1.Objective
The objective of these Regulations is to provide that certain activities in relation to VicForests are authorised for the purposes of Part IV of the Trade Practices Act 1974 of the Commonwealth.
2.Authorising provisions
These Regulations are made under sections 86 and 92 of the State Owned Enterprises Act 1992.
3.Definitions
In these Regulations—
"director" means a director of VicForests;
"officer" means an officer of VicForests;
"VicForests" means the body known as "VicForests" that was established as a State body under section 14 of the State Owned Enterprises Act 1992 and declared to be a State business corporation under section 17 of that Act by Orders in Council dated 28 October 2003 published in the Government Gazette on that day.
4.Authorisation
For the purposes of Part IV of the Trade Practices Act 1974 of the Commonwealth, any act or thing done by or in relation to VicForests or any director or officer on behalf of VicForests that is specified in regulation 5 as an act or thing or kind of act or thing to which this regulation applies, is authorised during the period ending on the day that is 6 months after the day on which these Regulations come into operation, if the act or thing or kind of act or thing is done with the consent of the Treasurer.
5.Application
Regulation 4 applies to the following acts or things or kinds of acts or things—
(a)tendering or auction processes for the allocation or sale of timber resources;
(b)a contract, arrangement or understanding entered into in connection with the allocation or sale of timber resources;
(c)giving effect to a contract, arrangement or understanding of the type described in paragraph (b);
(d)any other act or thing done in connection with an act or thing or kind of act or thing described in paragraph (a), (b) or (c).
6.Expiry
These Regulations expire on the day that is 6 months after the day on which they come into operation.

1. General Information
The State Owned Enterprises (Trade Practices) Regulations 2005, S.R. No. 85/2005 were made on 5 July 2005 by the Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council under sections 86 and 92 of the State Owned Enterprises Act 1992, No. 90/1992 and came into operation on 5 July 2005.
The State Owned Enterprises (Trade Practices) Regulations 2005 will sunset on 5 January 2006: regulation 6.

There are no amendments made to the State Owned Enterprises (Trade Practices) Regulations 2005 by statutory rules, subordinate instruments and Acts.
