514 QuEEnsIan r ANNO QUARTO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 41 of 1965 An Act to Amend " The State Electricity Commission Acts, 1937 to 1964 " and "The Electric Light and Power Acts. 1896 to 1964 ," each in certain particulars [ ASSENTED TO LOTH NOVEMBER, 1965] BE IT ENACTED by the Queen's Most Excellent Majesty. by and with the advice and consent of the Legislative Assembiv of Queensland in Parliament assembled. and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as " The State Electricity Commission Acts and Another Act Amendment Act of 1965." 2. Division of Act . This Act is divided into Parts as follows:- PART I-PRELIMINARY; PART 11-AMENDMENTS OF "THE STATE ELECTRICITY COMMISSION ACTS, 1937 TO 1964 "; AND PART III-AMENDMENTS OF " THE ELECTRIC LIGHT AND POWER ACTS. 1896 TO 1964."

State Electricity Commission Acts, Etc.. Act of 1965, No. 41 515 PART 11-AMENDMENTS OF " THE STATE ELECTRICITY COMMISSION ACTS, 1937 TO 1964" 3. (1) Interpretation of Part II . This Part II of this Act shall be read as one with " The State Electricity Commission Acts. 1937 to 1964." (2) Collective title . " The State Electricity Commission Acts, 1937 to 1964," and this Part II of this Act may be collectively cited as " The State Electricity Commission Acts, 1937 to 1965." 4. Amendment of s. 17. Section seventeen of " The State Electricity Commission Acts, 1937 to 1964," is amended by omitting subsection (3) and inserting in its stead the followingV subsection:-- (3) The Commission, in accordance with the result of an,, investigation or investigations made by it, may at its discretion make a determination varying the prices or methods of charge stated in the said Schedule or so approved as aforesaid, or substituting other prices or methods of charge in lieu thereof; and the prices or methods of charge as so varied or substituted by such determination shall at the discretion of the Commission- (a) apply in respect of each consumer to the supply of electricity supplied by the Electric Authority after the date of the regular meter reading next following the day specified by the Commission in the said determination; or (b) apply in respect of each consumer to the supply of electricit} indicated on the account forwarded by the Electric Authority next following the day specified by the Commission in the said determination and on all subsequent accounts forwarded by the Electric Authority, as if they have been stated in the said Schedule or so approved as aforesaid; and the prices and methods of charge for the time being in force may be altered in like manner at any time after the expiration of any or every period of two years or such lesser period as the Commission thinks fit after the same were last altered." 5. Amendment of s. 25 (1). Subsection (1) of section twenty-five of " The State Electricity Commission Acts, 1937 to 1964," is amended by adding to paragraph (q) the following subparagraph:- " For the purposes of this paragraph (q) the words "any moneys held by the Commission " shall include moneys standing to the credit of " The Electricity Trust Fund constituted by section eleven of this Act, whether held by or on behalf of the Commission." PART III-AMENDMENTS OF " THE ELECTRIC LIGHT AND POWER ACTS. 1896 TO 1964" 6. (1) Interpretation of Part 111 . This Part III of this Act shall be read as one with " The Electric Light and Power Acts, 1896 to 1964." (2) Collective title . " The Electric Light and Poirer Acts, 1896 to 1964," and this Part III of this Act may be collectively cited as " The Electric Light and Power Acts, 1896 to 1965."

Subsection (1) of section 4A of " The Electric Light and Power Acts, 1896 to 1964." is amended by- (a) adding to paragraph (a) the following subparagraph:- (Iii) Issue to any Electric Authority a license authorising such Electric Authority to supply electricity beyond the area in which such Electric Authority is for the time being authorised to supply electricity but within such area as shall be described in the license. (In this subparagraph " Electric Authority " includes a body corporate authorised by any Act to supply electricity and such a body corporate shall have and may exercise all such powers as are necessary to make application for and to carry out the terms and conditions of a license issued pursuant to this subparagraph.)"; and (b) omitting the proviso appearing in paragraph W.
