State Superannuation Amendment

Regulations 2019

Made by the Governor in Executive Council.

1.             Citation

These regulations are the State Superannuation Amendment
Regulations 2019.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the State Superannuation
Regulations 2001.

4.             Regulation 68 amended

In regulation 68(3)(a) delete “subregulation (2)(a) or (b),” and

insert:

subregulation (2)(b),

5.             Regulation 69J amended

In regulation 69J(2) delete “writing,” and insert:

writing or by telephone,

6.             Regulation 71 amended

In regulation 71(1) in the definition of permanent incapacity

delete “SIS Regulations regulation 6.01(2).” and insert:

SIS Act section 10(1).

7.             Regulation 103 amended

In regulation 103(1)(c) delete “regulation 248B(5)(d); and” and

insert:

regulation 248B(2)(b)(ii); and

8.             Regulation 111D amended

In regulation 111D(2) delete “writing,” and insert:

writing or by telephone,

9.             Regulation 219A amended

(1)	In regulation 219A(1) in the definition of superannuation
interest delete “section 90MD)” and insert:
section 90XD)
(2)	In regulation 219A(2) delete “section 90MD —” and insert:
section 90XD —

10.           Regulation 219D amended

In regulation 219D(2)(b) delete “section 90MY.” and insert:

section 90XY.

11.           Regulation 219H amended

Delete regulation 219H(2)(d) and insert:

(d) if the transfer was made to —

(i)      the GESB Super Scheme in accordance with regulation 219D(3)(c), details of how the trustee of that fund can be contacted; or

(ii)      an eligible rollover fund in accordance with regulation 219D(3)(d), the name of the eligible rollover fund and details of how the trustee of that fund can be contacted.

12.           Regulation 251 amended

In regulation 251(1) delete “An” and insert:

Except as provided in regulations 69J(2) and 111D(2), an

13.           Schedule 1 Division 1 amended

(1)	In Schedule 1 Division 1 delete item 16A.
(2)	In Schedule 1 Division 1 after item 17 insert:

17A.	Infrastructure WA established under the Infrastructure
Western Australia Act 2019

14.           Schedule 1 Division 2 amended

In Schedule 1 Division 2 delete items 10, 38 and 40.
