s1 2 s4 State Penalties Enforcement Amendment Regulation No. 276, 2007 (No. 4) 2007 1 Short title This regulation may be cited as the State Penalties Enforcement Amendment Regulation (No. 4) 2007 . 2 Regulation amended This regulation amends the StatePenaltiesEnforcementRegulation 2000. 3 Amendment of s 5 (Administering authority for particular nominated laws) Section 5(2), definition nominated law , paragraph (h)— omit, insert — ‘(h) the WaterAct2000 , sections 360ZCB(4), 360ZCD(4), 360ZCE, 360ZCF(1), 360ZCG(4), 360ZCH(3), 360ZE(4), 389(3), 400(4), 402(4), 403, 404(1), 405(4), 406(3), 433(1), 822 and 824B(1);’. 4 Replacement of s 8BA (Administering authority for WaterAct 2000, s 360ZE(4)) Section 8BA— omit, insert — ‘8BA Administering authority for Water Act 2000, ch 2A ‘(1) The administering authority for an infringement notice offence that is a chapter 2A offence against the WaterAct2000 , or an infringement notice about the offence, is the local government for the local government area in which the offence is committed, if the local government is a water service provider for the local government area. ‘(2) In this section— chapter 2A offence against the WaterAct2000 means an offence against the WaterAct2000 , section 360ZCB(4), 360ZCD(4), 360ZCE, 360ZCF(1), 360ZCG(4), 360ZCH(3) or 360ZE(4).’.
