States Grants (Advanced Education)

An Act relating to the grant of Financial Assistance to the States in connexion with Advanced Education.

BE it enacted by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, as follows:—

Short title.

1. This Act may be cited as the States Grants (Advanced Education) Act 1966.

Interpretation.

2.—(1.) In this Act, unless the contrary intention appears—

“approved project” means a project in respect of a college of advanced education, being a project—

(a) specified in the Third Schedule; or

(b) approved by the Minister under section 3 of this Act;

“capital expenditure” means—

(a) expenditure on the purchase of land, with or without buildings, the planning, erection, alteration or extension of a building, the development or preparation of land for building or other purposes or the installation of water, electricity or other services; and

(b) expenditure exceeding Two thousand dollars for the purchase of, or otherwise in connexion with, a single item of equipment;

 

“college of advanced education” means a place of education specified in a Schedule to this Act;

“college purposes”, in relation to a college of advanced education, means the general teaching purposes of that college in connexion with courses of study at that college approved by the Minister under section 3 of this Act, and includes external tuition for those courses of study and planning and other preparatory work in connexion with proposed courses of study approved by the Minister under that section;

“fees” means tuition, examination and other fees paid by a student enrolled at, or applying for enrolment at, a college of advanced education in connexion with a course of study at the college approved by the Minister under section 3 of this Act, being fees forming part of the funds available for expenditure for college purposes, and includes such fees paid in respect of the conferring of a diploma, certificate or other award in respect of such a course of study, but does not include fees the payment of which is voluntary or fees paid to an organization of students;

“library material” includes books, periodicals, newspapers, films, sound recordings, musical scores, maps, plans, pictures, photographs and prints;

“State contributions” means moneys expended for college purposes by, or out of funds provided by, a State in connexion with a college of advanced education or colleges of advanced education, other than moneys expended in fulfilment of the conditions upon which a payment is or has been made to the State by the Commonwealth under this Act or any other Act;

“year to which this Act applies” means any of the years One thousand nine hundred and sixty-seven, One thousand nine hundred and sixty-eight and One thousand nine hundred and sixty-nine.

(2.) In this Act, a reference to a Schedule shall be read as a reference to a Schedule to this Act.

Approvals in respect of courses, projects and library material.

3.—(1.) For the purposes of this Act, the Minister may—

(a) approve courses of study and proposed courses of study in respect of a college of advanced education;

(b) approve, in respect of a college of advanced education specified in the Third Schedule, particulars of a project specified in the second column of that Schedule;

(c) approve, in respect of a college of advanced education specified in the Third Schedule, projects additional to those specified in that Schedule, being projects

 

consisting of the purchase of land with or without buildings, and approve particulars, including the estimated cost, of each project so approved;

(d) approve, in respect of a college of advanced education specified in the Fourth Schedule, projects involving capital expenditure and particulars, including the estimated cost, of each project so approved; and

(e) approve, in respect of a college of advanced education, proposed library material,

and may revoke or vary any such approval.

(2.) Where a project specified in the second column of the Third Schedule consists of, or includes, the erection, alteration or extension of a building, that project shall be deemed to include the provision of furnishings and equipment for that building, or for the altered parts or the extensions of that building, as the case may be.

(3.) As soon as practicable after the Minister has approved projects in pursuance of paragraph (c) or paragraph (d) of sub-section (1.) of this section, he shall cause a statement specifying the projects and the approved estimated cost of each of the projects to be laid before each House of the Parliament.

Grants for recurrent expenditure.

4.—(1.) Subject to this section, where a college of advanced education is specified in the first column of a Part of the First Schedule, there is payable, in respect of the year to which that Part relates, to the State in which the college is situated, for the purposes of financial assistance, such amount (if any) as the Minister approves, but not exceeding the amount specified in respect of the college in the fifth column of that Part.

(2.) If an amount is specified in respect of the college in the second column of that Part and the sum of the fees received by the college during that year and the State contributions made in respect of the college during that year (other than fees or State contributions used for capital expenditure) does not exceed the amount so specified, no amount is payable to the State under this section in relation to the college in respect of that year.

(3.) If the sum of the fees received by the college during that year and the State contributions made in respect of the college during that year (other than fees or State contributions used for capital expenditure) is less than the amount specified in respect of the college in the third column of that Part, the amount payable to the State under this section in relation to the college in respect of that year shall not exceed the amount that bears to the amount ascertained by deducting from that sum the amount (if any) specified in respect of the college in the second column of that

 

Part the same proportion as the amount specified in respect of the college in the fifth column of that Part bears to the amount specified in respect of the college in the fourth column of that Part.

(4.) The financial assistance to a State under this section in relation to a college of advanced education is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that an amount equal to that payment is applied in expenditure, other than capital expenditure, on college purposes in a manner approved by the Minister.

Grants for recurrent expenditure for certain colleges in New South Wales, Victoria and Tasmania.

5.—(1.) Subject to this section, where a college of advanced education is specified in the Second Schedule, there is payable in relation to that college, in respect of a year to which this Act applies, to the State in which the college is situated, for the purposes of financial assistance, such amount (if any) as the Minister, having regard to the amount of the fees received by, and the State contributions made in respect of, the college, approves.

(2.) The sum of the amounts payable under this section to a State, in relation to the colleges of advanced education specified in the first column of the Part of the Second Schedule that relates to that State, shall not exceed the amount specified in the second column of that Part.

(3.) The financial assistance to a State under this section in relation to a college of advanced education is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that an amount equal to that payment is applied, in respect of the college, in expenditure, other than capital expenditure, on college purposes in a manner approved by the Minister.

