States Grants (Advanced Education) Act (No. 4) 1973 (Cth)
To amend the
[
BE IT ENACTED by the Queen, the Senate and the House of Representatives of Australia, as follows:—
(2) The
(3) Section 1
of the
(4) The Principal
Act, as amended by this Act, may be cited as the
(a) by inserting in sub-section (1), after the definition of “qualified accountant”, the following definition.:—
“‘recurrent expenditure’ means expenditure that is not capital expenditure;”; and
(b) by adding at the end of sub-section (1) the following definition:—
“‘year 1973’ , in relation to a college of advanced education specified in Part IIof the Third Schedule, does not include the period from and including 1 January 1973 to and including 30 June 1973.”.
(a) by omitting from sub-section (1) the words “a year to which this Act applies” and substituting the words and figures “the year 1973”;
(b) by inserting after sub-section (1), the following sub-section:—
“(1a) Subject to this section, in relation to a college of advanced education referred to in the First Schedule, there is payable, in respect of each of the years 1974 and 1975, to the State in which the college is situated, for the purpose of financial assistance—
(a) where a determination is in force under sub-section (2) or (3) specifying an amount to be the amount payable under this section to the State in relation to the college in respect of that year and the recurrent expenditure expended by the college upon college purposes during that year is not less than the amount so specified—an amount equal to the amount so specified;
(b) where there is no such determination in force and the recurrent expenditure expended by the college upon college purposes during that year is not less than the maximum grant specified in relation to the college in respect of that year—an amount equal to that maximum grant; or
(c) in any other case—an amount equal to that recurrent expenditure.”;
(c) by omitting from sub-section (3) the words “Seventy thousand dollars” and substituting the words “the prescribed amount”;
(d) by inserting after sub-section (3) the following sub-section:—
“(3a) In sub-section (3), ‘the prescribed amount’, in relation to a determination, means—
(a) if the determination relates to the year 1973—$70,000
; or(b) in any other case—$200,000.”;
(e) by omitting sub-sections (5), (6), (7), (8) and (9) and substituting the following sub-sections:—
“(5) Where the Minister is satisfied that—
(a) an. amount of State contribution expended after the expiration of the year 1973 related to college purposes in respect of that year; or
(b) an amount of recurrent expenditure expended after the expiration of the year 1974 or the year 1975 related to college purposes in respect of that year,
he may, in his discretion and with the approval of the State, direct that, for the purposes of this section, that amount shall be treated as having been expended during that year.
“(6) Where the Commission is satisfied that—
(a) an amount of State contribution, not exceeding $125,000, expended after the expiration of the year 1973 related to college purposes in respect of that year; or
(b) an amount of recurrent expenditure, not exceeding $200,000, expended after the expiration of the year 1974 or the year 1975 related to college purposes in respect of that year,
the Commission may, in its discretion and with the approval of the State, direct that, for the purposes of this section, that amount shall be treated as having been expended during that year.
“(7) The sum of the amounts payable under this section to a State in relation to colleges of advanced education referred to in the First Schedule shall not exceed—
(a) in respect of the year 1973—
(i) if the sum of the incomes of those colleges during that year is not less than the sum of the qualifying amounts for that year in respect of those colleges—the sum of the maximum grants for that year in respect of those colleges; or
(ii) in any other case—so much of the sum of those maximum grants as bears to that sum the same proportion as the sum of those incomes bears to the sum of those qualifying amounts; and
(b) in respect of the year 1974 or the year 1975—
(i) if the sum of the recurrent expenditures expended by those colleges upon college purposes during that year is not less than the sum of the maximum grants for that year in respect of those colleges—the sum of the maximum grants for that year in respect of those colleges; or
(ii) in any other case—the sum of those recurrent expenditures for that year.
