STATE ENVIRONMENTAL PLANNING POLICY No. 44— KOALA HABITAT PROTECTION (AMENDMENT No. 1)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Environmental Planning and Assessment Act 1979, has been pleased to make the State Environmental Planning Policy set forth hereunder in accordance with the recommendation made by the Minister for Planning.

Citation

1. This Policy may be cited as State Environmental Planning Policy

No. 44—Koala Habitat Protection (Amendment No. 1).

Commencement

2. (1) This Policy commences on 13 February 1995, except as

provided by subclause (2).

(2) Clause 7 (b) commences on 13 March 1995.

Principal Policy

3. State Environmental Planning Policy No. 44—Koala Habitat

Protection is referred to in this Policy as the Principal Policy.

Aims, objectives etc.

4. This Policy aims to amend the Principal Policy:

(a)

to vary the local government areas to which the Principal Policy

applies; and

(b) to correct a spelling error.

1995—No. 46

Application of this Policy

5. This Policy applies to the land to which the Principal Policy, as

amended by this Policy, applies.

Relationship to other environmental planning instruments

6. This Policy mends the Principal Policy in the manner set out in

clause 7.

Amendment of Principal Policy

7. The Principal Policy is mended:

(a)

by omitting the following local govement areas from Schedule 1:

Hunters Hill Shellharbour

(b)

by inserting in Schedule 1 in alphabetical order the following local government areas:

Campbelltown

Wakool

Warren

Wentworth

(c)

by omitting from Schedule 1 the word “Coollah” and by inserting

instead the word “Coolah”.