(4.) As soon as practicable after the commencement of this Act, the Minister shall cause to be laid before each House of the Parliament a statement specifying the basis on which he proposes to approve amounts of financial assistance to States under this section.

Grants for capital expenditure on college building projects. &c.

6.—(1.) Subject to this section and to section 8 of this Act, if a State contribution in respect of a college of advanced education or colleges of advanced education specified in the Third Schedule in the period of three years to which this Act applies was made for the purpose of carrying out an approved project in connexion with the college or colleges, there is payable under this section to the State in which the college is, or the colleges are, situated, for the purposes of financial assistance, such amount (if any) as the Minister approves, but not exceeding the State contribution.

 

(2.) The amount payable to a State under the last preceding sub-section in relation to a project in connexion with a college of advanced education or colleges of advanced education, being a project specified in respect of the college or colleges in the second column of the Third Schedule, shall not exceed the amount specified in the third column of that Schedule opposite to the description of that project or such other amount as the Minister, at the request of the State, determines.

(3.) The sum of the amounts payable to the State of Victoria under sub-section (1.) of this section in relation to projects in connexion with colleges of advanced education, being projects described in the second column of the Third Schedule as “Other works and services”, shall not exceed the amount specified in the third column of that Schedule opposite to that description of those projects or such other amount as the Minister, at the request of the State, determines.

(4.) The amount payable to a State under sub-section (1.) of this section in relation to a project in connexion with a college of advanced education or colleges of advanced education, not being a project specified in the second column of the Third Schedule, shall not exceed one-half of the approved estimated cost of the project as specified in the particulars of the project approved by the Minister under section 3 of this Act.

(5.) The financial assistance to a State under this section in relation to a project in connexion with a college of advanced education or colleges of advanced education is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that an amount equal to that payment is applied towards that project in a manner approved by the Minister.

Grants for capital expenditure on certain college building projects, &c., in Victoria.

7.—(1.) Subject to this section and to the next succeeding section, if a State contribution made by the State of Victoria in respect of a college of advanced education or colleges of advanced education specified in the Fourth Schedule in the period of three years to which this Act applies was made for the purpose of carrying out an approved project in connexion with the college or colleges, there is payable under this section to that State, for the purposes of financial assistance, such amount (if any) as the Minister approves, but not exceeding the State contribution.

(2.) The amount payable to the State of Victoria under the last preceding sub-section in relation to a project shall not exceed one-half of the approved estimated cost of the project as specified in the particulars of the project approved by the Minister under section 3 of this Act.

 

(3.) The sum of the amounts payable to the State of Victoria under sub-section (1.) of this section shall not exceed the amount specified in the second column of the Fourth Schedule or such other amount as the Minister, at the request of the State, determines.

(4.) The financial assistance to the State of Victoria under this section in relation to a project in connexion with a college of advanced education or colleges of advanced education is granted on the condition that that State will, in respect of each payment of that financial assistance and without undue delay, ensure that an amount equal to that payment is applied towards that project in a manner approved by the Minister.

Limitation on grants for capital expenditure.

8.—(1.) The sum of the amounts payable to a State other than Victoria under section 6 of this Act in relation to colleges of advanced education shall not exceed the sum of the amounts specified in the third column of the Third Schedule opposite to the descriptions of projects in connexion with those colleges.

(2.) The sum of the amounts payable to the State of Victoria under the last two preceding sections in relation to colleges of advanced education shall not exceed the sum of—

(a) the amounts specified in the third column of the Third Schedule opposite to the descriptions of projects in connexion with those colleges; and (b) the amount specified in the second column of the Fourth Schedule.

Grants for acquisition of library material.

9.—(1.) Subject to this section, there is payable to a State during the period of three years to which this Act applies, in relation to a college of advanced education situated in that State, for the purposes of financial assistance, such amount (if any) in respect of library material for use in connexion with the college as the Minister approves.

(2.) The financial assistance to a State under this section in relation to a college of advanced education is granted on the condition that the State will, in respect of each payment of that financial assistance and without undue delay, ensure that an amount equal to that payment is applied in a manner approved by the Minister in the acquisition, for use by the college, of library material approved by the Minister under section 3 of this Act in relation to the college.

(3.) The sum of the amounts payable to the States under this section shall not exceed Five hundred thousand dollars.

(4.) As soon as practicable after the thirty-first day of December in each year to which this Act applies, the Minister shall cause a statement of the approvals given under this section in respect of that year to be laid before each House of the Parliament.

Additional conditions.

10. In addition to the conditions specified in any other provision of this Act, an amount of financial assistance to a State under this Act is granted on the conditions that—

(a) if the Minister informs the Treasurer of the State that he is satisfied that the State has failed to fulfil the conditions applicable to that amount, the State will repay that amount to the Commonwealth;

(b) if that amount exceeds the amount properly payable, the State will repay the excess to the Commonwealth; and

(c) in the case of an amount of financial assistance in respect of an approved project—

(i) the project will be carried out in accordance with the particulars of the project approved by the Minister under section 3 of this Act; and

(ii) the State will, whenever requested by the Minister, furnish to the Minister a report as to the progress of work, and the expected rate of further progress of work, on the project or, if work has not commencement on the project at the time when the request is made, as to the expected time of commencement of work, and the expected rate of progress of work, on the project.

Advances.

11. The Treasurer may, at such times as he thinks fit make advances of such amounts as he thinks fit to a State on account of an amount that may become payable under this Act to the State, and the conditions that would be applicable to a payment of the last-mentioned amount are applicable to any such advance.

Appropriation.

12. Payments to a State under this Act shall be made out of the Consolidated Revenue Fund, which is appropriated accordingly.