“(8) For the purposes of sub-section (7)—
(a) a reference to the sum of the maximum grants for the year 1974 in respect of colleges situated in a State and referred to in the First Schedule shall be read as if it were a reference to the sum of—
(i) the sum of the maximum grants for that year in respect of those colleges; and
(ii) the amount (if any) by which the sum of the maximum grants for the year 1973 in respect of colleges situated in that State and referred to in that Schedule exceeds the sum of the amounts payable to that State under this section in respect of the last-mentioned year; and
(b) a reference to the sum of the maximum grants for the year 1975 in respect of colleges situated in a State and referred to in that Schedule shall be read as if it were a reference to the sum of—
(i) the sum of the maximum grants for that year in respect of those colleges; and
(ii) the amount (if any) by which the sum of the maximum grants for the year 1974 in respect of colleges situated in that State and referred to in that Schedule, including the amount referred to in sub-paragraph (ii) of paragraph (a), exceeds the sum of the amounts payable to that State under this section in respect of the last-mentioned year,
“(9) The financial assistance to a State under this section is granted on the conditions that—
(a) the State will, in respect of each payment of that financial assistance and without undue delay, ensure that the amount of the payment is applied in expenditure, other than capital expenditure, on college purposes in a manner approved by the Commission; and
(b) where the financial assistance is in respect of the year 1974 or the year 1975—the State will ensure that no college of advanced education situated in the State charges fees in respect of that year or any part of that year.”;
(f) by omitting from paragraph (a) of sub-section (12) the words “a year” and substituting the words “the year 1973”;
(g) by omitting paragraph (ab) of sub-section (12); and
(h) by omitting sub-section (13) and substituting the following sub-sections:—
“(13) For the purposes of paragraph (a) of sub-section (12), one-half of the fees received during the period from and including 1 January 1973 to and including 31 December 1973 by a college of advanced education specified in Part II of the Third Schedule shall be deemed to have been received during the period from and including 1 July 1973 to and including 31 December 1973.
“(14) For the purposes of this section—
(a) the qualifying amount in respect of a college of advanced education for the year 1973 is the amount specified in the second column of the First Schedule in respect of that college; and
(b) the maximum grant in respect of a college of advanced education for a year to which this Act applies is—
(i) in the case of the year 1973—the amount specified in the third column of the First Schedule in respect of that college;
(ii) in the case of the year 1974—the amount specified in the fourth column of that Schedule in respect of that college; and
(iii) in the case of the year 1975—the amount specified in the fifth column of that Schedule in respect of that college.”.
(a) by omitting from sub-section (1) the words “but not exceeding the State contribution” and substituting the words—
“but not exceeding—
(a) where the college is, or the colleges are, specified in Part I of the Third Schedule—five times the State contribution; or
(b) where the college is, or the colleges are, specified in Part II of the Third Schedule—nine times the State contribution.”;
(b) by inserting after sub-section(1) the following sub-sections:—
“(1a) Where the Commission is satisfied that the contribution, or the total of the contributions, made by a State during the year 1973in relation to a college of advanced education specified in the first column of the Second Schedule, for the purpose of carrying out a project specified in respect of that college in. the second column of that Schedule, exceeds—
(a) where the college is specified in Part Iof the Third Schedule—one-fifth of the prescribed amount; or
(b) where the college is specified in Part II of the Third Schedule— one-ninth of the prescribed amount,
the Commission may, at the request of that State, approve—
(c) the reduction of the amount payable to that State under sub-section (1) by an amount equal to the amount by which that contribution or the total of those contributions exceeds one-fifth or one-ninth of the prescribed amount, as the case requires; and
(d) the payment to that State, by way of financial assistance, of an amount equal to the amount of the reduction under paragraph (c).
“(1b) In sub-section (1a), ‘the prescribed amount’ means—
(a) if an amount has been determined by the Minister or by the Commission under sub-section (3) to be the maximum amount payable in respect of a project of a college of advanced education—that amount; or
(b) in any other case—the amount specified in. relation to that project of that college in the third column of the Second Schedule.”;
(c) by omitting from sub-section (2) the words “the last preceding sub-section” and substituting the word and figure “sub-section (1)”;
(d) by omitting from paragraph (b) of sub-section (3) the words “One hundred thousand dollars” and substituting the symbol and figures “$180,000”;
(e) by omitting from paragraph (b) of sub-section (6) the words “One hundred thousand dollars” and substituting the symbol and figures “$180,000”;
(f) by omitting sub-section (7) and substituting the following sub-section :—
“(7) The amount payable to a State under sub-section (1) in respect of an approved project in connexion with a college of advanced education or colleges of advanced education, not being a work or other matter specified in the second column of the Second Schedule, shall not exceed—
(a) where the college is, or the colleges are, specified in Part I of the Third Schedule—five-sixths of the approved estimated cost of the project as specified in the particulars of that work or matter approved by the Minister under section 3; and
(b) where the college is, or the colleges are, specified in Part II of the Third Schedule—nine-tenths of the approved estimated cost of the project as specified in the particulars of that work or matter approved by the Minister under section 3.”;
(g) by omitting from sub-section (9) the words “this section” and substituting the word and figure “sub-section (1)”;
(h) by inserting in sub-section (10), after the word and figure “sub-section (3)”, the words and figure “or sub-section (6)”; and
(i) by inserting in sub-section (11), after the word and figure “sub-section (3)” (second occurring), the words and figure “or sub-section (6)
“7f. (1) Subject to this section, there are payable to the State of Western Australia in respect of the period to which this Act applies, in relation to the Western Australian Institute of Technology, for the purpose of financial assistance, such amounts in respect of the costs incurred by the college in respect of the provision of facilities for, and the conduct of, a course in dental therapy as the Minister approves.
