His Excellency the Governor, with the advice of the Executive Council, has made the following State environmental planning policy under the Environmental Planning and Assessment Act 1979.

1 Name of Policy
This Policy is State Environmental Planning Policy (Exempt and Complying
Development Codes) Amendment (Trading Hours of Licensed Premises on New
Year’s Eve) 2018.
2 Commencement
This Policy commences on the day on which it is published on the NSW legislation website.
3 Repeal of Policy

Omit the clause.
[2] Clause 2.131B Specified development—extended trading hours on new year’s eve for licensed premises across the State
Omit “and without limiting the operation of clause 2.131A” from clause 2.131B (1).

Omit “2017” wherever occurring.
[4] Clause 2.131B (1) (b)
| Insert “or is otherwise permitted in accordance with an exemption under that Act” after “extended trading authorisation”. |

Omit the definition of 2017 new year’s eve trading period.
Insert in alphabetical order:
new year’s eve trading period, in relation to licensed premises, means the
period from the end of the standard trading period on 31 December 2018 to
2 am on the next succeeding day.

Omit “, 2.131A”.

Omit “, the new year’s eve trading period referred to in clause 2.131A or the 2017 new year’s eve trading period referred to in clause 2.131B (as the case requires)”.
Insert instead “or the new year’s eve trading period referred to in clause 2.131B”.
