STATE ENERGY COMMISSION (ELECTRICITY AND GAS CHARGES)

AMENDMENT BY-LAWS 1994

Made by The State Energy Commission of Western Australia with the approval of the Lieutenant-Governor and deputy of the Governor in Executive Council.

Citation

I.      These by-laws may be cited as the State Energy Commission (Electricity

and Gas Charges) Amendment By-laws 1994.

Commencement

2.     These by-laws come into operation on 1 July 1994.

First Schedule amended

4. The First Schedule to the principal by-laws is amended —
(a) by inserting after "Tariff B1" the following tariff—
exceeding 1650 units.

Special Community Service Tariff

This tariff is available for small voluntary and undermentioned conditions. charitable organizations, subject to the

Fixed charge at the rate of 22.54 cents per day. Plus all metered consumption at the rate of —

12.29 cents per unit for the first 20 units
per day.
15.98 cents for the next 1630 units per
day.
14.42 cents per unit per day for all units

Conditions for Tariff Cl

For the purposes of this tariff the consumer must comply with the following conditions.

(1) The consumer must -

(a) be a direct customer of SECWA;
(b) organization;

be a voluntary, non-profit making

(c) be classified as being tax exempt under

section 23 of the Income Tax Assessment

Act 1936 of the Commonwealth;

provide a public service, which is

(d) available to any member of the public

without discrimination;

not be a Commonwealth, State or local

(e) government department., instrumentality

or agency; and

(f)
from any organization mentioned in not receive the major part of its funding

paragraph (e).

(2) A consumer seeking supply under this Tariff must make an application to the Commission in

writing accompanied by evidence which clearly demonstrates that the consumer meets all the conditions listed in item (1).

and

(b) by deleting the Tariff and Standby charges referred to in column 1 of the Table to this paragraph the charges respectively set out
in column 2 of the Table and substituting in each case the
corresponding charge set out in column 3 of the Table.

Second Schedule amended

5. The Second Schedule to the principal by-laws is amended —

(a) in Tariff N2 by inserting after "Instrumentalities" the

following —

Cost of Supply Tariff

State, Commonwealth and Foreign Government Instrumentalities situated within the Pilbara grid system.

Tariff

Fixed charge at the rate of 28.65 cents per day.

Plus all metered consumption at the rate of

19 cents per unit.

"P-ilbara grid system" defined
For the purposes of this Tariff the "Pilbara grid system" means the electrical system from which electricity generated at one or more of the power stations at Dampier, Cape Lambert and Port Heclland respectively is supplied to consumers.

and

(c) by inserting after Tariff A2 the following Tariff —

Special Community Service Tariff

This tariff is available for small voluntary and charitable organizations, subject to the undermentioned conditions.

(1) The consumer must —

(a) be a direct customer of SEC WA;
(b) organization;

be a voluntary, non-profit making

(c)

be classified as being tax exempt under section 23 of the Income Tax Assessment Act 1936 of the Commonwealth;

(d)

provide a public service, which is available to any member of the public without discrimination;

(e)

not be a Commonwealth, State or local government department, instrumentality or agency; and

(f) not receive the major part of its funding from any organization mentioned in paragraph (e).

(2) A consumer seeking supply under this Tariff must make an application to the Commission in writing accompanied by evidence which clearly demonstrates that the consumer meets all the conditions listed in item (1).