“(2) The sum of the amounts payable to the State under sub-section (1) shall not exceed $248,000.
“(3) The financial assistance to the State of Western Australia under this section is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that the amount of the payment is applied in a manner approved by the Minister towards the costs incurred by the Western Australian Institute of Technology in respect of the provision of facilities for, and the conduct of, the course in dental therapy.
“(4) As soon as practicable after 31 December in each year, the Minister shall cause a statement of the approvals given under this section in respect of that year to be laid before each House of the Parliament.
“7g.(1) Subject to sub-section (2), there is payable to the State of Victoria in respect of the period to which this Act applies, in relation to the Victoria Institute of Colleges, for the purpose of financial assistance, the sum of $800,000.
“(2) The financial assistance to the State of Victoria under sub-section (1) is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that the amount of the payment is applied, in a manner approved by the Commission, towards the costs incurred by the Victoria Institute of Colleges in respect of the establishment and conduct of the following courses:—
(a) a course at the Preston Institute of Technology that is a course in social work leading to the grant of a degree of Bachelor of Social Science;
(b) a course at the Preston Institute of Technology that is a course in physical education leading to the grant of a Diploma of Applied Science;
(c) a course at the Footscray Institute of Technology that is a course in physical education leading to the grant of a Diploma of Social Science.”.
(a) by inserting in the definition of “full-time student” in sub-section (9), after the word “education”, the words “or at a University”;
(b) by omitting from sub-section (9) the definition of “resident full-time student” and substituting the following definition:—
“‘resident full-time student in relation to a student residence or affiliated college, means a full-time student who—
(a) is a resident of the student residence or affiliated college; and
(b) in the case of a student of a college of advanced education—is pursuing a course of study approved by the Commission under section 4;”; and
(c) by adding at. the end of sub-section (9) the following definition:—
““University’ has the same meaning as in the
States Grants (Universities )Act 1972–1973.”.
“(1) A State may request the Minister to approve a grant of financial assistance in respect of a project of a student residence, or of an affiliated college, of a college of advanced education, being a project that is to be carried out in a country area of the State.
“(2) Subject to this section, where the Minister approves a project under sub-section (1), there is payable to the State, during the years 1974 and 1975, by way of financial assistance, such amount as the Commission approves, not exceeding—
(a) in the case of a project of a student residence—the estimated total capital expenditure in relation to that project; or
(b) in the case of a project of an affiliated college—three-fourths of the estimated total capital expenditure in relation to that project.
“(2a) The sum of the amounts payable under sub-section (2) shall not exceed $480,000.”.
“(1) A State may request the Minister to approve a grant of financial assistance in respect of a project of a student residence, or of an affiliated college, of a college of advanced education, being a project that relates to the provision of non-collegiate accommodation.
“(2) Subject to this section, where the Minister approves a project under sub-section (1), there is payable to the State, during the years 1974 and 1975, by way of financial assistance, an amount equal to such part of the estimated total capital expenditure in relation to the project as the Commission approves, not exceeding the product of the number of students for whom the project will provide accommodation and $2,500.
“(2a) The sum of the amounts payable under sub-section (2) shall not exceed $2,000,000.”.
“11a. Financial assistance payable to a State under this Act shall be paid in such amounts, and at such times, as the Minister thinks fit.”.
