DEVELOPMENT WITHOUT CONSENT (AMENDMENT No. 7)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Environmental Planning and Assessment Act 1979, has been pleased to make the State Environmental Planning Policy set forth hereunder in accordance with the recommendation made by the Minister for Planning. Citation

1. This Policy may be cited as State Environmental Planning Policy

NO. 4—Development Without Consent (Amendment No. 7).

Principal Policy

2. State Environmental Planning Policy No. 4—Development Without

Consent is referred to in this Policy as the Principal Policy.

Aims, objectives etc.

3. The aim of this Policy is to amend the Principal Policy to permit development for the purposes of bush fire hazard reduction without the need to obtain development consent.

Application of Policy

4. This Policy applies to the whole of the land to which the Principal

Policy applies.

Amendment of Principal Policy

5. This Principal Policy is amended by inserting after clause 11C the

following clause:

Bush fire hazard reduction

11D. (1) In this clause:

"Bush fire hazard reduction" means a reduction or modification

(by controlled burning or by mechanical, chemical or manual

means) of material that constitutes a bush fire hazard.

(2) Where, in the absence of this clause, development for the purpose of bushfire hazard reduction may be carried out only with development consent being obtained therefor, that development may be carried out without that consent if:

(a)

the development is consistent with a plan of operations, within the meaning of section 41A of the Bush Fires Act 1949, that applies to the area or locality in which it is proposed to c out that development; and

(b)

the development does not include the clearing, within the meaning of clause 7 of State Environmental Planning Policy No. 14—Croastal Wetllands, of land to which that Policy applies.
