(1) That National Employers Mutual General

Insurance Association Limited (NEM) pay Transport Accident Commission, formerly

the State Insurance Office, (TAC) and

CMT Construction of Metropolitan Tunnels (CMT)

taxed costs in respect of NEM's counter-claim
against CMT and CMT's claim for indemnity

in respect of such counter-claim against TAC

in this Court, the Full Court of the Supreme

Court of Victoria and at first instance including reserved costs.

There will be consent orders accordingly.
