State Penalties Enforcement Amendment Regulation (No. 2) 2008 [s 1] 1 Short title This regulation may be cited as the State Penalties Enforcement Amendment Regulation (No. 2) 2008 . 2 Commencement This regulation commences on 1 July 2008. 3 Regulation amended This regulation amends the StatePenaltiesEnforcementRegulation 2000. 4 Amendment of s 5 (Administering authority for particular nominated laws) (1) Section 5(2), definition nominated law , paragraph (h), from ‘360ZCH(3)’— omit, insert— ‘360ZCH(3) and 360ZE(4);’. (2) Section 5(2), definition nominated law , paragraph (i)— renumber as paragraph (j) . (3) Section 5(2), definition nominated law — insert— ‘(i) the WaterSupply(SafetyandReliability)Act2008 , sections 43(3), 52(4), 54(4), 55, 56(1), 57(4), 58(3), 145(1), 191 and 195(1);’. 5 Amendment of s 5A (References to Acts) Section 5A, ‘paragraphs (a) to (i)’— omit, insert— ‘paragraphs (a) to (j)’. State Penalties Enforcement Amendment Regulation (No. 2) 2008 [s 6] 6 Replacement of s 8C (Administering authority for WaterAct 2000, other provisions) Section 8C— omit, insert— ‘8C Administering authority for Water Supply (Safetyand Reliability) Act 2008 ‘The administering authority for an infringement notice offence that is an offence against a provision of the WaterSupply (Safety and Reliability) Act 2008 , or an infringement notice about the offence, is the local government for the local government area in which the offence is committed, if the local government is a water service provider for the local government area.’. 7 Amendment of sch 5 (Other legislation) (1) Schedule 5, entry for the Water Act 2000 , entries for sections 389(3), 400(4), 402(4), 403, 404(1), 405(4), 406(3), 433(1), 822 and 824B(1)— omit .
