No 56—Sydney Harbour Foreshores

and Tributaries (Amendment No 2)

under the

Environmental Planning and Assessment Act 1979

His Excellency the Governor, with the advice of the Executive Council, has made the following State environmental planning policy under the Environmental Planning and Assessment Act 1979 in accordance with the recommendation made by the Minister for Urban Affairs and Planning. (S99/01316 Pt1)

1      Name of Policy

This Policy is State Environmental Planning Policy No 56—Sydney

Harbour Foreshores and Tributaries (Amendment No 2).

2      Principal Policy

In this Policy, State Environmental Planning Policy No 56—Sydney Harbour Foreshores and Tributaries is referred to as the Principal Policy.

Clause 3

State Environment Planning Policy No 56—Sydney Harbour Foreshores

and Tributaries (Amendment No 2)

3      Aims, objectives etc

This Policy aims to amend the Principal Policy:

(a)

to limit the definition of related structures for the purposes of the Principal Policy so that the definition includes only those structures which are related to foreshore sites that are specifically identified in the Principal Policy as land to which the Principal Policy applies, and

(b)

to make it clear:

(i)	that the development of a related structure which is related to such of the land to which the Principal Policy applies as is described in Schedule 1 to the Principal Policy is State significant development, and
(ii)	that the development of a related structure which is related to such of the land to which the Principal Policy applies as is described in Schedule 2 to the Principal Policy is taken to be development of a site of strategic significance.

4      Land to which this Policy applies

This Policy applies to the whole of the land to which the Principal

Policy applies.

5      Amendment of Principal Policy

The Principal Policy is amended as set out in Schedule 1.

Schedule 1 Amendments

(Clause 5)

[1]      Clause 3 Definitions

Insert “and which is related to a strategic foreshore site” after “not” in the definition of related structure in clause 3 (1).

[2]      Clause 4 Land to which this Policy applies

Insert “which are related to other land to which this Policy applies” after

“structures” in clause 4 (2).

[3]      Clause 8 Application of this Part

Insert at the end of the clause:

(2) This Part applies to a related structure which is related to land to which this Policy applies described in Schedule 1 in the same way as it applies to the land described in Schedule 1.

[4]      Clause 13 Application of this Part

Insert at the end of the clause:

(2) This Part applies to a related structure which is related to land to which this Policy applies described in Schedule 2 in the same way as it applies to the land described in Schedule 2.
