9058 EXPLOSIVES-FORESTS. State For"sts and National Parks Act. 6 E\lw. VII. No. 20, If either Rouse of Parliament, within forty days next after any Regulations have been so laid before such House, resolves that such Regulations or any of them ought to be annulled, the same shall, after the date of such resolu- tion, be of no effect without prejudice to the validity of anything done in the meantime under such Regulations. Exemptions. 9. The Governor in Council may from time to time, by the Regulations, exempt from the operation of this Act, either wholly or to such extent as he thinks advisable, safety fuses, safety cartridges,amorces, or any other explosive. . Forfeiture 10. In the event of any breach of this Act, by any fAocrt.breach of act or default, in any factory, magazine, or other place where explosives are manufactured or kept, then, in addition to any penalty, all or any part of the explosives (including any ingredients) in respect of which, or being in any building in respect of which, the offence was committed, may be forfeited. Penalties 11. All penalties and forfeitures imposed under this recoverable. Act shall be recoverable and adjudged in a summary way before any two justices of the peace. FORESTS. 6 Edw. VII. The Governor in Council may, from time to time, by Proclamation, permanently reserve any Crown lands and declare them to be a National Park under this Act. 3. From and after the Proclamation of a State Forest Restriction or National Park under this Act, no such State Forest or on alienation any part thereof or National Park or any part thereof shall be sold or otherwise alienated in fee-simple or for any less estate, except under the authority of an Act of Parliament: Provided that- (a) J.. eases of lands comprised in a State Forest or National Park may be granted for special purposes under sections 188 and lS8A of " The Land Act, 1897"* ; (b) Occupation licenses may be granted, under Part V. of the said last-mentioned Act, of lands comprised in a State Forest or National Park; (c) Nothing in this Act shall be construed to restrict or affect the provisions of the laws in force for the time being relating to mining for gold or other minerals upon lands comprised in a State Forest. 5. The holder of a lease or license of any land under Restriction of this Act shall not fell, cut, destrov, injure, or remove any ~ g~ s as to tree or timber on such land unless~ expressly authorised by Im er. his lease or license so to do, and then only in accordance with such authorisation. 6. (1.) The Governor in Council may, from time Regulations. to time, make Regulations for all or any of the following purposes :- (i.) The management and control of State Forests and National Parks; (ii.) Prescribing the conditions under which timber or other forest products may be cut, removed, or otherwise disposed of in a State Forest; (iii.) Prescribing the rate or amount of royalties, fees, and charges payable in respect of the cutting, removal, or other disposal of timber or other forest products in a :-;tate Forest; * 61 Vie. Reserving any tree or kind or class of trees in a State Forest either wholl v or to such extent as is considered necessary:and imposing penalties for the felling or destruction of or damage to the same; (v.) Prescribing any acts which may not be done within a State Forest or National Park without a license or permit for the doing of such act, and the conditions upon which such licenses or permits shall be granted; the protectioo of State Forests and National Parks and forest products from trespass, destruction, and damage; (vi.) Defining what shall constitute forest products for the purposes of this Act; (vii.) Authorising the seizure of timber or other forest products, and prescribing penalties not exceed- ing fifty pounds for any breaches of any regulations; (viii.) Generally for the carrying into effect the objects of this Act. Publication. (2.) All such Regulations shall be published in the Gazette, and upon being so published shall have the same effect as if they were enacted in this Act, and shall not be questioned in any proceedings whatsoever. Copies of all such Regulations shall be laid before Parliament forthwith if then sitting, and if not then sitting, within fourteen days after the commencement of' the next ensuing session. If either House of Parliament, within forty days next after any Regulations have been so laid before such House, resolves that such Regulations or any of them ought to be annulled, the same shall, after the date of such resolution, be of no effect without prejudice to the validity of anything done in the meantime under such Reg'ulations. Prosecutions. 7. All offences a~ ainst this Act or any Regulations made thereunder shall be heard and determined in a summary way by and before any two justices of the peace.
