An Act relating to the grant of financial assistance to the States for primary and secondary education, and for related purposes

The Parliament of Australia enacts:

1Short title

This Act may be cited as the States Grants (Primary and Secondary Education Assistance) Legislation Amendment Act 2004.

2Commencement

1. (1)

   Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur.	1 January 2005 (paragraph (a) applies)

Note: This table relates only to the provisions of this Act as originally passed by the Parliament and assented to. It will not be expanded to deal with provisions inserted in this Act after assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1Amendments

States Grants (Primary and Secondary Education Assistance) Act 2000

At the end of subsection 59(5)

Add:

1. ; (f)

   the program year for which the amount is being worked out is 2004.

At the end of subsection 60(5)

Add:

1. ; (f)

   the program year for which the amount is being worked out is 2004.

Subsection 61(3)

Omit “either of the circumstances mentioned in”.

Subsection 61(4)

Omit “the circumstances are”, substitute “this subsection applies if any of the following circumstances apply to the school”.

Paragraph 61(4)(a)

Omit “and”.

At the end of subsection 61(4)

Add:

1. ; (c)

   the program year for which the amounts are being worked out is 2004.

Part 1 of Schedule 8 (table item dealing with 2004 program year, column 4)

Omit “7,414”, substitute “18,433”.
