No 6)

1     Name of plan

This plan is State Environmental Planning Policy No 56—Sydney

Harbour Foreshores and Tributaries (Amendment No 6).

2     Aims of Policy

This Policy aims to amend State Environmental Planning Policy No 56—Sydney Harbour Foreshores and Tributaries so as to include the land comprising the Caltex site at Ballast Point in Schedule 1 to that Policy, as a consequence of which certain development, if carried out on that land, will be State significant development.

3     Land to which Policy applies

This Policy applies to the land shown edged heavy black on the map sheet marked “Schedule 1—Map 18—Caltex Site, Ballast Point”, a copy of which is deposited in the head office of the Department.

4 Amendment of State Environmental Planning Policy No 56—Sydney Harbour Foreshores and Tributaries

The State Environmental Planning Policy No 56—Sydney Harbour

Foreshores and Tributaries is amended as set out in Schedule 1.

Schedule 1 Amendments

(Clause 4)

[1]     Clause 9 State significant development

Insert after clause 9 (1) (a) (ii):

(iii)      the land edged heavy black on the sheet of the map marked “Schedule 1—Map 18—Caltex Site, Ballast Point” (that land being referred to in this clause as the Caltex site), or

[2]     Clause 9 (2)

Omit “or the Rozelle Hospital site” wherever occurring.

Insert instead “, the Rozelle Hospital site or the Caltex site”.

[3]     Clause 10 Consent authority

Insert at the end of clause 10 (1) (b):

(c) development specified in clause 9 (2) that is carried out on the land edged heavy black on the sheet of the map marked “Schedule 1—Map 18—Caltex Site, Ballast Point”.

[4]     Clause 10 (4)

Insert after clause 10 (3):

(4) Leichhardt Council is the consent authority for development specified in clause 9 (2) that is carried out on the land edged heavy black on the sheet of the map marked “Schedule 1—Map 18—Caltex Site, Ballast Point”.
