State Sporting Legislation Amendment Act 2024

The Parliament of Victoria enacts:

PART 1—PRELIMINARY

1Purposes

The purposes of this Act are—

(a)to amend the ANZAC Day Act 1958 to change the description of an area in which sports are held on ANZAC Day; and

(b)to amend the Kardinia Park Stadium Act 2016 to—

(i)permit the Minister to make event management declarations; and

(ii)abolish the Kardinia Park Advisory Committee; and

(iii)change the membership and procedures of the Trust; and

(iv)permit the Minister to delegate approval of leases that are not major leases over certain land managed by the Trust; and

(c)to amend the Melbourne and Olympic Parks Act 1985 to—

(i)change requirements relating to resignation of members from the Trust; and

(ii)change powers relating to appointment of acting members to the Trust; and

(iii)change requirements relating to approval of leases over the National Tennis Centre and Olympic Park; and

(iv)permit the Minister to delegate approval of leases that are not major leases over land managed by the Trust; and

(v)provide the Minister with discretionary powers relating to fees, allowances and remuneration of members of the Trust who are representatives of Tennis Australia Limited and the Victorian Tennis Association; and

(vi)change the membership requirements of the Trust relating to nominations made by Tennis Australia Limited and the Victorian Tennis Association; and

(d)to amend the Melbourne Cricket Ground Act 2009 to—

(i)change requirements relating to resignation of members from the Trust; and

(ii)permit the Minister to delegate the power to make floodlight determinations; and

(iii)permit the Minister to make acting appointments to the Trust; and

(iv)increase the maximum membership of the Trust; and

(e)to amend the Professional Boxing and Combat Sports Act 1985 to permit the Minister to make acting appointments to the Board; and

(f)to amend the State Sport Centres Act 1994 to—

(i)abolish the State Netball and Hockey Centre Advisory Committee; and

(ii)increase the maximum membership of the Trust; and

(iii)permit the Minister to delegate approval of leases that are not major leases over certain land managed by the Trust; and

(g)to make other minor and technical amendments to those Acts.

2Commencement

This Act comes into operation on the day after the day on which this Act receives the Royal Assent.

PART 2—AMENDMENT OF ANZAC DAY ACT 1958

3Sports on ANZAC Day

(1)In section 4(3) of the ANZAC Day Act 1958

(a)for "two" substitute "2";

(b)for "thirty miles from the post office at" substitute "50 kilometres from the


north-east side of";

(c)for "he" substitute "the Minister".

(2)In section 4(4) of the ANZAC Day Act 1958, for "two" substitute "2".

(3)In section 4(5) of the ANZAC Day Act 1958, for "he" substitute "the person".

(4)In section 4(6) of the ANZAC Day Act 1958, for "his" substitute "the person's".

4Statute law revision

(1)In section 5(1) of the ANZAC Day Act 1958, for "1.00 pm" substitute "1 p.m.".

(2)In section 5A(1) of the ANZAC Day Act 1958, for "1.00 pm" substitute "1 p.m.".

(3)In section 5C(1)(b) of the ANZAC Day Act 1958, for "day" substitute "Day".

PART 3—AMENDMENT OF KARDINIA PARK STADIUM ACT 2016

5Definitions

In section 3 of the Kardinia Park Stadium Act 2016 insert the following definition—

"major lease means a lease that—

(a)is for a term of 21 years or more; or

(b)is over the whole of the Kardinia Park Stadium Land;".

6New section 10A inserted

After section 10 of the Kardinia Park Stadium Act 2016 insert

"10A   Acting chairperson

(1)The Minister may appoint a member of the Trust to act as the chairperson during a period of vacancy if—

(a)the office of chairperson of the Trust becomes vacant under section 9 or 10; or

(b)the chairperson of the Trust is unable to perform the duties of office of chairperson because of illness or otherwise.

(2)A person appointed to act as chairperson under subsection (1)—

(a)has the rights, powers and duties of the chairperson for whom that person acts; and

(b)is entitled to receive any remuneration, fees or allowances, if any, that are fixed from time to time for the chairperson by the Minister.".

