463 Qavensluu^ ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 60 of 1978 An Act to amend the State Counter - Disaster Organization Act 1975 in certain particulars [ASSENTED TO 29TH SEPTEMBER, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the State Counter-Disaster Organization Act Amendment Act 1978. (2) In this Act the StateCounter-Disaster Organization Act1975 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the State Counter-Disaster Organization Act1975-1978. 2. Amendment of s. 6. Section 6 of the Principal Act is amended by- (a) inserting before the definition " body " the following definition:- " " authorized person " means a person authorized to act by the Chairman or by a disaster district co-ordinator; ";
464 State Counter-Disaster Organization Act Amendment Act 1978, No. 60 (b) omitting the definition " disaster district controller " and substituting the definition:- disaster district co-ordinator " means a disaster _ district co- ordinator appointed under this Act; "; (c) in the definition " region " omitting the words " a disaster district or " and substituting the words " any part of a disaster district or any disaster district or any "; (d) in the definition " resources "- (i) inserting after the word " includes " the word " food,"; (ii) omitting the word " boat ," and substituting the words " vessel, aircraft,"; (iii) inserting at the end thereof the words " or any means of supplying a want or need "; (e) inserting after the definition " statutory service " the following definitions:- "vehicle" means a vehicle within the meaning of the TrafficAct1949-1977; " vessel " includes ship, boat, punt , ferry or air cushion vehicle however propelled ". 3. Repeal of and new s. 14. The Principal Act is amended by repealing section 14 and substituting the following section:- " 14. Functions of State Emergency Service. The functions of the State Emergency Service are- (a) to advise and assist Local Authorities, Government Departments, statutory organizations, voluntary groups and other bodies; (b) to educate and train members of the public (including volunteers and members of voluntary groups); (c) to co-ordinate, direct and control members of the public (including volunteers and members of voluntary groups), material and resources, with respect to counter-disaster purposes.". 4. Amendment of s. 15. Section 15 of the Principal Act is amended by inserting after paragraph (g) the following paragraph:- (h) shall advise and assist the Minister and the Chairman on all matters with respect to the State Emergency Service ". 5. Repeal of and new s. 18. The Principal Act is amended by repealing section 18 and substituting the following section:- " 18. Declaration of regions . The Governor in Council may, by Order in Council- (a) divide a disaster district into two or more parts and declare each part to be a region for the purposes of this Act;
State Counter-Disaster Organization Act Amendment Act 1978, No. 60 465 (b) declare a disaster district or any two or more disaster districts to be a region for the purposes of this Act; (c) vary any region- declared pursuant to paragraph (b) by excluding therefrom or including therein any disaster district.". 6. Amendment of s. 21 . Section 21 of the Principal Act is amended by in subsections (1) and (4) omitting the word " controller " and substituting in each case the word " co-ordinator ". 7. Amendment of s. 23. Section 23 of the Principal Act is amended by- (a) omitting from the heading thereof the word " controller " and substituting the word " co-ordinator "; (b) in subsection (1) omitting the word " controller " and substituting the word " co-ordinator " and omitting the words " or Chairman ". 8. Amendment of s. 24 . Section 24 of the Principal Act is amended by in subsection (1) omitting the word " controller " and substituting the word " co-ordinator ". 9. Amendment of s. 25 . Section 25 of the Principal Act is amended by- (a) in paragraph (b) of subsection (1) omitting the word " controller " and substituting the word " co-ordinator "; (b) in subsection (2)- (i) in paragraph (a) omitting the word " controller " and substituting the word " co-ordinator "; (ii) in paragraph (b) omitting the word " controller " where it first occurs and substituting the word " co-ordinator "; (iii) in subparagraph (iii) of paragraph (b) inserting after the word " vehicle " wherever it occurs the words " or vessel "; (c) in subsection (3) omitting the word " controller " where it first occurs and substituting the word " co-ordinator ". 10. Amendment of s. 26 . Section 26 of the Principal Act is amended by- (a) in subsection (1) omitting paragraph (b) and substituting the following paragraph:- (b) shall establish and at all times maintain within its Area a local emergency service based upon the resources of the Local Authority and including members of the State Emergency Service, volunteers and members of voluntary groups all of whom shall be resident in that Area, with such advisory committees, units and services as the Minister considers necessary or desirable; "; (b) in subsection (3) omitting paragraph (b) and substituting the following paragraph:- (b) shall establish and at all times maintain within their combined Areas a local emergency service based upon the resources of the combined Local Authorities and including members of the State Emergency Service, volunteers and members of voluntary groups all of whom shall be resident within those Areas, with such committees, units and services as the Minister considers necessary or desirable; ";
466 State Counter-Disaster Organization Act Amendment Act 1978, No. 60 (c) in subsection (4) omitting the word "controller" wherever it occurs and substituting in each case the word " co-ordinator ". 11. New s. 34A . The Principal Act is amended by inserting after section 34 the following section:- " 34A. Annual Report. The Director shall, as soon as practicable after the thirtieth day of June in each year, submit to the Minister a report on the administration and operations of the State Emergency Service for the period of twelve months immediately prior to that date. The Minister shall lay a copy of every such report before the Legislative Assembly.".
