STATES GRANTS (SCHOOLS) ACT 1974

No. 110 of 1974

An Act to Increase the Financial Assistance payable to the States in relation to Schools.

 

BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows: —

PART I—PRELIMINARY

Short title.

1. This Act may be cited as the States Grants (Schools) Act 1974.

Commencement.

2. This Act shall come into operation on the day on which it receives the Royal Assent.

PART II—AMENDMENTS OF STATES GRANTS (SCHOOLS) ACT 1972-1973

Citation.

3. (1) In this Part, the States Grants (Schools) Act 1972-1973 is referred to as the Principal Act.

(2) The Principal Act, as amended by this Part, may be cited as the States Grants (Schools) Act 1972-1974.

Grants to States for building projects in connexion with schools.

4. Section 8 of the Principal Act is amended—

(a) by omitting from paragraph (a) of sub-section (3) the words “the second column of the Schedule to this Act” and substituting the words “column 2 of the Schedule”.

(b) by omitting from paragraph (b) of sub-section (3) the words “the third column” and substituting the word and figure “column 3”; and

(c) by omitting sub-sections (4) and (5) and substituting the following sub-sections:—

“(4) The Minister shall not authorize payments to the States under this Part, in respect of building projects in connexion with government schools, that—

(a) in the case of payments authorized on or before 30 June 1975 (including payments authorized before the commencement of the States Grants (Schools) Act 1974)—exceed, in the aggregate, $63,761,500;

(b) in the case of payments authorized on or before 30 June exceed, in the aggregate, $101,247,500; or

(c) in the case of payments authorized on or before 30 June 1977—exceed, in the aggregate, $136,247,500.

“(5) The Minister shall not authorize payments to the States under this Part, in respect of building projects in connexion with non-government schools, that—

(a) in the case of payments authorized on or before 30 June 1975 (including payments authorized before the commencement of the States Grants (Schools) Act 1974)— exceed, in the aggregate, $18,511,500;

(b) in the case of payments authorized on or before 30 June exceed, in the aggregate, $29,222,000; or

(c) in the case of payments authorized on or before 30 June exceed, in the aggregate, $39,222,000.”.

Schedule.

5. The Principal Act is amended by omitting the Schedule and substituting the following Schedule:—

PART III—AMENDMENTS OF STATES GRANTS (SCHOOLS) ACT 1973

Citation.

6. (1) In this Part, the States Grants (Schools) Act 1973 is referred to as the Principal Act.

(2) The Principal Act, as amended by this Part, may be cited as the States Grants (Schools) Act 1973-1974.

Grants for recurrent expenditure of non-systemic schools.

7. Section 15 of the Principal Act is amended—

(a) by inserting before sub-section (1) the following sub-section:—

“(1a) In this section, ‘period to which this section applies’ means—

(a) the period of 6 months that commenced on 1 January 1974;

(b) the period of 6 months that commenced on 1 July 1974; or

(c) the year commencing on 1 January 1975.”;

(b) by omitting from sub-section (1) the words “year to which this Act applies” and substituting the words “period to which this section applies”; and

(c) by omitting sub-section (5) and the table at the foot of that sub­section and substituting the following sub-section and table:—

“(5) There is payable (and, in respect of the period of 6 months that commenced on 1 January 1974, there shall be deemed to have been payable) to a State under this section, in respect of each period to which this section applies, by way of financial assistance to the State in respect of recurrent expenditure of each non-systemic school in the State—

(a) in the case of the period of 6 months that commenced on 1 January 1974—

(i) if the school is a non-government primary school—an amount equal to the product of the amount specified in column 2 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving primary education at the school on the date in the year that commenced on 1 January 1974 that is the schools census date for that State for that year; and

 

(ii) if the school is a non-government secondary school—an amount equal to the product of the amount specified in column 3 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving secondary education at the school on the date in the year that commenced on 1 January 1974 that is the schools census date for that State for that year;

(b) in the case of the period of 6 months that commenced on 1 July 1974—

(i) if the school is a non-government primary school—an amount equal to the product of the amount specified in column 4 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving primary education at the school on the date in the year that commenced on 1 January 1974 that is the schools census date for that State for that year; and

(ii) if the school is a non-government secondary school—an amount equal to the product of the amount specified in column 5 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving secondary education at the school on the date in the year that commenced on 1 January 1974 that is the schools census date for that State for that year; and

(c) in the case of the year commencing on 1 January 1975—

(i) if the school is a non-government primary school—an amount equal to the product of the amount specified in column 6 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving primary education at the school on the date in that year that is the schools census date for that State for that year; and

(ii) if the school is a non-government secondary school-an amount equal to the product of the amount specified in column 7 of the table set out at the foot of this sub-section opposite to the category specified in column 1 in which the school is included and the number of pupils receiving secondary education at the school on the date in that year that is the schools census date for that State of the year.

8. Section 53 of the Principal Act is amended by omitting from sub-section (3) the figures “$6,000,000” and substituting the figures “$7,200,000”.