7Procedure of meetings

In section 16(2) of the Kardinia Park Stadium Act 2016 after "absent," insert "and there is no acting chairperson,".

8Section 30 repealed

(1)Section 30 of the Kardinia Park Stadium Act 2016 is repealed.

(2)The Kardinia Park Advisory Committee established by section 30 of the Kardinia Park Stadium Act 2016 is abolished.

(3)A person holding office as a member of the Kardinia Park Advisory Committee under section 30(3) of the Kardinia Park Stadium Act 2016 immediately before the commencement of this Part—

(a)ceases to hold that office; and

(b)is not entitled to any remuneration or compensation because of the loss of that office.

9New section 31A inserted

After section 31 of the Kardinia Park Stadium Act 2016 insert

"31A   Minister may delegate approval power under section 31 in relation to leases that are not major leases

(1)Subject to subsection (2), the Minister, by instrument, may delegate the Minister's approval power under section 31 to—

(a)the Secretary of the Department of the Minister administering this Act; or

(b)a person or class of person employed under Part 3 of the Public Administration Act 2004 as an executive within the meaning of that Act in the Department of the Minister administering this Act.

(2)A delegation under subsection (1)—

(a)must only be in relation to a lease over the Kardinia Park Stadium Land; and

(b)must only be in relation to a lease that is not a major lease; and

(c)may be in relation to a class of leases that are not major leases or a specific lease that is not a major lease; and

(d)may be subject to any conditions or limitations that the Minister specifies in the instrument of delegation.

10Event management declarations

In section 34 of the Kardinia Park Stadium Act 2016

(a)in subsection (1), for "On the recommendation of the Minister, the Governor in Council" substitute "The Minister";

(b)in subsection (2), for "a recommendation" substitute "an event management declaration".

11Suspension of functions, duties and powers

In section 37(2) of the Kardinia Park Stadium Act 2016 omit "a recommendation for".

PART 4—AMENDMENT OF MELBOURNE AND OLYMPIC PARKS ACT 1985

12Definitions

(1)In section 4 of the Melbourne and Olympic Parks Act 1985 insert the following definition—

"major lease means a lease that—

(a)is for a term of 21 years or more; or

(b)is over the whole of the National Tennis Centre; or

(c)is over the whole of the Olympic Park;".

(2)In section 4 of the Melbourne and Olympic Parks Act 1985, in the definition of national tennis centre land, in paragraph (f), after "Schedule;" insert "and".

(3)In section 4 of the Melbourne and Olympic Parks Act 1985, in the definition of Olympic Park, for "olympic park land" substitute "Olympic Park land".

13Further powers

(1)In section 7(1)(a)(i) of the Melbourne and Olympic Parks Act 1985, for "consent of the Minister administering the Crown Land (Reserves) Act 1978" substitute "approval of the Minister".

(2)In section 7(3)(a) of the Melbourne and Olympic Parks Act 1985 omit "his or her".

14New section 7AA inserted

After section 7 of the Melbourne and Olympic Parks Act 1985 insert

"7AA   Minister may delegate approval power under section 7(1) in relation to leases that are not major leases

(1)Subject to subsection (2), the Minister, by instrument, may delegate the Minister's approval power under section 7(1)(a)(i) to—

(a)the Secretary of the Department of the Minister administering this Act; or

(b)a person or class of person employed under Part 3 of the Public Administration Act 2004 as an executive within the meaning of that Act in the Department of the Minister administering this Act.

(2)A delegation under subsection (1)—

(a)must only be in relation to a lease that is not a major lease; and

(b)may be in relation to a class of leases that are not major leases or a specific lease that is not a major lease; and

15Membership

(1)In section 8 of the Melbourne and Olympic Parks Act 1985

(a)in paragraph (b), for "Lawn Tennis Association of Australia" substitute "Minister to represent Tennis Australia Limited";

(b)in paragraph (c), after "of the" insert "Minister to represent the".

