MR P.F. SINGLETON:   May it please your Honour, I appear with my learned friend, MS. M.T. ENGLAND, for the Commissioner of Police for New South Wales.  (instructed by Crown Solicitor (NSW) on behalf of New South Wales Commissioner of Police)

HIS HONOUR:   I should say that parties to the special leave application have indicated that they do not wish to attend today and they have been excused from attendance.  Now, you have a minute of proposed order that relates to the oral argument during the special leave application and you have another proposed minute of orders relating to certain parts of the respondent’s written summary of argument?

MR SINGLETON:   That is so, your Honour, and some other matters.

HIS HONOUR:   Yes.  You rely on, apart from earlier affidavits by the Commissioner, Mr Mitrevski’s affidavit which was sworn on 5 November?

MR SINGLETON:   That is so.

HIS HONOUR:   I will make those orders.

MR SINGLETON:   May it please your Honour.

HIS HONOUR:   Adjourn the Court.
