State Penalties Enforcement and Another Regulation Amendment Regulation (No. 1) 2008 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the State Penalties Enforcement and Another Regulation Amendment Regulation (No. 1) 2008 . 2 Commencement This regulation commences on 1 January 2009. Part 2 Amendment of State Penalties Enforcement Regulation 2000 3 Regulation amended in pt 2 This part amends the StatePenaltiesEnforcementRegulation 2000. 4 Amendment of s 5 (Administering authority for particular nominated laws) Section 5(2)— omit, insert— ‘(2) In this section— nominated law does not include the following laws— (a) the Building Act 1975 ; (b) the Dangerous Goods Safety Management Act 2001 ; (c) the DangerousGoodsSafetyManagementRegulation2001 ; (d) the Electoral Act 1992 ; 2008 SL No. 449 Page 3

State Penalties Enforcement and Another Regulation Amendment Regulation (No. 1) 2008 Part 2 Amendment of State Penalties Enforcement Regulation 2000 [s 6] 6 Insertion of new ss 5B–5D After section 5A— insert— ‘5B Administering authority for Building Act 1975 ‘The administering authority for an infringement notice offence that is an offence against a provision of the BuildingAct 1975 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) for an infringement notice served by an employee of the Queensland Building Services Authority, the Queensland Building Services Authority; or (c) for an infringement notice served by an officer of the Queensland Fire and Rescue Service, the department in which the FireandRescueServiceAct1990 is administered. ‘5C Administering authority for Dangerous Goods SafetyManagement Act 2001 ‘The administering authority for an infringement notice offence that is an offence against a provision of the DangerousGoodsSafetyManagementAct2001 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) otherwise, the department in which the provision is administered. ‘5D Administering authority for Dangerous Goods SafetyManagement Regulation 2001 ‘The administering authority for an infringement notice offence that is an offence against a provision of the DangerousGoodsSafetyManagementRegulation2001 , or an infringement notice about the offence, is— 2008 SL No. 449 Page 5

State Penalties Enforcement and Another Regulation Amendment Regulation (No. 1) 2008 Part 2 Amendment of State Penalties Enforcement Regulation 2000 [s 7] (a) for an infringement notice served by an employee of a local government, the local government; or (b) otherwise, the department in which the provision is administered.’. 7 Insertion of new ss 7AA–7AC After section 7— insert— ‘7AA Administering authority for Food Act 2006 ‘The administering authority for an infringement notice offence that is an offence against a provision of the Food Act2006 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) otherwise, the department in which the provision is administered. ‘7AB Administering authority for Integrated Planning Act1997 ‘The administering authority for an infringement notice offence that is an offence against a provision of the IntegratedPlanningAct1997 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) for an infringement notice served under the VegetationManagement Act 1999 , the department in which that Act is administered; or (c) for an infringement notice served by an employee of the Queensland Building Services Authority, the Queensland Building Services Authority. State Penalties Enforcement and Another Regulation Amendment Regulation (No. 1) 2008 Part 2 Amendment of State Penalties Enforcement Regulation 2000 [s 8] ‘7AC Administering authority for Land Protection (Pest andStock Route Management) Act 2002 ‘The administering authority for an infringement notice offence that is an offence against a provision of the LandProtection (Pest and Stock Route Management) Act 2002 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) otherwise, the department in which the provision is administered.’. 8 Insertion of new s 8AB After section 8AA— insert— ‘8AB Administering authority for Public Health (InfectionControl for Personal Appearance Services) Act 2003 ‘The administering authority for an infringement notice offence that is an offence against a provision of the PublicHealth (Infection Control for Personal Appearance Services)Act 2003 , or an infringement notice about the offence, is— (a) for an infringement notice served by an employee of a local government, the local government; or (b) otherwise, the department in which the provision is administered.’. 9 Insertion of new s 8BAA Before section 8BA— insert— ‘8BAA Administering authority for Transport Operations(Road Use Management) Act 1995 ‘The administering authority for an infringement notice offence that is an offence against a provision of the Transport 2008 SL No. 449 Page 7