(2)At the end of section 8 of the Melbourne and Olympic Parks Act 1985 insert

"(2)For the purposes of subsection (1)(b), Tennis Australia Limited may provide the Minister with recommended persons to consider for nomination as representative members on the Trust.

(3)For the purposes of subsection (1)(c), the Victorian Tennis Association may provide the Minister with recommended persons to consider for nomination as representative members on the Trust.".

16Terms of office

In section 10(1) of the Melbourne and Olympic Parks Act 1985, for "his or her" substitute "the member's".

17Resignation and Removal

In section 11(1) of the Melbourne and Olympic Parks Act 1985, for "Governor in Council" substitute "Minister".

18Chairperson

(1)In section 12(2) of the Melbourne and Olympic Parks Act 1985, for "his or her" substitute "the chairperson's".

(b)the chairperson of the Trust is unable to perform the duties of office of chairperson because of illness or otherwise.

(2)An acting chairperson is entitled to receive the same fees and allowances as a person appointed as chairperson of the Trust.".

21Payment of members

In section 14(1) of the Melbourne and Olympic Parks Act 1985

(a)in paragraph (b), for "2004; or" substitute "2004—";

(b)paragraph (c) is repealed.

22Procedure of Trust

In section 15(1) of the Melbourne and Olympic Parks Act 1985, for "he or she" substitute "the chairperson or person appointed as acting chairperson.".

23Effect of vacancy or defect

In section 16A(c) of the Melbourne and Olympic Parks Act 1985, after "an" insert "acting chairperson or".

24New section 35 inserted

After section 34 of the Melbourne and Olympic Parks Act 1985 insert

"35   Previous decisions, matters or things of the Trust not affected

(1)On and from the commencement of Part 4 of the State Sporting Legislation Amendment Act 2024, the Trust is taken to be the same body as it was immediately before the commencement, despite the changes to the constitution of the Trust made by that Act, and no decision, matter or thing is to be affected by those changes.

(2)The members of the Trust holding office immediately before the commencement of Part 4 of the State Sporting Legislation Amendment Act 2024 continue to hold office as members after that commencement on the same terms and conditions on which they held office as members immediately before the commencement.".

PART 5—AMENDMENT OF MELBOURNE CRICKET GROUND ACT 2009

25Constitution of Trust

In section 7(b) of the Melbourne Cricket Ground Act 2009, for "8" substitute "9".

26Resignation, removal and vacancies

(1)In section 9(1) of the Melbourne Cricket Ground Act 2009, for "to the Governor in Council" substitute "signed by the member to the Minister".

(2)In section 9(2)(a) and (b) of the Melbourne Cricket Ground Act 2009, for "his or her" substitute "the member's".

27New sections 9A and 9B inserted

After section 9 of the Melbourne Cricket Ground Act 2009 insert

"9A   Acting chairperson

(1)The Minister may appoint a member of the Trust to act as chairperson during a period of vacancy if—

(a)the office of chairperson of the Trust becomes vacant under section 9; or

(b)the chairperson of the Trust is unable to perform the duties of office of chairperson because of illness or otherwise.

(2)A member of the Trust appointed as acting chairperson under subsection (1)—

(a)has and may exercise all the powers and perform all the duties and functions of the office of chairperson; and

(b)retains their position as a member of the Trust but is not to exercise the functions and powers of a member (other than as acting chairperson) for the period of the appointment as acting chairperson; and

(c)is entitled to receive the same fees, travelling and other allowances as the person appointed as chairperson, but is not also entitled to receive the fees, travelling and other allowances of a member (other than as the acting chairperson) during the period of the appointment as acting chairperson.

(3)For the avoidance of doubt, the appointment of a member of the Trust as acting chairperson does not constitute a resignation, removal from office or vacancy in that office of member under section 9.

9BActing member

(1)If a member of the Trust is unable to perform the duties or functions of the member's office, the Minister may appoint a person qualified to be appointed to that office as an acting member during the period of inability.

(2)The Minister—

(a)subject to this Act, may determine the terms and conditions of the appointment of the acting member; and

(b)may terminate the appointment at any time.

