An Act to amend the States Grants (General Purposes) Act 1994

The Parliament of Australia enacts:

1Short title

This Act may be cited as the States Grants (General Purposes) Amendment Act (No. 2) 1997.

2Commencement

This Act commences on the day on which it receives the Royal Assent.

3Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendment of the States Grants (General Purposes) Act 1994

Subclause 5(1) of Schedule 4 (definition of AS)

Omit “means the number set out opposite the name of the State in the following table”, substitute:

means:

1. (a)

   if paragraph (b) does not apply—the number set out opposite the name of the State in the table at the end of this definition; or

2. (b)

   if the regulations prescribe, in respect of each State, a number as the alcohol share for that State for the purposes of this definition—the number so prescribed in respect of the State.

Subclause 5(1) of Schedule 4 (definition of TS)

Repeal the definition, substitute:

TS (tobacco share) means:

1. (a)

   if paragraph (b) does not apply—the number set out opposite the name of the State in the table at the end of this definition; or

2. (b)

   if the regulations prescribe, in respect of each State, a number as the tobacco share for that State for the purposes of this definition—the number so prescribed in respect of the State.
