No 5)

1 Name of Policy

This plan is State Environmental Planning Policy No 56—Sydney

Harbour Foreshores and Tributaries (Amendment No 5).

2 Aims of Policy

This Policy aims to amend State Environmental Planning Policy

No 56—Sydney Harbour Foreshores and Tributaries so as:

(a)	to include the land comprising the site of Rozelle Hospital in Schedule 1 to that Policy, as a consequence of which certain development, if carried out on that land, will be State significant development, and
(b)	to extend the range of development that, although carried out on land referred to in Schedule 1 to that Policy, is not State significant development if carried out on the site of Rozelle Hospital or Luna Park.

3 Land to which Policy applies

(1)	This Policy applies to the land shown edged heavy black on the map sheet marked “Schedule 1—Map 17—Rozelle Hospital”, a copy of which is deposited in the head office of the Department.
(2)	To the extent to which it deals with the matters referred to in clause 2 (b), this Policy also applies to the land shown edged heavy black on the map sheet marked “Schedule 1—Map 16—Luna Park”, a copy of which is deposited in the head office of the Department.

Schedule 1 Amendments

(Clause 4)

[1] Clause 9 State significant development

Omit clause 9 (1) (a). Insert instead:

(a)

it is development specified in subclause (2) that is carried out on any of the following land:

(i)	the land edged heavy black on the sheet of the map marked “Schedule 1—Map 16—Luna Park” (that land being referred to in this clause as the Luna Park site), or
(ii)	the land edged heavy black on the sheet of the map marked “Schedule 1—Map 17—Rozelle Hospital” (that land being referred to in this clause as the Rozelle Hospital site), or

[2] Clause 9 (2)

Insert “or the Rozelle Hospital site” after “the Luna Park site” wherever occurring.

[3] Clause 9 (2) (a)

Insert “within an existing building” after “a change in use”.

[4] Clause 9 (2) (d)

Omit “or satellite dish”. attachment to a building”.

[5] Clause 9 (2) (h) and (i)

Omit the paragraphs.

Insert after clause 9 (2) (l):

(m)

the alteration, extension or enlargement of an existing building in accordance with a master plan that the Minister has adopted for the site on which the building is situated, other than:

(i)	work involving an increase in the floor space of the building of more than 500 square metres, or
(ii)	work affecting a building that, under some other environmental planning instrument, is an item of the environmental heritage (however described),

(n)

minor development specified in Schedule 3.

[7] Clause 10 Consent authority

Omit clause 10 (1). Insert instead:

(1) Pursuant to section 76A (9) of the Act, the Minister is the consent authority for development on land to which Schedule 1 applies, other than the following development:

(a)	development specified in clause 9 (2) that is carried out on the land edged heavy black on the sheet of the map marked “Schedule 1—Map 16—Luna Park”,
(b)	development specified in clause 9 (2) that is carried out on the land edged heavy black on the sheet of the map marked “Schedule 1—Map 17—Rozelle Hospital”.

[8] Clause 10 (3)

Insert after clause 10 (2):

(3) Leichhardt Council is the consent authority for development specified in clause 9 (2) that is carried out on the land edged heavy black on the sheet of the map marked “Schedule 1—Map 17—Rozelle Hospital”.

(b) the provision and use of outdoor seating or tables or any item of street or public domain furniture (including benches, bicycle racks, bins, bollards, information signs, public artwork installations, street lights, telephone kiosks, tree surrounds and water bubblers) on a footpath or in a plaza or other public place,

BY AUTHORITY