(3)An acting member is entitled to receive the same fees, travelling and other allowances as a member.

(4)The Minister's determination of fees, travelling and other allowances under subsection (3) must be the same amount as those fixed by the Governor in Council under section 8(c).

(5)While the appointment of an acting member remains in force, the acting member has and may exercise all the powers and perform all the duties and functions of the office in which that person is acting.".

28Pecuniary and other interests of members

In section 11(1) of the Melbourne Cricket Ground Act 2009, for "his or her" substitute "the member's".

29Meetings

In section 12(2) of the Melbourne Cricket Ground Act 2009 after "absent," insert "and there is no acting chairperson,".

30New section 30A inserted

After section 30 of the Melbourne Cricket Ground Act 2009 insert

"30A   Minister may delegate floodlights determination power under section 30

(1)Subject to subsection (2), the Minister, by instrument, may delegate the Minister's power under section 30 to—

(a)the Secretary of the Department of the Minister administering this Act; or

(b)a person or class of person employed under Part 3 of the Public Administration Act 2004 as an executive within the meaning of that Act in the Department of the Minister administering this Act.

(2)A delegation under subsection (1)—

(a)may be in relation to a determination for the operation of floodlights generally or for a particular period; and

(b)may be subject to any conditions or limitations that the Minister specifies in the instrument of delegation.

31New section 34A inserted

After section 34 of the Melbourne Cricket Ground Act 2009 insert

"34A   Transitional and savings provision—Previous decisions, matters or things of the Trust not affected

(1)On and from the commencement of Part 5 of the State Sporting Legislation Amendment Act 2024, the Trust is taken to be the same body as it was immediately before the commencement, despite the changes to the constitution of the Trust made by that Act, and no decision, matter or thing is to be affected by those changes.

(2)The members of the Trust holding office immediately before the commencement of Part 5 of the State Sporting Legislation Amendment Act 2024 continue to hold office as members after that commencement on the same terms and conditions on which they held office as members immediately before the commencement.".

PART 6—AMENDMENT OF PROFESSIONAL BOXING AND COMBAT SPORTS ACT 1985

32Licence applications to be forwarded to Chief Commissioner

(1)In section 6A(4) of the Professional Boxing and Combat Sports Act 1985, for "he or she" substitute "the Chief Commissioner".

(2)In section 6A(5) of the Professional Boxing and Combat Sports Act 1985

"14BA   Acting chairperson

(1)The Minister may appoint a member of the Board to act as chairperson during a period of vacancy if—

(a)the office of chairperson of the Board becomes vacant under section 14(6) or (7); or

(b)the chairperson of the Board is unable to perform the duties of office of chairperson because of illness or otherwise.

(2)During the period of vacancy under subsection (1), the member appointed to act as chairperson—

(a)has and may exercise all the powers and perform all the duties and functions of the office of chairperson; and

(b)retains their position as a member of the Board but is not to exercise the functions and powers of a member (other than as acting chairperson) for the period of the appointment as acting chairperson.

(3)For the avoidance of doubt, the appointment of a member as acting chairperson does not constitute a vacancy in the office of member under section 14(6) or a termination of appointment under section 14(7).

(4)The acting chairperson is entitled to any fees, allowances and other expenses as determined by the Minister, but is not entitled to receive the fees, allowances and other expenses of a member (other than as the acting chairperson) during the period of the appointment as acting chairperson.

(5)The Minister's determination of fees, allowances and other expenses under subsection (4) must be the same amount as those fixed by the Governor in Council under section 14(5).

14BBActing member

(1)If a member of the Board is unable to perform the duties or functions of the member's office, the Minister may appoint a person to act in that office of member during the period of inability.

(2)The Minister—

(a)subject to this Act, may determine the terms and conditions of the appointment of the acting member; and

(b)may fix remuneration in respect of an acting member; and

(c)may terminate the appointment at any time.

(3)While the appointment of an acting member remains in force, the acting member has, and may exercise, all the powers and perform all the duties and functions of the office of member in which that person is acting.

