REGULATIONS UNDER THE STATES GRANTS (SCHOOLS) ACT 1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the States Grants (Schools) Act 1973.

STATES GRANTS (SCHOOLS) (BOARDS FOR CATHOLIC SYSTEMIC SCHOOLS) REGULATIONS

Citation.

1. These Regulations may be cited as the States Grants (Schools) (Boards for Catholic Systemic Schools) Regulations.

Interpretation.

2. In these Regulations—

“Chairman”, in relation to a Board for Catholic Systemic Schools, means the Chairman of the Board elected in accordance with sub-regulation 5 (1) and includes, in relation to a meeting of the Board at which the Chairman is not present, a member of the Board elected as Chairman of that meeting in accordance with sub-regulation 6 (3);

“Roman Catholic Education Authorities”, in relation to a State, means the authorities responsible for the administration of Catholic systemic schools in the State;

“the Act” means the State Grants (Schools) Act 1973.

Establishment of Boards.

3. There is hereby established, for each State, a Board for Catholic Systemic Schools.

Constitution of Boards.

4. (1) The Board for Catholic Systemic Schools for a State shall consist of five members, two of whom shall be appointed by the Minister and three of whom shall be appointed by the Roman Catholic Education Authorities in that State.

(2) A member of the Board for Catholic Systemic Schools for a State may resign his office by notice in writing addressed—

(a) in the case of a member appointed by the Minister—to the Minister; or

(b) in the case of any other member—to the Roman Catholic Education Authorities in that State.

(3) A vacancy occurs in the office of a member of a Board for Catholic Systemic Schools where that member—

(a) dies; or

(b) resigns as a member of the Board.

(4) Where a vacancy occurs in the office of a member of the Board for Catholic Systemic Schools for a State, a new member shall be appointed in the place of that first-mentioned member—

(a) in the case of a vacancy that occurs in the office of a member appointed by the Minister—by the Minister; or

(b) in the case of a vacancy that occurs in the office of any other member—by the Roman Catholic Education Authorities in the State.

(5) As soon as practicable after the appointment of a member of the Board for Catholic Systemic Schools for a State—

(a) in the case of a member appointed by the Minister—the Minister shall, by notice in writing, notify the Roman Catholic Education Authorities in that State of the appointment and the name of that member; or

(b) in the case of a member appointed by the Roman Catholic Education Authorities in that State—those Authorities shall, by notice in writing, notify the Minister of the appointment and the name of that member.

Chairman.

5. (1) The members of the Board for Catholic Systemic Schools for a State shall elect one of their number to be the Chairman of the Board.

(2) The Chairman of a Board for Catholic Systemic Schools may resign his office by notice in writing addressed to the other members of the Board.

Meetings of the Board.

6. (1) Meetings of a Board for Catholic Systemic Schools shall be held at such times and places as the Chairman of the Board determines or as are fixed by or in pursuance of a resolution of the Board.

(2) The Chairman of a Board for Catholic Systemic Schools shall preside at all meetings of the Board at which he is present.

(3) Where the Chairman of a Board for Catholic Systemic Schools is not present at a meeting of the Board, the members of the Board present shall elect one of their number to be the Chairman of the meeting.

(4) At meetings of a Board for Catholic Systemic Schools, the Chairman has a deliberative vote but does not have a casting vote.

Quorum.

7. At a meeting of the Board for Catholic Systemic Schools for a State, three members, including not less than one of the members appointed by the Minister and two of the members appointed by the Roman Catholic Education Authorities in the State, shall form a quorum.
