96 HOSPITALS-HOUSING. State Housing Act Amendment Act. 10 GEO. VI. No. 38, and su"!Jsection lA of this section, and in respect of which office applications are called in the manner therein provided. (ii.) In respect of filling any such position of secretary referred to in paragraph (i.) of this subsection the Public Service Commissioner shall take into considera- tion the then existing salary and/or classification, the length of service, the nature of the service, special qualifications, and such other acts, matters, and things as he shall consider necessary and desirable in respect of any such applicant under the provisions of the said paragraph (i.) of this subsection. Any such person subsequently appointed as aforesaid to the office of secretary shall be and be deemed to be an officer of the Public Service and subject to *" The Public Service Acts, 1922 to 1945," and t" The Public Service Superannuation Acts, 1912 to 1937," accordingly." [ASSENTED TO 14TH NOVEMBER, 1946.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The State Housing and . Act Amendment Act of 1946," and shall be read as one constructIon. with t" The State Housing Act of 1945," herein referred to as the Principal Act. 1946. HOUSING. State Housing Act Amendment Act. 97 2. The following section, numbered 22A, is inserted ~ ew~ 22A after section twenty-two of the Principal Act, namely :_ Inse . " [22A.] (1.) Where the Commission has ('ontracted with any person (hereinafter in this section referred to as the" contractor")forthe erection by him of a group of two or more dwelling-houses, and the contractor has completed the erection of any such dwelling-house in accordance with the contract to the satisfaction of the Commission, and has handed over such dwelling-house to the Commission, the Commission may, not earlier than the ninth day thereafter- (i.) If it has not received notice under and in accordance with *" The Contractors and Work- men's Lien Acts, 1906 to 1921," claiming a charge upon moneys payable by the Com- mission under such contract; and (ii.) If the contractor satisfies it that no person is claiming or entitled to claim any such charge, make to the contractor such payment as in its opinion would not exceed the sum which would be payable in respect of such dwelling-house if the total money payable under the contract were apportioned amongst all of the dwelling-houses included in the contract. (2.) This section shall be read and applied so as to give the Commission power to pay at its discretion, but so that the provisions hereof shall not give, or be deemed to give, to a contractor any greater right to recover payment of money from the Commission than he would have if this section had not been passed." 3. (1.) In the fifth subparagraph of paragraph (a) of Amendment clause twelve of the Schedule to the Principal Act the of s; ~. words" not exceeding twenty-five years in the case of a c. . wooden dwelling-house and not exceeding thirty years in the case of a brick or concrete dwelling-house" are repealed and the words " not exceeding thirty years" are inserted in lieu thereof.
