000” and substituting “$5,383,000”.

Interpretation

12. Section 19 of the Principal Act is amended by omitting “the year 1985” and substituting “either of the years 1985 and 1986”.

Equipment grants for technical and further education

13. Section 33 of the Principal Act is amended by omitting from sub-section (6) “the year 1985” and substituting “either of the years 1985 and 1986”.

Approval of, and directions relating to, additional building projects

14. Section 37 of the Principal Act is amended—

(a) by omitting from paragraph (1) (c) “and” (last occurring);

 

(b) by inserting after paragraph (1) (c) the following paragraph:

“(ca) may approve a building project (other than a minor building project) submitted to the Minister by a State as an approved building project of an institute of tertiary education in respect of a year to which this Act applies; and”;

(c) by omitting from sub-section (2) “and 20” and substituting “, 20 and 20a”;

(d) by omitting from sub-section (4) “or a technical and further education institution” and substituting “, a technical and further education institution or an institute of tertiary education”; and

(e) by omitting from sub-section (4) “or 20” and substituting “, 20 or 20a”.

Major building projects

15. Section 38 of the Principal Act is amended—

(a) by omitting from paragraph (1) (a) “or”;

(b) by inserting after paragraph (1) (b) the following word and paragraph:

“; or (c) is specified, in relation to an institute of tertiary education, in Column 2 of Schedule 20a,”;

(c) by omitting from sub-section (1) “or college” and substituting “college or institute”;

(d) by inserting in sub-section (2) “or 1986” after “1985”;

(e) by inserting in sub-section (2) “or 5, as the case requires,” after “Column 4”; and

(f) by adding at the end of sub-section (2) “and to that year”.

Conditions attaching to building grants

16. Section 40 of the Principal Act is amended—

(a) by omitting from paragraph (3) (b) “or”; and

(b) by adding at the end of sub-section (3) the following word and paragraph:

“; or (d) in a case where the relevant institution is an institute of tertiary education—a building project specified in Column 2 of Schedule 20a in relation to the institute.”.

Variation of certain Schedules relating to building projects

17. Section 41 of the Principal Act is amended—

(a) by omitting from sub-section (2) “or (c)” and substituting “, (c) or (ca)”;

(b) by omitting from paragraph (2) (a) “or 20” and substituting “, 20 or 20a”;

(c) by omitting from sub-section (3a) “or 20” and substituting “, 20 or 20a”;

(d) by omitting from sub-section (3b) “or 20” and substituting “, 20 or 20a”; and

(e) by inserting in sub-section (4) “20a,” after “20,”.

Grants for approved courses provided by non-government business colleges

18. Section 44 of the Principal Act is amended—

(a) by omitting from sub-section (1) “1985” and substituting “in a year to which this Act applies”;

(b) by omitting from sub-section (2) “the year 1985” and substituting “a year to which this Act applies”;

(c) by omitting from sub-section (2) “Column 2 of Schedule 23” and substituting “the Column of Schedule 23 that relates to that year”;

(d) by omitting from sub-section (3) “the year 1985” and substituting “a year to which this Act applies”;

(e) by omitting from sub-section (4) “the year 1985” and substituting “a year to which this Act applies,”;

(f) by omitting from sub-paragraph (4) (b) (ii) “1986” and substituting “next following the end of that year”; and

(g) by adding at the end the following sub-section:

“(5) In this section, ‘year to which this Act applies’ means either of the years 1985 and 1986.”.

Repeal and substitution of Schedules

19. Schedules 1 to 23 (inclusive) to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted.

Consequential amendments

20. The Principal Act is amended as set out in Schedule 2 to this Act.

Payments made before Royal Assent

21. Payments (including advances) by way of financial assistance made to a State or to the Northern Territory under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.

CONSEQUENTIAL AMENDMENTS OF PRINCIPAL ACT

The Principal Act is amended by omitting “the year” (wherever occurring) from the following provisions and substituting “a year”:

Sub-sections 6 (1) and (2), 20 (1), (2), (4) and (5), 21 (1), (2) and (4), 22 (1), (2), (4) and (5) and 23 (1), (2), (4) and (5), section 24 and sub-sections 25 (3) and (4) and 33 (2), (3), (4) and (5).
