STATE SPORTS CENTRE TRUST ACT 1984 - REGULATION

(Relating to money obtained from the disposal of

vehicles abandoned on Trust land)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the State Sports Centre Trust Act 1984, has been pleased to make the Regulation set forth hereunder.

The State Sports Centre Regulation 1989 is amended by inserting

after clause 23 the following clause:

Vehicles disposed of after abandonment

23A (1) The residue, if any, of any money paid to the Trust in connection with the disposal of a vehicle under clause 23 after the deduction of

(a) the fee referred to in clause 23 (6); and

(b) the reasonable costs of disposal of the vehicle,

is to be disbursed in accordance with this clause.

(2) If a person -

(a) within the period of 12 months commencing on the day on which the vehicle was disposed of, makes application to the Trust for the payment to the person of the residue referred to in subclause (1); and

(b) satisfies the Trust that the person was, when the vehicle was disposed of, the owner of the vehicle,

the residue is to be paid by the Trust to that person.

(3) If no such application has been made within that period, or if no

such application has been made successfully, the residue is to be paid

by the Trust to the Treasurer and deposited to the credit of the

Consolidated Fund.

(4) The Trust is not liable in respect of any money paid to the

Treasurer in accordance with this clause.

(5) Money that has been paid to the Treasurer in accordance with

this clause in connection with the disposal of a vehicle may be

recovered from the Treasurer by a person who satisfies the Treasurer that the person was, when the vehicle was disposed of, the owner of the vehicle.

EXPLANATORY NOTE

The object of this Regulation is to amend the State Sports Centre Regulation 1989 so as to specify the way in which money obtained from the disposal of vehicles abandoned on Trust land is to be disbursed.