(4)The Minister's determination of remuneration under subsection (2)(b) must be the same amount as that fixed by the Governor in Council under section 14(5).".

41Disclosure of information

In section 14E of the Professional Boxing and Combat Sports Act 1985, for "he or she" substitute "the member or employee (as the case requires)".

42Disclosure of information by Chief Commissioner

In section 14F of the Professional Boxing and Combat Sports Act 1985, for "he or she" substitute "the Chief Commissioner".

43Appointment of special counsel if review involves protected information

(1)In section 17A(4) of the Professional Boxing and Combat Sports Act 1985, for "he or she" substitute "the special counsel".

(2)In section 17A(5)(a) of the Professional Boxing and Combat Sports Act 1985, for "he or she" substitute "the special counsel".

44Decision where protected information is involved

"major lease means a lease that—

(b)is over the whole of any of the lands referred to in paragraphs (a) to (d) of the definition of State Sport Centres land;".

46Members of the Trust

In section 10 of the State Sport Centres Act 1994, for "7" substitute "11".

47Temporary vacancies

In section 14(2) of the State Sport Centres Act 1994, for "he or she" substitute "the person".

48Pecuniary and other interests of members

In section 16(1) of the State Sport Centres Act 1994, for "his or her" substitute "the member's".

49Meetings

In section 17(1) of the State Sport Centres Act 1994, for "his or her" substitute "the chairperson's".

50New section 23B inserted

After section 23A of the State Sport Centres Act 1994 insert

"23B   Minister may delegate approval power in relation to leases that are not major leases

(1)Subject to subsection (2), the Minister, by instrument, may delegate the Minister's approval power under section 25B, 26B or 26FD to—

(a)the Secretary of the Department of the Minister administering this Act; or

(b)a person or class of person employed under Part 3 of the Public Administration Act 2004 as an executive within the meaning of that Act in the Department of the Minister administering this Act.

(2)A delegation under subsection (1)—

(a)must only be in relation to a lease over the State Sport Centres land; and

(b)must only be in relation to a lease that is not a major lease; and

(c)may be in relation to a class of leases that are not major leases or a specific lease that is not a major lease; and

(d)may be subject to any conditions or limitations that the Minister specifies in the instrument of delegation.

51Powers to enter into leases

In section 25B(2) of the State Sport Centres Act 1994, for "The Trust" substitute "Subject to section 23B, the Trust".

52Powers to enter into leases

In section 26B(2) of the State Sport Centres Act 1994, for "The Trust" substitute "Subject to section 23B, the Trust".

53Section 26D repealed

(1)Section 26D of the State Sport Centres Act 1994 is repealed.

(2)The State Netball and Hockey Centre Advisory Committee established by section 26D of the State Sport Centres Act 1994 is abolished.

(3)A person holding office as a member of the State Netball and Hockey Centre Advisory Committee under section 26D(2), (2A) or (3) of the State Sport Centres Act 1994 immediately before the commencement of this Part—

54Section 26E repealed

Section 26E of the State Sport Centres Act 1994 is repealed.

55Section 26F repealed

Section 26F of the State Sport Centres Act 1994 is repealed.

56Powers to enter into leases

In section 26FD(3) of the State Sport Centres Act 1994, for "The Trust" substitute "Subject to section 23B, the Trust".

57New section 42 inserted

After section 41 of the State Sport Centres Act 1994 insert

"42   Previous decisions, matters or things of the Trust not affected

(1)On and from the commencement of Part 7 of the State Sporting Legislation Amendment Act 2024, the Trust is taken to be the same body as it was immediately before the commencement, despite the changes to the constitution of the Trust made by that Act, and no decision, matter or thing is to be affected by those changes.

(2)The members of the Trust holding office immediately before the commencement of Part 7 of the State Sporting Legislation Amendment Act 2024 continue to hold office as members after that commencement on the same terms and conditions on which they held office as members immediately before the commencement.".

PART 8—REPEAL OF THIS ACT

58Repeal of this Act

This Act is repealed on the first anniversary of the day on which it receives the Royal Assent.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
