STATE ENERGY COMMISSION

ENDMENT ACT

No. 6 of 1991

AN ACT to amend the State Energy Commission Act 1979.

[Assented to 5 June 1991.]

The Parliament of Western Australia enacts as follows:

Short title

1. This Act may be cited as the State Energy Commission

Amendment Act 1991.

Commencement

2. This Act shall come into operation on a day to be fixed by

proclamation.

Section 124 amended

3. Section 124 of the State Energy Commission Act 1979* is

amended

(a) in subsection (4)—

(i)    by inserting before paragraph (d) (ia) the following subparagraph

It (iaa) subject to subsection (4a), the payment

of an additional amount by way of interest at the prescribed rate to be made where the payment of any amount exceeding $1 000 in relation to electricity, gas or any other form of energy supplied or services performed by the Commission is not paid in full on the date when it is due as specified by the Commission or within such time as is fixed by the Commission; ";

and

(ii)   by inserting after "charges" in paragraph (e) the following-

" and other amounts ";

and

(b) by inserting after subsection (4) the following subsection

(4a) For the purposes of calculating the amount on which interest is payable under a by-law made under subsection (4) (d) (iaa) the amounts due under separate accounts rendered to a person shall not be aggregated. ".
