An Act to Amend" The State Electricity Commission STATE Acts,1937 to 1945," in certain particulars. ELECTRICITY COMMISSION ACTS AMENDMENT [ASSENTED TO 15TH DECEMBER, 1947.] ACT OF 1947. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :-- Short title 1. This Act may be cited as " The State Electricity and t t' Oommission Acts Amendment Act of 1947," and shall be cons ruc Ion. read as one with *" The State Electricity Commission Acts, 1937 to 1945," herein referred to as the Principal Act. Collective The Principal Act and this Act may collectively be title. cited as "The State Electricity Commission Acts, 1937 to 1947." Amendments 2. Section twenty-three of the Principal Act is of s. 23. amended as follows :_ (a) The first paragraph of subseCtion one thereof is repealed and the following paragraph is inserted in lieu thereof, namely :- "Nothing contained in this Act shall authorise or be deemed to authorise City Electric Light Company Limited as the Electric Authority authorised to supply .* 1 G. 6 No. 26 and amending Act.
1947. ELECTHICITY. State Electricity Commission, Etc., Act. 71 electricity within the Area defined in Schedule II. of this Act to charge or to be entitled to receive for electricity supplied at any time within any part of such Area without the City of Brisbane a maximum price which exceeds by more than ten per centum the maximum price charged by the said Company for the supply of electricity in a like case within the City of Brisbane at that time." (b) The proviso to subsection one thereof is amended by repealing the words " below the prices referred to in the preceding paragraph of this subsection." (c) Subsection two thereof is amended by repealing the words "as at the commencement of this Act" where such words twice appear therein. 3. The following section is inserted after section New s. 26A twenty-six of the Principal Act, namely :- inserted. " [26A.] (1.) If the Commission is satisfied that any Rationing of Electric Authority is, by reason of any cause or circum- electricity in stance whatsoever, not being a cause or circumstance emergency. within the control of such Electric Authority, unable for the time being- (a) To supply electricity to all or any of the persons who are consumers of electricity supplied by such Electric Authority; or (b) To supply in full the electricity required by all or any of such persons, the Commission may, with the approval of the Minister, by Order, direct, prohibit, restrict, control or regulate in any other manner whatsoever, the supply of electricity by such Electric Authority and/or the consumption of electricity supplied by such Electric Authority. Without limit to the generality of the foregoing provisions of this section, the Commission may, in any Order made under this section, make provision autho- rising, providing for and regulating the disconnection of the supply of electricity to any consumer who contravenes or fails to comply with any provision of the Order. (2.) Any Order made under this section may at any time and from time to time be amended, altered, or otherwise modified, by a further Order made hereunder.

Every such Order shall be in force for such reriod not longer than one month as may be specified therein, but the Commission may, with the approval of the Minister, by notice published in the Gazette, extend such period from time to time but so that any such extended period shall not be longer than one month: Provided that the Commission may, with the approval of the Minister, by notice published in the Gazette, revoke any such Order at any time. (4.) Any Order made under this section shall be published in the Gazette and shall, on and from the date of such publication, have the force of law and be binding upon the Electric Authority concerned and every other person whomsoever. (5.) Any Order or notice under this section shall be publicly advertised by the Electric Authority concerned in such manner as the Commission directs. (6.) Any person who contravenes or fails to comply with any provision of an Order made under this section shall be guilty of an offence against this Act and liable accordingly." Amendment 4. Subsection one of section twenty-seven of the ofs. 27 (1). Principal Act is amended by adding the following paragraph thereto, namely:- " Such Agreement may be altered from time to time pursuant to the provisions thereof by agreement between the Commission and the Company with the approval of the Governor in Council by Proclamation published in the Gazette and, subject to any such alteration being made in compliance with the requirements of subsection two of this section and of section twenty-three of this Act, no other provision of this Act shall prevent such Agreement from being so altered." Amendment 5. Clause two of Schedule IV. of the Principal Act of Soh. IV. is amended by repealing the words "at the commence- ment of this Act" and by inserting the words "at that time" in lieu of such repealed words.
