State Superannuation Amendment
Regulations 2011
Made by the Governor in Executive Council.
1. Citation
These regulations are the State Superannuation Amendment
Regulations 2011.2. Commencement
These regulations come into operation as follows —
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette; (b) the rest of the regulations — on the day after that day. 3. Regulations amended
These regulations amend the State Superannuation
Regulations 2001.4. Regulation 3 amended
In regulation 3(1) insert in alphabetical order:
suffers from a terminal medical condition, in relation
to a person, means that a terminal medical condition
exists in relation to the person within the meaning
given in the Superannuation Industry (Supervision)
Regulations 1994 (Commonwealth) regulation 6.01A;
5. Regulation 45 amended
(1) In regulation 45(1) delete paragraph (c) and insert:
(c) suffers from a terminal medical condition; or (d) dies.
(2) In regulation 45(2) delete “subregulation (1)(a) or (b)” and
insert:subregulation (1)(a), (b) or (c)

(3) In regulation 45(3) delete “subregulation (1)(c)” and insert: subregulation (1)(d)
6. Regulation 74 amended
In regulation 74(1):
(a) after each of paragraphs (a), (b) and (c) insert: or
(b) after paragraph (c) insert:
(da) a West State Super Member suffers from a
terminal medical condition; or7. Regulation 76 amended
(1) After regulation 76(1)(c) insert:
(da) suffers from a terminal medical condition; or
(2) In regulation 76(2)(a) delete “(c) or (d)” and insert: (c), (da) or (d)
8. Regulation 114 amended
In regulation 114(1) after paragraph (c) insert:
(da) a GESB Super Member suffers from a terminal
medical condition; or
9. Regulation 118 amended
(1) After regulation 118(1)(b) insert:
(ca) suffers from a terminal medical condition; or
(2) In regulation 118(2)(a) delete “(b) or (c)” and insert: (b), (ca) or (c)
